Reclaim driving license: request and complaint
A request for a refund becomes more convincing if the reader immediately understands what decision you mean, why you need the driver's license and which documents support your story. A good letter is not a collection of standard sentences about work and family. This guide will help you distinguish between a request to the Public Prosecution Service and a complaint to the court. This concerns a provisional refund; the criminal case can continue later.

Start with the decision you are opposing
Find the police receipt and any hold letter from the officer. Has there already been a call for a Public Prosecution Service hearing or summons? This information helps determine where a complaint should be sent and which phase applies. Write down the public prosecutor's office number exactly and add the complete relevant decision.
Also check whether there is a CBR decision. A complaint in criminal law is not a general application to resolve all driving license problems. A different legal procedure applies for a CBR suspension or invalidation. See driving ban and CBR before sending a document with the wrong title.
A request to the Public Prosecution Service can make your interest visible at an early stage
The Public Prosecution Service describes the possibility of requesting provisional restitution through a petition. In it you explain what important interest you have and why alternative transport is not sufficient. Use the current filing information from the handling public prosecutor's office or the official Public Prosecution Service page; an old address from an online example can lead to delays.
A complete request does not have to be long. Create a clear timeline, state the desired decision and refer to an appendix for each important practical point. Keep an exact copy with the shipping information. A telephone communication about your work does not replace a well-recorded written request with evidence.
A complaint can be filed from the time of seizure
According to the judiciary, you may file a complaint from the moment the driver's license has been confiscated or surrendered. This can be done immediately, after a withholding decision or if no message has been received after ten days. The often heard rule that you must always wait ten days first is therefore too general.
If the Public Prosecution Service has not yet made a decision, the court can send your complaint to the officer to be included in the initial decision. That does not mean that every early filing immediately results in a court hearing. If in doubt, ask how your piece will be handled and avoid multiple conflicting versions of the same request.
No message or refusal from the Public Prosecution Service: first look up the decision
If you have not received anything after the first ten days, ask the handling public prosecutor's office if and when a decision has been made about withholding. A missing letter does not prove that the officer made a decision too late; also check the address used and the date of actual seizure. The Public Prosecution Service instruction mentions restitution if a decision on withholding has not been made in a timely manner, with application of the statutory deadline rules. This requires a check of the decision date and term, not just your mailbox.
If the withholding has been confirmed or the Public Prosecution Service has refused your request, read what reasons have been given and what information has already been taken into account. A complaint can submit that decision to the court. Add the decision and specific substantiation instead of just resending the same request. If information is missing, you can have it recorded which inquiries you made and which data are still missing.
In case of emergency, have it investigated which step is appropriate in your phase and make an upcoming work or care appointment concrete. A telephone conversation, expired expected date or submitted notice of complaint does not lift the restriction. Also ask how any refund is actually carried out and whether the document must be forwarded due to a separate obligation. Do not drive until the relevant barriers have been removed and you have received the required valid document.
Describe your work or care responsibilities with verifiable details
For work, state the position, necessary travel and working hours. Let the employer explain which tasks cannot be performed by a colleague or temporarily otherwise. When working independently, concrete assignments and journeys are more transparent than just a Chamber of Commerce extract. driving license required for work explains how to make these circumstances controllable and investigate alternatives.
In care, you can explain for whom you perform which tasks, how often and why others cannot take over. A medical diagnosis is not always necessary to describe the transport need. Share targeted evidence and agree on how sensitive attachments will be safely delivered to the right counter. Do not use this website to upload a complete criminal file.
- Name, address, contact details and public prosecutor's office number.
- Date of seizure and copy of the relevant decision.
- Clear reasons for the request and the desired provisional refund.
- Work or care items that match the interests described.
- Explanation of researched transport alternatives.
- Date, signature and proof of mailing.
Check the competent court and the transmission channel
If you already have a summons or summons for a Public Prosecution hearing, check the court of the district where you have to appear. Without such a call, the official explanation is in line with the location of the traffic incident. Check the contact details and current instructions of the relevant court.
Rechtspraak offers secure emailing for various courts; Shipping by post may also be possible. A simple email to any general address does not automatically constitute the correct submission. Check whether all attachments are legible and whether you receive an acknowledgment of receipt. Simply clicking send does not prove that the correct file has been reached.
Prepare a brief explanation and answers to questions
During the hearing, your interests can be discussed and the Public Prosecution Service can respond. Bring an organized set of pieces and make sure recent changes are known. If an employer now offers adapted work, this also includes an honest and useful explanation of the situation.
A lawyer is not required for this procedure. You can ask for help with the legal assessment or representation. The request for a provisional refund has its own character; discuss with a lawyer how an explanation relates to the defense in the original criminal proceedings.
A rejection of the complaint does not constitute a final sentence
Request the written decision and record the date of receipt. A complaint declared unfounded means that the judge has not ordered the requested provisional restitution. It is not a final ruling on guilt and punishment in the traffic case. Have an immediate assessment of what legal remedies are possible against this specific decision and what regulations apply. The route is not the same as an appeal against a later criminal judgment.
If anything significant changes afterward, keep evidence of what is new and when it occurred. Consider changed circumstances surrounding the treatment or specific interests that were previously unknown. In case law, under certain circumstances, a new complaint has been assessed on the basis of new arguments. That is not a general possibility to have the same assessment made again indefinitely. Have the meaning and correct route of the new information assessed; a repeated request does not replace a legal remedy against the previous decision.
In the case of an assignment, the other side of the same distinction applies: provisional restitution is not an acquittal and does not rule out a later driving ban. So continue preparing the criminal case, even once the urgent transport question has been resolved. A separate CBR decision also continues to require individual attention; If necessary, follow the route of objection at the CBR.
The procedure and the lawyer have different costs
You do not pay any court fees for handling this criminal complaint. If you engage a lawyer, there may be costs involved. Ask whether the price only includes the letter or also file research, contact with the public prosecutor's office and assistance at a possible hearing.
Whether subsidized legal aid is possible must be assessed separately. The guide driving license lawyer costs distinguishes the first Public Prosecution Service request, the complaint, the criminal case and the CBR process. Also read about a pro deo lawyer. A free court procedure does not mean that a chosen lawyer will automatically handle the entire traffic case for free.
Check what is still open after assignment
If the decision is positive, the driver's license must also be returned. According to the Judiciary, you are not allowed to drive before you have received it. In addition, check whether another obstacle applies. A ruling on withholding cannot be tacitly interpreted as a lifting of a separate CBR suspension. In the case of a driving license that has been invalidated, receipt of the card is also not sufficient to restore its validity.
Save the decision and record the remainder of the criminal case. A provisional decision on restitution does not rule out a subsequent driving ban. The general guide driving license recovered also helps you to continue to monitor new mail, a call and the further settlement after this first urgent step.
Frequently asked questions
Do I have to wait for the first letter from the Public Prosecution Service?
Not always. Case law mentions filing a complaint from seizure or surrender. If the Public Prosecution Service has not yet made a decision, the court can first forward the complaint to the officer.
Can my employer also submit a complaint?
According to the Judiciary, an interested party can also do this, for example an employer or a family member who is dependent for mobility. The involvement and importance must be clear.
Is an employer's statement always sufficient?
No. The statement supports an interest but does not determine the outcome. Specific activities, alternatives and other circumstances are taken into account.
Does the complaint cost court fees?
Not for this criminal procedure. Costs for a self-engaged lawyer are a separate item. Ask in advance about the work and financing.
Will I also have my CBR decision reversed with one complaint?
No. A CBR decision has a different legal procedure. Read the remedies section of that letter and monitor that period separately.
What can I do if the court rejects the complaint?
Save the written decision and have the possible legal remedies assessed immediately. A new application with the same story does not replace it. Truly new circumstances may give rise to investigating an appropriate next step; they do not automatically entitle you to a new substantive assessment or refund.
