CBR fitness to drive test: preparation and results

A mandatory investigation by the CBR assesses a different question than the criminal court: are you suitable or skilled enough to drive safely? The invitation can mention medical components, an interview or a driving skills assessment. Understanding which research applies is more important than looking for standard answers. This guide will help you organize documents, appointments, and remedies without predicting a medical diagnosis or positive outcome.

Start by distinguishing between aptitude and skill

Fitness to drive concerns the physical and mental conditions for safe driving. Driving skills are about traffic knowledge and vehicle control. An investigation after an alcohol or drug incident is therefore not automatically a new driving test. Nor does a successful practical ride answer every medical question. Read the research question and ask for an explanation if the name is unclear.

Compare the reason, the investigation imposed and the available documents. Do not look for a preparation that is written for a completely different procedure. An investigation during an application or extension may also proceed differently than a measure following a police report. Indicate to an advisor from which route the letter was sent.

The notification, the investigation and the outcome constitute separate steps

A police report may give rise to a mandatory investigation. That decision is not the same as the final conclusion about your fitness to drive. Those who only wait for the later results may miss an earlier objection period. Therefore, mark the date and remedy reference of each decision you receive.

The criminal case cannot yet be completed. This does not automatically make the CBR assignment provisional or non-binding. In driving suspension and CBR you can read how to distinguish between both processes. After a drug check, 's driver's license confiscated after drugs helps to distinguish the police investigations from a later CBR assessment.

Check appointments, payment and any suspension

Before the appointment, check which documents, payments and identification are required. Booking an examination date does not mean that you have met all the conditions. Immediately report any cancellation in accordance with the invitation and request written clarity about replacement. A telephone conversation in which you only explain that you are unable to attend does not guarantee that staying away is permitted.

Read separately whether the validity of the driver's license has been suspended. The single call for an investigation does not answer whether you are allowed to drive. Arrange appropriate transportation to the research location and keep any criminal restrictions in mind. Not cooperating or missing a payment can provide independent grounds for an adverse decision.

  • Save the imposition decision and the complete invitation.
  • Record research question, payments and response deadlines.
  • Bring the requested identification and available relevant documents.
  • Write down medication names and questions without changing treatment yourself.
  • Check suspension, seizure and driving ban before every trip.

Prepare facts without practicing answers

Create a business timeline of the check-up, relevant medical history and the information you remember. Indicate when something is an estimate. A consciously rehearsed story may produce differences with previous statements or medical data. The purpose of preparation is that you understand questions and can explain relevant information.

An alcohol or drug test can assess more than just a single laboratory value. Ask which parts apply to your research and how you should follow instructions. Do not independently change prescribed medication or medical treatment to influence a result; discuss health questions with a qualified health care provider and the researcher.

Read the reasoning behind the conclusion

Check whether the report mentions the correct person, dates, measurements and statements. Then see how that data supports the conclusion. A factual error is different from disagreement with an expert interpretation. Note for each passage what you think is incorrect and which document or explanation can support this.

An investigation must be conducted carefully and a report must be able to justify its findings. Disciplinary case law shows that further questions and substantiation also matter. That does not make every unfavorable report defective. Have a specific due diligence question assessed; a favorable ruling from another file does not prove your own medical suitability.

Access, correction and blocking require a conscious choice

Medical reporting may include rights of access, correction of factual inaccuracies and blocking. Read the explanation of your report and the given response period. A correction request is intended to check relevant facts, not to simply replace an unwelcome medical conclusion with your own judgment.

Blocking transmission may have consequences for the required cooperation and therefore for your driver's license. Therefore, do not use that right as an automatic way to make a negative report disappear. Ask in a timely manner what the consequences will be in your procedure. A complaint about the doctor and a response to the CBR decision must each follow their own route.

Review a second investigation and appeal separately

A letter about an unfavorable result can explain the possibility of a second examination. Check the exact application and payment conditions immediately. Do not assume that the same six weeks apply as for an objection. Also have it assessed which question a second investigation can answer and which documents the new researcher needs.

Your own medical report, a second examination within the CBR process and an objection to the decision are not interchangeable. They can complement each other, but costs and process position differ. Discuss with your advisor which substantive point is still open before you order an expensive additional assessment without a clear research question.

A medical outcome does not necessarily constitute a legal consequence

The CBR makes a decision based on the applicable rules and the investigation. Read what was actually decided, for which categories and from what date. A verbal impression during the appointment does not replace the written decision. Moreover, a good result does not automatically cancel a criminal driving ban or withholding.

In the event of an unfavorable decision, discuss an objection against the CBR and any emergency assistance with the administrative judge. In case of invalidation, the guide driver's license invalidated will help. In the meantime, continue to follow the existing obligations, unless an applicable decision demonstrably changes them.

Request a cost overview for research and legal assistance

Ask which items are paid to the CBR and which to a doctor or research institution. If you have a question about the bill, please state which route it concerns. Keep a specification of work performed. This way you can ask for a specific explanation about the invoice, without confusing the substantive dispute about fitness to drive with it.

Legal aid can be assessed separately for subsidized legal aid. The Legal Aid Board handles CBR disputes in the current administrative law policy; financial conditions and the importance and character of the dispute remain relevant. Also ask whether research costs and expert costs are not included in the assignment. Our guide lawyer costs helps make agreements concrete.

Questions from litigants

Frequently asked questions

Is a CBR test the same as a criminal blood test?

No. The police can use blood tests for criminal proceedings. A CBR examination assesses fitness to drive and may include a different question and multiple components.

Does a normal blood test prove that I am fit to drive?

A single value does not provide a complete result. The researcher and the CBR assess the relevant data in conjunction with the applicable requirements. Ask for an explanation of the basis for the report.

Can I have errors in the report corrected?

Ask about the inspection and correction procedure and respond within the specified period. Make it clear which concrete facts are incorrect and how you can substantiate this. A medical conclusion will not be replaced upon request.

Should I have a negative report blocked?

Let the consequences be assessed first. Blocking can be regarded as insufficient cooperation and affect your driver's license. It is not a guaranteed solution to an unfavorable outcome.

Do I have six weeks to request a second investigation?

Don't assume that. The conditions for a second investigation may have a different, shorter term than an objection. Check the results letter and ask for advice immediately if you have any doubts.
