Driving license revoked due to speeding
If you significantly exceed the speed limit, your driver's license can be confiscated immediately. Various questions then arise: what speed limit applied, what speed is legally used and will the driver's license be withheld? The number on your own speedometer alone does not answer those questions. This guide shows what data you collect and why a request for refund is separate from the final assessment of the traffic offense.

When can speed lead to seizure?
The OM instruction mentions mandatory seizure if the permitted maximum speed is exceeded by fifty kilometers per hour or more. For a moped, the limit is thirty kilometers per hour or more. There must be a stop for that specific basis for seizure. Seriously dangerous driving behavior can also provide another basis.
These limits do not mean that every lower exceedance can only result in a normal traffic fine. The next step may depend on the exceedance, the type of road and the circumstances. Therefore, treat the question of whether the driver's license could be confiscated separately from the question of whether the speeding violation can be proven.
Use the determined speed after the appropriate correction
A measurement correction may apply to a measurement. The method of measurement and the data in the official report are relevant. A raw measured speed, a corrected speed and the number on your dashboard are different data. Check which of these is stated on your document before calculating the excess.
Request the file via the appropriate route or discuss this with your lawyer. Look at the measuring method, location, time and the stated limit. A technical discussion is made stronger by a specific ambiguity in the documents than by a general statement that all measuring equipment is unreliable.
Determine which limit applied at that place and time
The applicable maximum speed may depend on signage, the type of road, the time of day and temporary measures. A memory of a previous ride does not necessarily indicate which rule applied at the check. Make a note of the precise location and direction of travel; a general street name can include several road sections with other signs.
Keep existing dashcam footage or other lawfully obtained information in its original form. After seizure, do not drive yourself to photograph signs. If necessary, ask someone else to safely record the situation, with date and location. Images taken later do not necessarily show what the situation was at the time of the inspection.
After the inspection, a separate OM decision will follow
The police will forward the driver's license and the relevant documents. The Public Prosecution Service will then, in principle, decide on withholding or refunding within ten days. That is a different assessment than the final criminal case. The general guide driving license recovered provides an overview of the various decisions.
Keep a logbook with the date of collection, mail received and contact with the public prosecutor's office. If you are not notified, ask about the status instead of assuming that the deduction is over. A missing letter, a verbal expectation and actual return are not the same.
Substantiate why alternative transport is not sufficient
Anyone who visits customers every day has a different mobility problem than someone with a permanent workplace next to a station. Therefore, describe the specific tasks, services and locations. Have an employer explain whether temporary other work is possible and what consequences the absence actually has. The guide driving license required for work discusses appropriate documents for employees, self-employed persons and professional drivers.
When caring for family or medical appointments, the frequency and available support are important. Organize the information so that someone else can understand what problem will arise tomorrow and what alternatives you have explored. You can argue these interests without tailoring a statement about speed to the desired result.
- Save the data for the road section, direction of travel, date and time.
- Distinguish between measured and corrected speed.
- Collect existing images without editing files.
- Request a specific employer or healthcare statement.
- Check whether the CBR has also sent a decision in addition to the Public Prosecution Service.
A request for a refund concerns provisional availability
You can ask the Public Prosecution Service for restitution and you can file a complaint with the court. A lawyer is not required to file a complaint. The request does require a clear indication of the decision, the relevant circumstances and supporting documents. reclaim driving license explains how to approach this preparation.
The fact that the judge provisionally returns the driver's license does not mean that the violation has been refuted. Conversely, a rejection does not yet determine the final debt. Take into account a later Public Prosecution hearing or criminal hearing in your planning and keep the documentation required for this. For help, ask in advance which activities are covered by the cost agreement with the driving license lawyer.
A penalty indication on the internet does not replace the case assessment
The consequences of speeding do not depend solely on one speed figure. Previous traffic offenses, danger, the precise accusation and personal circumstances can play a role. A legal maximum, a Public Prosecution Service starting point and a judicial decision each have their own meaning. A table is not a predetermined verdict. In the case of an imposed driving ban, the implementation period and any deduction also deserve separate control.
Check which document you will receive later. A summons involves a hearing; a criminal order has a different route for a substantive objection. Have a term assessed before paying alone or sending a general email. Not every response counts as the correct legal remedy.
Safety measures taken by the CBR can continue
Unsafe driving behavior can also end up at the CBR. A decision about a CBR course or research is a separate administrative decision. The precise legal conditions depend on the observed conduct. Therefore, do not just rely on the exceedance, but read the full explanation of the decision.
Compare OM and CBR obligations with the correct authorities and response data. The page about driving ban and CBR helps recognize differences. To resume driving, all applicable barriers must be cleared, not just the decision that was first on your file.
Frequently asked questions
Will my driving license always be confiscated if I exceed the speed limit by fifty kilometers?
The OM instruction mentions mandatory seizure in the event of an arrest. Check which corrected exceedance has been determined. Other grounds may also be relevant, such as serious endangerment.
Can my own speedometer refute the police data?
A reminder on your dashboard is not in itself the same information as a monitored measurement. The measurement method, correction and other file data must be assessed.
Can I drive through because I am on my way to work?
No. Work necessity is not permission to continue driving after seizure. Arrange transport and, if necessary, substantiate this interest in a request for refund.
Am I finished with the case after provisional return?
No. A decision on the traffic offense and a driving ban may follow. A separate CBR procedure can also be completed.
How quickly does the judge handle a complaint?
The schedule depends on the court and the case. There is no general promised date of return. Make your urgent interest clear and send a complete file.
