Article 12 proceedings: challenging a decision not to prosecute
A dismissal or lack of prosecution can feel as if your story has not been seriously investigated. Under certain conditions, the Article 12 procedure can provide a route to submit the prosecution decision to the court. It is not an ordinary complaint letter about the police and not a criminal hearing in which guilt is already determined. A useful complaint responds to the real reason for non-prosecution and shows what evidence or research could change the assessment.

A prosecution complaint is different from a complaint about treatment
Article 12 of the Code of Criminal Procedure concerns the assessment of no or no further prosecution within the applicable framework. A complaint about unfair treatment by a police officer has a different function. The police have a separate complaints route for this. Both problems can occur together, but a complaint about behavior does not automatically lead to the prosecution decision that you want to achieve with Article 12. So start with the desired decision. (the police have a separate complaints route for this)
Our analysis uses a route question: do you want restoration of contact, assessment of an investigation choice, prosecution or compensation? Each goal may require a different process. The Rechtspraak explanation of the complaint procedure describes the route to the court. An incorrectly chosen letter can cost time and misdirect expectations. Careful preparation does not have to do everything at once, but it must make clear what specific decision is required and why that particular procedure is suitable for it. (Rechtspraak -explanation of the complaints procedure)
Not everyone involved can complain on behalf of society
Direct importance is significant for the Article 12 route. A victim or survivor may have such a position, but not every bystander or concerned citizen automatically has the same access. The authority and interest of an organization or representative must also be examined. The Code of Criminal Procedure provides the framework. The desire that a particular person be prosecuted is not in itself a complete basis for admissibility. (Code of Criminal Procedure)
Therefore, describe your relationship to the fact and the consequences for you. If you act on behalf of someone else, appropriate representation must be arranged. A care provider, family member or authorized representative does not automatically have the same independent claim. Have this assessed early, so that substantive work does not rest on an incorrect process position. A clear interest description can be brief and does not have to include every sensitive detail. The aim is for the court to understand why you are allowed to submit this prosecution question.
The real dismissal determines the response
Non-prosecution can have various reasons, such as evidence problems, unknown perpetrator or a policy consideration. The Public Prosecution Service's instructions on grounds for dismissal help to understand the categories. A response to insufficient evidence requires something other than an argument about the importance of prosecution when evidence is not the central problem. Read the official letter and ask for clarification where necessary. Your own summary that the police were of no use may lack the real basis. (OM instruction on grounds for dismissal)
Write the justification in plain words next to the available material. Which part is not sufficiently supported and which source can add something to that? If the reason concerns a weighing of interests, which concrete circumstances do you think have not been sufficiently taken into account? A complaint becomes sharper by dealing with the decisive reasoning. A long repetition of the report without a response to the dismissal can actually conceal that essence. The lawyer can assess which legal and factual points are relevant to the court.
Do not wait because there is no normal objection period on the letter
The terms and limits depend on the type of decision and circumstances. Special rules may apply, for example regarding a different form of settlement, and limitation or further proceedings may be important. The general idea that Article 12 is always open indefinitely is therefore incorrect. Have the received letter and current situation assessed immediately. A reconsideration request to the Public Prosecution Service does not automatically extend every possible term or limit.
Save date and method of receipt, previous requests and responses. If no clear decision has yet been received, ask the position and have it assessed which route is appropriate. Submitting a complaint before the Public Prosecution Service was even aware of the fact may raise a different problem than a substantiated complaint after dismissal. The practical lesson is that timely clarification is more helpful than waiting for complete certainty. The complaint and any previous request must be consciously coordinated.
Create an evidence map with concrete missing links
A good request makes it clear which data exists, which data is missing and why further research could be useful. Don't just mention that there are witnesses or cameras, but what they might be able to clarify and what that expectation is based on. An unresearched source must actually be relevant. A list of all conceivable research methods is not a proof plan. The court is more interested in a clearly defined question that can affect the dismissal steps.
Keep material in its original form and do not approach those involved to coordinate statements. If images can disappear, preservation may require an urgent separate step. State your uncertainties honestly. A message that seems like an important clue may also allow for other explanations. The assessment becomes more reliable when that possibility is not hidden. The lawyer can help organize the information legally and practically. The aim is not to produce a conviction itself, but to enable a substantiated prosecution or investigative assessment.
A specific request is more readable than a complete file
A complaint must make the case recognizable: person involved, fact, police or public prosecutor's office number, decision and your objections. Please include the relevant letter and number attachments. Follow the current instructions of the competent court, including signing and safe shipping. A general email to several courts at the same time is not a careful route. Request confirmation of receipt and save exactly which version was submitted.
Organize the content around the motivation and specific research questions. Show personal impact where relevant, but don't make it the only response to an evidence problem. Conversely, a purely technical overview cannot sufficiently explain the prosecution interest if it is actually under discussion. According to the official procedure, a lawyer is not required in all cases, but support can be useful in cases of complex admissibility, evidence or interests. Make the scope and costs of that help clear in advance.
Advice, file and hearing are different steps
During the procedure, the Public Prosecution Service can give its position and background, after which the court will decide independently. An opinion from the Advocate General is not the decision of the court. Inspection of documents and a possible hearing also have their own conditions. Ask in advance how you can view the relevant file and what support is needed. Not every piece is provided indefinitely without consideration; privacy and other interests may play a role.
Read the papers for the actual differences. What is recognised, what is disputed and what research do you think is lacking? A new response does not have to read the entire declaration again. Focus on the points that may be decisive for the prosecution question. If you cannot appear, request a postponement via the appropriate route and do not assume automatic permission. A language need must also be reported in a timely manner. The purpose of preparation is that the limited space for explanation is used for the specific question that the court must assess.
The person being complained about also has rights
An Article 12 procedure deals with the question of whether prosecution should take place, not a definitive finding of proof. The accused can be heard within the framework and has his own position. An assignment therefore does not mean that that person has already been declared guilty. The later criminal judge independently assesses evidence and criminality. This distinction is essential, even when the complaint is an important moment of recognition for the victim.
It is wise for a defendant to discuss the summons and complaint with a lawyer. An earlier letter of dismissal does not automatically provide certainty that any further proceedings are impossible. At the same time, he does not have to approach the questions as if a full criminal hearing is already taking place. The specific rights and route must be explained. For the complainant, this means that the request remains focused on the correct decision. Compensation or immediate punishment is not simply settled in the same complaint decision.
Fictional example: a dismissal with an unused witness
A fictitious declarant is dismissed due to insufficient evidence. He knows that a bystander may have seen a specific part and has an original message briefly mentioning that sighting. A targeted complaint explains what question the witness can answer and why it affects the evidence gap. That is different from simply stating that the offense is serious and the case should therefore be prosecuted.
The lawyer assesses the source, importance and possible further investigation route. The example does not guarantee assignment: the observation may be less clear or other limitations may exist. It does show how new or unused information is connected to the actual dismissals. If the court orders prosecution, an independent criminal assessment will follow. The complaint is therefore a step in access to assessment, not a final decision on guilt. That expectation should be fair from the preparation onwards.
A complaint card for importance, motivation and research
Create the card before sending a large file. Use reliable case data and keep the official decision. Mark which information is new, already researched or still uncertain. The map helps focus the complaint on the prosecution question and makes visible whether another complaint or damages procedure is also necessary. It does not replace a deadline check or formal submission to the competent court.
- Position: direct interest and possible authority to act on behalf of someone.
- Case: fact, defendant, police or public prosecutor's office number and agency involved.
- Decision: exact grounds for dismissal or non-prosecution with receipt date.
- Response: specific legal or factual difference with that motivation.
- Research: relevant source, expected contribution and available original information.
- Procedure: competent court, signing, sending, inspection and possible hearing.
- Expectation: Prosecution question, separate debt assessment and other desired routes.
Frequently asked questions
Is Article 12 an ordinary complaint about the police?
No. This concerns an assessment of whether or not to prosecute further. Treatment or other complaints may have their own route.
