An independent re-test after an alcohol or drug test

You receive a result after a roadside alcohol or drug investigation. If you want an independent re-test, ask immediately which procedure applies. Do not wait for other proceedings to finish.

Check which research has been carried out and what information you received about it. Breath test and blood test do not automatically have the same procedure for a check. Have the concrete instructions assessed.

Save the report and the communication about the results and independent re-test. Make a note of when you received it. Ask what period applies and what actions must be carried out before that date.

An objection letter or a question to a laboratory does not itself commission an independent re-test. Check which laboratory is suitable and how the sample, order and any payment must be arranged.

Record which sample is subject to research and how it gets to the laboratory. Save confirmations of order and payment. A loose promise that it will be arranged is insufficient certainty.

Have your attorney review the outcome in addition to the original investigation. Criminal proceedings, driving license and CBR may require their own decisions. Track their deadlines separately.
