Driving license revoked: what happens now?
After a seizure, you mainly want to know whether you can still work and when you can drive again. The answer starts with the right letter and the right agency. The police confiscate the driver's license, the Public Prosecution Service assesses the criminal case and the CBR can also decide on safe driving. These decisions do not automatically coincide. This guide will help you organize your first actions and documents.

Seizure, withholding and driving suspension mean something different
Seizure is the actual confiscation of your driver's license by the police. The officer may then decide to retain the driver's license longer: withholding. A driving disqualification is a criminal sanction. Anyone who uses these words interchangeably may mistake a temporary decision for the outcome of the entire case.
Therefore, note for each document who sent it, when it was received and what decision it contains. A receipt from the police, letter from the Public Prosecution Service and CBR decision belong in the same file, but may require different responses. A photo of only the first page often lacks the explanation on the back.
First arrange transport and store your documents
You are not allowed to drive a motor vehicle during the seizure. A moped or tractor is not a solution for getting to work yourself. Arrange transportation with someone else and make agreements with your employer. An urgent appointment or a plea of ignorance does not constitute permission to drive.
Save the date of the inspection, the proof of confiscation, the reason given by the police and the details of the handling public prosecutor's office. Make a separate note of what you observed yourself and what an officer said. This distinction prevents a suspicion from later being included in a request as an established fact.
- Record the date and time of the actual intake.
- Save the receipt and all complete letters.
- Arrange alternative transportation before planning a new trip.
- Check your mail daily and record receipt dates.
The first OM decision will be made in ten days
After seizure, the Public Prosecution Service will assess whether the driver's license will be withheld or returned. The official explanation mentions a period of ten days. That's not ten working days. The precise calculation and any extension if the end day falls on a weekend or public holiday must be checked against the applicable deadline rules.
Not receiving a letter does not mean that you can drive again on your own initiative. Ask the public prosecutor's office about the decision and record who you spoke to. If there is any uncertainty, have it checked whether a decision has been made in a timely manner and which request is appropriate. The decision does not yet relate to the final punishment for the traffic offense.
The reason determines which questions are important
For alcohol, this includes the final measured value and your status as a novice driver. When it comes to speed, the applicable limit, measurement and correction are important. The guides on alcohol and speed help organize that data without predicting a penalty yourself.
There may be several accusations at the same time, such as dangerous driving behavior in addition to speeding. Therefore, do not limit your preparation to the word that has been mentioned most often on the street. Ask which facts are being investigated and whether there is a separate driving ban, seizure of a vehicle or a report to the CBR. A Dutch seizure may also be required in the case of a foreign driving license.
An interest in restitution becomes stronger through concrete information
An employer can explain which journeys are essential, how often they take place and which activities are impossible without a driving licence. The type of assistance and available alternatives are relevant for care tasks. Simply saying that driving is easier does not make it clear why other transport would be temporarily insufficient.
Collect what is needed to make the real problem visible: working hours, accessibility data, concrete travel times and appropriate explanations. The guide driving license required for work helps an employee, driver or self-employed person to select specific proof. Do not submit an unsolicited pile of medical data. Discuss with an advisor what information is necessary and through which official channel sensitive documents can be sent safely.
Request a refund at the appropriate counter
You can request the Public Prosecution Service to temporarily return your driving license. There is also a complaint procedure at the court. According to the Judiciary, a complaint can be submitted as soon as the seizure is made; so you don't always have to wait ten days first. The court can forward the document if the Public Prosecution Service has yet to decide.
Which route makes sense in your phase depends on the available documents and the next decision. In driving license recovery you will find a document checklist. A letter to the CBR does not replace a complaint about criminal withholding, and the same applies vice versa.
Also check the CBR if the Public Prosecution Service returns
The CBR can impose a course or fitness to drive test and affect the validity of the driver's license. This is an administrative procedure with a purpose other than punishment. Therefore, with every favorable OM decision, ask whether a CBR decision or other obstacle applies before you make a new journey.
Save CBR letters in a separate tab with your own response dates and payment obligations. The absence of a criminal hearing does not mean that an investigation is canceled. The explanation about driving ban and the CBR shows why one file can contain different legal routes.
Provisional restitution does not end the criminal case
After return, another Public Prosecution Service hearing or treatment by the judge may follow. Therefore, also save evidence that may be important later and respond to a new call. A restitution letter is not an acquittal, and a complaint hearing is not a complete treatment of the original traffic suspicion.
When looking for help, you can ask whether the lawyer handles both traffic criminal law and CBR cases, what work is included in the price and whether financing is possible. Our explanation of the costs of a driving license lawyer helps to record agreements about an urgent request, the subsequent criminal case and the CBR process separately.
Frequently asked questions
Can I drive a scooter with a suspended driving license?
No. You are not allowed to drive a motor vehicle during criminal proceedings. You cannot circumvent that ban by choosing a different vehicle.
Are the ten days working days?
No, the official period is ten days. Legal term rules may play a role in the end date. Have the calculation checked and do not drive without a confirmed refund.
Will I get my driver's license back because I need it for my work?
A concretely substantiated work interest can be taken into account. It does not give an automatic right to a refund and must be weighed against the other circumstances.
Is a lawyer required for a complaint?
No. You may submit a complaint yourself. A lawyer can help with the legal basis, documentary evidence, choice of court and the concurrence with the CBR.
Can I drive as soon as the Public Prosecution Service says that the driver's license will be returned?
Wait until you have actually received the driver's license and check whether a driving ban, CBR suspension or invalidation applies. If in doubt, ask the responsible authority for clarity.
