Driving licence lawyer fees and legal aid (pro deo)
The costs of a driver's license lawyer do not only depend on the hourly rate. A request to the Public Prosecution Service, a complaint to the court, a criminal hearing and an objection against the CBR are different activities. A price can only be assessed once it is clear which ones are included. Subsidized legal assistance is also not assessed in the same way for every step. This guide will help you agree on a specific assignment before urgency leads to unclear financial agreements.

First ask which procedures are included in the assignment
An offer for assistance with a suspended driver's license can only include an initial assessment, but also a request with hearing assistance. Have it noted whether the file is requested, who assesses evidence and whether contact with the public prosecutor's office is included. A later criminal hearing or CBR case does not automatically fall under the same agreement.
Separate the first urgent task from the next one. For example: assessment of the withholding letter and preparation of a complaint, with a new consultation as soon as a call for the criminal case is received. This allows you to request targeted help without paying for an unknown total process. Make sure you check who is monitoring the other deadlines in the meantime.
Compare a fixed price on content and an hourly rate on budget
With a fixed price it must be clear which actions and how many treatments are included. Ask what happens in the event of additional documents, a rescheduled hearing or additional proceedings. With an hourly rate, an estimate of the time spent and an agreement on cost updates are required to assess the total.
Therefore compare two quotations based on the same assignment. A low amount for just a standard letter is different from file research, a legally substantiated letter of complaint and assistance at a hearing. Ask who will carry out the work and who can be reached when a decision comes in. The cheapest individual action does not necessarily have to be the right assignment for your file.
Indicate VAT, advance payment and additional expenses
Ask whether a stated amount includes VAT and what expenses will follow. Consider travel costs, necessary translation or an expert engaged. Determine when your prior permission is required. An advance is usually a payment in advance; clarify how it will be settled with the final declaration and when a settlement will follow.
The rules of conduct of the legal profession require clear financial agreements and information when a previous estimate is likely to be significantly exceeded. Therefore, keep the order confirmation next to the declarations. Discuss an unclear item in a timely manner with a specific question about the action taken or the basis for the amount.
- Description of the urgent step and the subsequent follow-up.
- Fixed price or rate, hour estimate and VAT.
- Includes meeting, travel, file research and contact moments.
- Arrangement for advance payment, additional work and cost updates.
- Assessment of addition, insurance and consequences of a rejection.
The complaint has no court fees, but assistance may cost money
You do not pay the court any court fees for the criminal complaint procedure regarding the return of your driving license. A lawyer is not required. This does not make the procedure free of charge if you do seek professional help. Legal aid costs and any other expenses must be assessed separately.
Submitting yourself can be an option if you have a sufficient overview of the decision, route and substantiation. In the case of unclear principles, multiple measures or a complicated term calculation, a limited assessment by a lawyer may be useful. Ask whether such a well-defined assignment is possible. Use the driver's license reclaim guide to organize the documents in advance.
An early request to the Public Prosecution Service will not automatically be added
For the single request for restitution to the Public Prosecution Service, the Legal Aid Board uses policy Z100 as a starting point that you can explain this yourself. An addition is therefore not self-evident at that stage. The policy allows for a reasoned exception in the event of, among other things, factual or legal complexity or compelling circumstances.
Before issuing a paid assignment, ask whether that exception should be investigated in your situation. Also record what you will pay if the application is rejected and whether the lawyer is carrying out any work in the meantime. A low income alone does not prove that every step within this procedure can be subsidized.
There are other options for a complaint
The same RvR policy does provide for the possibility of an addition when the legal assistance provider submits a complaint for restitution. The substantive and financial conditions remain applicable. It is also checked whether activities already fall within the scope of a previous addition. A second procedure therefore does not automatically mean a second subsidy or bill.
Let the lawyer explain the application route and ask what personal contribution or other costs may remain for you. The decision comes from the Council, not from a registration form on a website. Our explanation of pro-deo terms will help you prepare the overall financial assessment and required data.
Assess the criminal case and the CBR process separately
The defense against the traffic suspicion is not the same as the request to have the document provisionally returned. A CBR decision again concerns administrative law. Therefore, ask for each route what falls under the assignment and any additions, who will handle it and what must happen if an objection, appeal or urgent procedure is necessary.
The current RvR policy does not generally exclude CBR cases because someone could always handle them themselves. CBR disputes are assessed within the normal administrative law addition policy. The financial and substantive requirements remain applicable; not every request or simple question results in an addition. Do not confuse a possible subsidy for legal assistance with reimbursement for an imposed CBR course or research.
Examine existing coverage before ordering additional work
If you have legal expenses insurance, report the case and ask which parts are covered under your policy. Describe honestly that it concerns a traffic criminal case, restitution or CBR dispute. Insurance for business conflicts does not automatically mean coverage for every private traffic incident. Also ask whether permission is required before an external lawyer starts.
An employer may be prepared to bear costs, but record who the client is and how payment is arranged. Assistance from an employer should not be a reason to leave unclear expectations about the defense. In addition, agree on how confidential information will be treated and what billing information is actually needed.
Assess costs without purchasing a guaranteed outcome
Payment from a lawyer does not guarantee a refund. Ask for a substantiated assessment of the steps, the missing pieces and the circumstances that may contradict your request. A fixed success rate without file research tells little about your situation. A favorable preliminary decision can also be followed by a criminal driving ban.
Nor do you assume that you will automatically be reimbursed for all costs after your return. Possible compensation requires its own legal assessment and depends on the procedure and outcome. Discuss in advance whether research into reimbursement is part of the assignment. The general guide attorney fees provides additional questions for a verifiable appointment.
Frequently asked questions
Is there a fixed rate for a driver's license lawyer?
No. Offices and assignments differ. Request a written description of the work, the rate or fixed price, VAT and possible additional expenses.
Do I pay court fees for a driver's license return complaint?
No. You do not pay the court any court fees for this criminal procedure. If you engage a lawyer, legal fees may be incurred.
Can I get pro deo for my suspended driver's license?
That may be possible, but the step is important. The first Public Prosecution Service request has a different starting point than a complaint. The financial and substantive conditions and scope of previous additions must also be assessed.
Is pro deo always excluded in a CBR decision?
No. The current policy assesses CBR cases according to the normal administrative law criteria. This does not give an automatic entitlement: the nature of the work, its importance and the financial conditions remain relevant.
Are CBR course costs included with an addition?
An addition concerns subsidized legal assistance. It does not mean that the bill for a course or research will be taken over. Discuss those costs separately and check the CBR decision.
