Area and contact restrictions after conviction

After a conviction, a contact or location ban can apply in various legal forms. The difference is practically important: onset, duration, exceptions and consequences in case of violation depend on the precise decision. Therefore, do not just read the place or name to which the ban applies. Create a compliance card with the complete conditions and have a necessary change assessed via the correct route.

Start with the legal form of the ban

A ban may, for example, be linked to a suspended sentence after conviction or imposed as a measure restricting freedom. The provisions are contained in the Criminal Code, but your own judgment determines which form was actually used. The daily summary I have a restraining order often omits that basis. Precisely because of this, uncertainty can arise about supervision, implementation and the possibility of requesting a change. Collect the full statement and any subsequent decisions before relying on a loose verbal explanation.

Create separate rules when multiple restrictions apply simultaneously. An area ban and a contact ban may differ in scope and conditions. A special condition can also exist in addition to an independent measure. Removing or changing one part does not automatically cancel the other. Therefore, ask the lawyer which decisions together determine the current situation. An overview that only contains the latest letter may miss an older but still valid part. The legal history is necessary to properly organize current compliance.

A legal remedy does not automatically say that you can wait

Check when the decision takes effect and whether a part has been declared immediately enforceable. An appeal lodged does not mean in every situation that a ban is temporarily ineffective. The applicable basis, operative part and any implementation decisions must be read together. Ask for specific explanations for your case. A general comment from someone you know that nothing is final yet can give an incorrect impression of what you must comply with in the meantime. Uncertainty is a reason for control, not an own exception.

Also note the duration and the relevant end moment. A probationary period, duration of measure and period of supervision are not necessarily the same period. Check whether changes or coincidences affect the calculation. Don't just use a self-calculated calendar date to assume everything is over. Have an important end moment confirmed on the basis of the applicable documents. This allows practical planning to be based on actual operation rather than on a memory of approximately what was said during the statement.

Words like indirect and environment can make a big difference

Read which forms of contact are prohibited. This may involve direct contact, having contact made or contact via digital channels, depending on the wording. Do not have a message transferred via a family member because you are not calling yourself, without having the reach assessed. The protected person may be described differently in the text than in an informal summary. Also ask how a response to an unexpected incoming message should be handled. Make practical agreements that are in line with the decision and avoid your own broad interpretation of an alleged exception.

In the case of a location ban, it must be clear which area, address, distance or map section is meant. A border can be relevant for work, transport and daily shopping. Place the formal description next to a useful route plan and have an unclear point clarified. A map that you draw yourself should not reduce the decision unnoticed. Also discuss what to do in the event of an accidental encounter or necessary passage. A safe course of action agreed in advance is more useful than trying to explain afterwards why your own interpretation seemed self-evident.

Only appropriate authority can change the situation

Some decisions contain a concrete option for written permission from a named authority. Others do not or use a limited exception for a specific purpose. Therefore, read who is allowed to give permission, for what purpose and in what form. A verbal agreement from someone familiar with the matter is not automatically the prescribed exception. Request specific confirmation and keep it with the relevant decision. General accessibility of a supervisor does not mean that every employee can adjust the content outside of the judgment.

Consent of the person being protected is also not a general waiver. The ban has a legal basis that cannot be changed solely by mutual agreement. This can also occur when there is a shared interest, for example regarding goods or children. Have such practical issues organized through an authorized route. Do not consult yourself to find a solution if that contact may fall under the ban. A carefully prepared request can make the necessary issue open for discussion without violating the restriction.

A destroyed component may leave other conditions intact

In a judgment of April 22, 2025, the Supreme Court annulled a freedom-restricting measure and its immediate enforceability due to the applicable sanction rules over time. However, the special conditions attached to a suspended prison sentence remained in place. That distinction in the dictum is practically important. The ruling does not show that every similar ban is invalid; the specific proven period and legal basis were decisive for the partial annulment.

The lesson for a new file is that the word prohibition does not describe one indivisible decision. A favorable ruling on a measure must be read alongside remaining conditions. After each legal remedy, ask which parts actually change and which remain valid. Do not rely on a summary that the restraining order is gone if the decision contains more nuance. Our editorial analysis is that extra care is needed especially after a favorable outcome: relief can lead to another valid part disappearing from view too quickly.

Compliance also requires a feasible daily organization

Translate the restrictions into concrete situations: commuting route, picking up items, shared appointments and digital contact. Do this with legal or accompanying coordination where necessary. A plan that just says avoid contact may be too vague if both people regularly use the same facility. Ask which practical solution fits within the decision. This could be a different route or a permitted professional intermediary, but only where the applicable rules actually allow it. A practical wish is not automatically a permitted form of contact.

Also discuss who informs data subjects about relevant boundaries without sharing more private data than necessary. An employer does not need to receive the entire criminal file to understand a route or location problem. Keep consent and exceptions accessible when lawfully given. In case of problems with implementation, help must be requested in a timely manner. An appointment that is only requested afterwards cannot automatically justify what has already happened. Therefore, also create an alternative in case the answer is not received on time or a request is not granted.

A new workplace within the prohibited area

Fictional example: Leon is offered a job at a location within the area stated in his judgment. He thinks that work interests are sufficient reason to go there anyway. His compliance card shows that a specific legal measure applies and that no automatic work exception has been included. He discusses with his lawyer what request for change is possible and what substantiation may be required. Until an appropriate decision exists, he does not plan as if the track independently overrides the ban.

The employer receives limited information about the practical obstacle and a possible alternative. The fictional example does not predict assignment; the importance of protection and the applicable jurisdiction remain relevant. It shows why a change request is not just a new schedule agreement. A substantiated proposal can indicate exactly what problem needs to be solved and what limitations are possible. This makes the question verifiable without having to approach the protected person or enter the area to demonstrate the necessity in practice.

A card with rules, exceptions and open questions

Create your own card for each individual disability. Include the source decision and date at the top so that an old version is not confused with a later change. Use the exact wording as an appendix and also include an understandable summary. Mark where legal explanation is still needed. An unknown point may not be colored as permission. The map is a practical tool for compliance and consultation; it itself does not change the effect of the ban. Check her again after each new decision.

  • Basis: special condition, Article 38v measure or other legal form.
  • Contents: protected person, area, channel and prohibited act.
  • Operation: start, duration, relevant end question and possible immediate feasibility.
  • Exception: precise text, authorized consentor, purpose and required form.
  • Practice: routes, work, goods, family issues and safely feasible alternative.
  • Incident: agreed course of action in the event of unexpected contact and appropriate recording.
  • Change: specific problem, source documents, authorized route and monitored response.

Record only necessary data and keep the card safe. A publicly shared calendar with address information of the protected person can create unnecessary new risks. Discuss who can see the map and which version is current. When giving permission, indicate the date, purpose and possible restriction. This prevents a one-off exception from being remembered later as a general exemption. A simple overview with correct sources is more valuable than many verbal explanations of which no one knows exactly who gave it and how long it was valid.

A change in circumstances requires an appropriate procedure

The Code of Criminal Procedure contains rules for enforcement decisions and amendment questions. The route depends on the legal form of the ban. There is a specific legal amendment option for an Article 38v measure; special conditions have their own framework. Let the lawyer determine what can be asked and which authority will decide on this. A letter to the probation service is not the same as a formal request to the competent court in every situation. Also ask who will continue to monitor current obligations as long as no new decision is made.

A decision of the Overijssel District Court from December 2024 shows how concrete such a question can be: after the protected person moved, the area ban in that special situation was amended and expired, while the contact ban with an adapted consent arrangement continued to exist. The judge explicitly discussed the limits of the legal route. This is not a general rule that moving automatically ends any area ban. On the contrary, it shows that a change may require a reasoned judicial decision, with a separate assessment of each part. (decision of the Overijssel court from December 2024)

Reporting a problem is better than accepting your own exception

Failure to comply may have consequences depending on the form imposed. In the case of special conditions, a conditional sentence may be imposed; In the case of a measure restricting freedom, the law has its own regulations. Ask what warning and consequences are included in your decision. Don't assume that suffering a consequence always ends the original obligation. The legal effect and remaining duration require separate explanation. Report an error or unforeseen situation via the appropriate route and keep the relevant facts without constructing a story afterwards.

Our analysis is that a ban is best implemented with precise source reading and prior practical agreements. Mutual good intentions, workload or a delayed response are not obvious legal exceptions. Organize the basis, scope and permission, and request a necessary change before acting on it. This supports both the protection for which the ban exists and a clear legal position for those who must comply with it. A current compliance card makes visible what applies and which questions still need to be answered by the competent authority.

Questions from litigants

Frequently asked questions

Can I have contact if the protected person requests this?

Not automatic. The precise decision and any permitted exception are decisive. Mutual consent does not automatically change a judicial ban. Request appropriate legal explanation in advance and use the authorized route.

Does a ban apply during my appeal?

That depends on the legal basis and the decision, including any immediate enforceability. Have the specific operation checked. An established legal remedy does not give permission to temporarily ignore the ban in every situation.

Does a contact ban expire if an area ban is changed?

Not by itself. Different components and legal forms can continue to apply side by side. Read the operative part and any remaining conditions carefully and confirm what actually changes.
