Reclaiming seized items: the steps and considerations
If the police take your phone, car or money, you want to know why and when you will get it back. Those are separate questions. Seizures can have different purposes and the position of the owner also counts. A request for restitution is not the same as a complaint to the judge. This guide will help you organize the pieces and interests without promising a fixed duration or favorable outcome.

Why is something confiscated?
An object may be needed for evidence, it may not be allowed back into circulation according to the judicial authorities or it may be seized as security for a financial measure. The purpose makes a difference in assessing its continuation. A telephone for investigation and money held as security are not necessarily the same thing.
Therefore, ask for the legal basis and available notice. The fact that you are the owner does not answer the question of whether the criminal law interest makes the object necessary. Conversely, a criminal investigation does not mean that every object can remain in custody indefinitely.
The receipt is your first starting point
A receipt is required upon seizure or as soon as possible thereafter. Check the description, date and any identifying information. For a vehicle, think of the license plate and for equipment, think of recognizable features. Please note if an item is missing or a description is incorrect.
Also keep data that can demonstrate ownership or a right of use. Proof of purchase, rental contract, or other documentation can help explain your position. Make it clear whether it concerns your own belongings, an object belonging to the employer or the property of someone else.
Who decides on further attachments?
The Public Prosecution Service plays a central role in decisions about custody, return and other settlements. Storage can take place at another organization. The place where the object is stored and the authority that makes the decision do not have to be the same.
Use the case number when requesting information. Ask what decision has already been made and to whom you can send a reasoned request. A commitment that you do not have in writing can be difficult to check later; store received messages and confirmations carefully.
Concrete a request for a refund
Explain which item you mean, what grounds you are claiming and why return is important to you. A work phone or vehicle can have consequences for income, but that importance must be made concrete. A general statement that you need something often does not sufficiently show the consequences.
Discuss with a lawyer whether there is a useful alternative or additional information. At the same time, ask what interests would stand in the way of restitution. A request is no guarantee that the investigation has been completed or that the Public Prosecution Service will immediately release the object.
A complaint is a judicial route
Under the applicable conditions, an interested party can request a decision from the court with a complaint. Article 552a of the Code of Criminal Procedure is an important starting point. The route, competent court and term depend on the situation and the state of the case.
Therefore, have the notification and follow-up documents reviewed before sending a general model. The procedure concerns the seizure issue and is not itself a complete substantive treatment of the criminal case. A suspended driver's license requires a different specific route; see driver's license refund.
Renunciation, sale and destruction are essential decisions
Anyone who renounces in writing can no longer claim a refund. Do not take that statement solely as an acknowledgment of receipt. Ask for an explanation of what you are signing and discuss any doubts with the lawyer. A choice about ownership is separate from the question of how you explain the suspicion.
Some goods can be sold or destroyed. Filing a complaint does not automatically prevent a sale. Therefore, do not wait to report a special interest, for example if the object itself and not just a possible value is of significance to you.
Practical implications remain
If a car is seized, obligations regarding insurance, motor vehicle tax and MOT may continue. Seizure is not automatically a suspension of the license plate. Check the situation with the competent authorities and do not make an assumption based on the fact that you cannot drive the car.
With a telephone or computer, the problem may also be access to appointments, work or data. Note that importance and discuss whether a separate question can be asked about it. Do not attempt to influence the investigation by deleting data, using other people's access, or removing objects.
Work from evidence to an appropriate next step
First make an overview of the objects, the case number, the known ground and your position. Add existing decisions and ownership information. With search or a broader fraud suspicion, several questions may arise at the same time; distinguish them before you try to solve everything in one letter.
A lawyer can assess which question should now be asked and whether legal action is useful. You can prepare your choice via find a criminal lawyer. Also ask what work and costs are associated with a separate seizure procedure.
- Save the receipt and all follow-up decisions.
- Identify the item and your ownership or use position.
- Note the consequences of the seizure with concrete substantiation.
- Ask for an explanation before signing a waiver.
- Have the term, competent court and grounds for attachment assessed.
Frequently asked questions
How long can the police keep my phone?
There is no fixed return date that applies to every telephone. The seizure grounds, the interest of the investigation and further decisions must be assessed. Ask about the status and discuss the continuation of the seizure.
Will I get my car back if the criminal case ends?
You cannot deduce this solely from stopping an investigation. The decision regarding the object, the grounds for attachment and any claims of others must be made clear separately.
Does a complaint stop sales?
Not automatic. The Public Prosecution Service can, under certain conditions, alienate objects while a complaint is pending. Report special interests in a timely manner and have the options assessed.
Is renunciation the same as signing for receipt?
No. A written waiver may terminate your claim for a refund. Read the statement and ask for an explanation before signing.
