Challenging a VOG decision in the administrative court
If Justis does not issue VOG even after an objection, the next step is not to send the same letter again. An appeal procedure requires a targeted response to the objection decision and the actual reasons therein. Our analysis: the preparation becomes stronger when each disputed judgment has its own factual source and legal question. This makes visible what the judge must assess and prevents a serious personal interest from receiving all the attention while a decisive point about function, data or policy remains undiscussed. This guide covers the phase before the administrative judge, in addition to the separate explanation of views and objections.

Start with the objection decision as a procedural document
Compare the original refusal and the decision on objection. Which reasons have remained, which have been adapted and which arguments have been responded to? The information from Justis about objections and appeals describes that an appeal to the court is possible if the refusal is upheld after an objection. An intention or primary refusal is not the same document as the decision you usually challenge at this stage. Use the correct attribute and add the required pieces.
Also make it visible whether the outcome differs completely or partially from what you asked. An improved factual description can be important while issue is still refused. That is no reason to ignore the change. An appeal that continues to challenge an error that has now been corrected may miss the current reason for refusal. Therefore, first ask the lawyer or representative to formulate the supporting motivation in plain language. Only when this is clear can you determine which arguments are still relevant and what additional substantiation is needed.
Read the filing instruction and save receipt information
Justis states a period of six weeks for appeal after the date of the decision on the objection. Check the specific legal remedies clause and have the legal calculation assessed if there is any doubt about disclosure, receipt or a special situation. Save the letter, envelope and any digital receipt data. Do not assume that calling Justis again will stop the appeal period. A formal procedure starts via the prescribed route; an employee who wants to explain something has not automatically extended a period.
Also check which court has jurisdiction and how the notice of appeal can be submitted. Digital options may differ per procedure. An ordinary email is not automatically a valid method of litigation. Rechtspraak's explanation of profession helps understand the route; the specific instructions remain decisive for your submission. If a complete file is not yet available, have it assessed in a timely manner how you can keep the period and supplement grounds or documents. Don't wait for perfection without someone being responsible for the formal step. (explanation of Rechtspraak about profession)
Connect every criticism to a decisive judgment
A ground for appeal must make it clear which part of the decision you believe is incorrect and why. This may, for example, concern data used, the description of activities, application of policy, motivation or weighing of interests. It is not enough to just write that you want to work and that the situation feels unfair. These consequences can be serious, but must be linked to the assessment you are protesting against. Show which step you think is wrong and which document supports that criticism.
Separate facts and legal conclusions. An employer can declare what access you have to money; its legal significance for the screening risk requires further reasoning. A completed treatment process can be relevant without automatically removing any risk. Do not state that a particular appendix makes the VOG mandatory if the consideration is more complicated. A specific and fairly defined ground gives the judge more guidance than absolute language that only sounds convincing when all other circumstances remain out of the picture.
A criminal charge must be properly placed
Check which status of criminal cases and registrations was used in the decision and which documents are available. An acquittal, dismissal or pending legal remedy must be precisely described. Not every change has the same meaning for every request. Have it assessed which information was relevant to the contested decision and how subsequent developments can be introduced into the procedure. A new event should not be presented unnoticed as something that Justis should have known about at the time of the previous decision.
Therefore, make a timeline with a distinction between dates of crime, settlements, application, primary refusal, objection and later documents. That order helps the judge and attorney answer the right question. A recent letter with a favorable outcome can have a lot of significance, but the procedural legal treatment must be examined. Sometimes a new application for a changed situation may also be appropriate. That is not automatically a replacement for the current appeal. Discuss both routes so that a practical new opportunity does not lead to an unseen lack of legal protection.
A new job description is not a free rewrite of the application
The Justis screening profiles connect the assessment to the purpose and risks of the position. In an appeal it may be important whether the actual activities have been described correctly. Ask an employer to confirm concrete tasks, powers and supervision and indicate since when that situation applies. A different function offered later does not necessarily have the same request purpose. Have a legal assessment of how a real change should be handled rather than just using a more favorable job title. (screening profiles of Justis)
Also describe the boundaries of supervision. A second approver may be a relevant organizational factor, but does not mean that abuse is impossible. A recommendation from the employer says something about trust and possibly about your own observations; it does not replace the assessment of the legal risk. By actually developing the function, an appeal can specifically address an assumption in the decision. This prevents the procedure from being about the good intentions of the parties while the day-to-day powers remain unclear.
Personal consequences require concrete substantiation
A missed training place or job must be made visible with the actual opportunity and conditions. Is a contract dependent on the VOG, what is the deadline and which alternatives have actually been explored? The Policy Rules VOG 2025 and the administrative law framework must be read together. A serious consequence is not an automatic conclusion, but a general sentence that work is important also does not provide sufficient information. Substantiate why this specific occasion and this person are particularly affected.
In sensitive circumstances, have each item assessed which part is necessary. A short targeted confirmation can be more informative than a complete medical record of yourself or a family member. Don't send a large collection of private information just to make the file impressive. A good grounds structure explains which interest is substantiated, how serious the consequences are and where you believe it has not been sufficiently considered. This precision helps the assessment and limits unnecessary dissemination of information that adds little to the dispute.
Fictitious example: a ground for objection to which a different response has been given
In a fictional example, Omar disputes a VOG denial because the job description says he cannot make payments independently. In the decision on objection, Justis acknowledges that difference, but then motivates the refusal on the basis of a different risk within the same activities. Omar wants to resend his old letter because it clearly states the original error. However, in doing so he would mainly repeat a point that has now been amended. The preparation now requires a response to the risk that the final decision actually carries.
The representative compares the two decisions and requests an additional, factual explanation of the relevant authority. The importance of the job is substantiated separately. Perhaps the refusal is rightly maintained; perhaps the new justification will prove insufficient. The example does not predict an outcome. It shows that an appeal requires a current assessment question. An earlier error may still have procedural significance, but it should not block the view of a now decisive argument because that old error is easier to explain.
A decision comparison with grounds for appeal and sources
Use one line per supporting point from the objection decision. State where it is stated in the decision and what response the judge is asked to give. Keep a factual correction separate from another appreciation of the same fact. The General Administrative Law Act provides the general procedural framework; the precise ground for appeal must be linked to your own decision. A matrix is a tool for preparation, not a form that can replace legal assessment.
- Decision point: passage and page number of the decision on objection.
- Previous objection: what was submitted and what was the response?
- Core criticism: factual error, policy question, lack of motivation or incorrect assessment.
- Source: the specific document, its date and its limited scope.
- Timeline: did the information already exist or is it a later development?
- Consequence: why can this point be significant for the outcome?
- Request: What decision or recovery step is legally required?
Read the matrix like someone who doesn't know your life and position. Is it clear why an appendix concerns the procedure? For example, a diploma can substantiate the importance of a training route, but does not automatically say anything about the identified risk. A statement from a supervisor has more value when one's own observations and contact period are known. With such boundaries, the judge does not have to come up with the missing reasoning himself and it remains visible which additional piece is still being sought.
An urgent job requires a separate process consideration
An impending start date may result in an urgent interest, but filing an appeal does not automatically result in a VOG. The interim measure is a separate procedure that is related to an objection or appeal and requires a temporary decision. Have a representative assess which request is possible and realistic in this VOG situation. Suspending a refusal does not automatically produce the desired positive document. An urgent request must therefore contain more than the wish that the judge immediately resolves the problem. (preliminary injunction)
Substantiate the urgency with a concrete opportunity and deadline and explain why waiting has serious consequences. Also ask what practical bridging the employer or training can offer while the procedure is ongoing. This does not make the legal request redundant, but the planning becomes less dependent on an unknown outcome. Do not accept a temporary exception to the VOG requirement without confirmation from the responsible organization. An emergency procedure and a working agreement can support each other, as long as no one promises a judicial decision or issue that does not yet exist.
An annulled decision is not always immediately issued
The judge can make various decisions. Sometimes a decision is upheld, sometimes a new decision must be made and sometimes a different procedural outcome may follow. Therefore, read the decisive part and the motivation together. Destruction does not mean that the VOG will be issued immediately in all cases; legal consequences can also be maintained. Ask what new task will follow for Justis or for you and what the associated deadline will be. A favorable passage does not replace the concrete result of the statement.
Our analysis is that a well-prepared appeal is not a second life story, but a testable criticism of a particular decision. This requires attention to the legal reason for refusal and the real consequences. With a decision comparison, targeted appendices and a fair timeline, the judge will have a more adjudicable dispute. For the earlier phase, the guide to a rejected VOG is the starting point; This in-depth focus focuses on the specific question of what still needs to be submitted to the administrative judge after an objection. Frequently asked questions
Can I go to court immediately after an intention to refuse?
That's not the usual route. First there is an opportunity for an opinion, after which a final refusal and objection can follow. An appeal is usually against the decision on objection. Have the specific letter and legal remedies information assessed.
Is mijn oude bezwaarschrift voldoende als beroepschrift?
Not by itself. Check how the grounds have been responded to and what the reasons for the refusal are. Previous arguments may remain relevant, but an appeal requires a targeted response to the decision on objection and correct submission to the competent court.
Will I receive the VOG immediately if the decision is annulled?
Not always. The ruling may require a new decision or have other consequences. Read exactly what the judge decides and which task lies with Justis or you. A favorable outcome should not be interpreted as immediate release without verification.
