Criminal Law in the Netherlands. Disagree with a Dutch prosecution penalty order? The legal remedy is an objection submitted to the Public Prosecution Service, following the proper procedure. Note when you learned about the penalty order. Have the deadline checked immediately, rather than waiting until the complete case file arrives. Check the correct prosecution office and permitted filing method. Include your case details and explain the reasons for your objection clearly. Keep a copy of your objection and proof of filing. Agree who will submit it; requesting the file is not itself an objection. Do not pay until your objection has been dealt with. Discuss earlier payments and any new payment reminders with your lawyer promptly. The prosecutor may withdraw or change the order. The judge may assess the case again, and a lower penalty is not guaranteed. Read the full explanation on the Criminal Law in the Netherlands website.
