Your preparation, step by step

Prepare your
next step.

Read which route suits the letter you received and create an overview for your conversation or request. You complete your own worksheet; You do not submit anything to the Public Prosecution Service, the CBR or the court.

From letter to next step

Where are you now?

Choose what's going on for you. You see which documents and questions belong to that phase. You do not have to enter any personal data for this.

Just received: complete your file

Note when you actually issued the driver's license. Keep the proof of intake, the measured value and all letters. In principle, the public prosecutor decides on withholding or restitution within ten days; weekends and holidays may be important.

  • Check which public prosecutor's office is handling your driver's license and which characteristic belongs to the case.
  • Substantiate an urgent interest with concrete documents. A request to the Public Prosecution Service and a complaint to the court are different routes; a complaint can be filed as soon as seizure takes place.
  • Do not drive while your driver's license has been suspended. A working interest does not provide an exception.

No message: check decision and transmission

Having no letter is not the same as no decision. Ask the handling public prosecutor's office when the decision was made, where the decision was sent and where your document is located. Save the answers and your contact moments.

  • Place the date of issue next to the date of the Public Prosecution Service decision. If in doubt, have the term assessed.
  • If refund is not forthcoming, you can discuss or file a complaint with the competent court. The court explains what information is required.
  • Even if you receive a message about a refund, wait until you have your driver's license in your hands. Also check any CBR restrictions and driving ban.

OM means: substantiate why a return is necessary

Read the motivation and the stated retention period. A complaint asks the court for a preliminary ruling on seizure and withholding. It has not yet made a final decision on the criminal case.

  • Collect the Public Prosecution Service decision, your arguments and verifiable supporting documents.
  • Describe your activities, the consequences and the alternatives examined. Just saying that you have to drive is less clear than a concrete explanation.
  • Check the competent court and the current filing method. A lawyer is not required for this complaint procedure.

Complaint rejected: read the decision first

Make a distinction between the preliminary decision on your complaint and a ruling in the criminal case itself. Those decisions have a different function. Do not automatically use a step-by-step plan for appealing against a criminal verdict.

  • Save the decision, the date you received it and the full motivation.
  • Have it assessed which next step in your procedure is possible and whether new circumstances are relevant. The decision aid does not calculate a period for this.
  • Further prepare the criminal case and keep your CBR file separately.

OM returns: also check the CBR decision

Return by the Public Prosecution Service does not cancel a suspension or invalidation by the CBR. Compare the OM letter and CBR decisions and check which restrictions still apply.

  • Note the decision, the requirements set and the stated objection or response period for each CBR letter.
  • Handle an objection to the CBR separately from a criminal complaint. In case of urgency, a provisional measure can be a subject for legal advice.
  • Do not rely solely on having the card. A driving ban or invalidity can also prohibit driving.

This overview organizes your next steps. It does not make a decision about your driving privileges or the chance of restitution. For specific deadlines, use the applicable rules and your own decisions.

Your preparation in one place

Worksheet for your driver's license file

List the facts, documents and questions. You can save your worksheet as a text file. Only fill in what you think is necessary; a name, BSN or medical file is not required here.

The entry remains on this page in your browser. We do not store or send your answers. Refresh or close clears the entry; a file that you download yourself remains on your device.

Which pieces do I already have?

Employed

Ask your employer to specifically describe the position, necessary journeys, frequency and consequences. Also have it explained whether other work, ride-alongs or replacement is possible. Add a roster or employment contract where appropriate; share only relevant data.

As an independent entrepreneur

Use verifiable orders, appointments, journeys and a Chamber of Commerce extract where relevant. Substantiate the business consequences and the costs or impossibility of replacement. Do not write an employer's statement on your own behalf: explain your own position and the source of each piece.

As a professional driver

Describe which driving license category you need and for which activities. Explore temporary alternatives with the employer. A professional interest does not cancel a seizure, driving ban or CBR restriction; categories and any other professional documents require separate inspection.

Draft employer declaration

An employer must check, supplement and sign this draft himself. Only include verifiable facts. The statement supports your story and does not entitle you to a refund.

The editable source template remains Dutch, so you can use it for a Dutch agency.
