Legal assistance & costs

Unable to pay your legal aid contribution

Legal aid financing with a government subsidy has been granted, but the personal contribution cannot be covered by the monthly budget. Then legal help may still feel out of reach. The problem cannot always be solved by simply saying that pro deo should be free. First it must be clear which contribution actually applies, to whom it is paid and which options suit your situation. Our analysis: combine an audit of the decision on the government subsidy for legal aid with early financial consultation. A payment problem should not unnoticed turn into a lack of clarity about who monitors the criminal case and its deadlines.

What contribution has actually been determined?

Read the decision of the Legal Aid Board next to the lawyer's bill. The explanation about the personal contribution describes that the amount and conditions are related to the applicable system and the financial assessment. Check which case and financing of legal aid with government subsidy is mentioned. A private advance invoice cannot simply be treated as a statutory personal contribution. An amount after a later income check also has a different reason than the contribution determined during the original financing of legal aid with a government subsidy.

Record the amount, basis, any discount and the recipient of the payment. Ask for an explanation if the invoice does not match the decision. A lawyer can mention disbursements or other allowable costs, but these must be recognizable and must not be unclear in one amount for pro deo. The client does not have to master all the financial rules in advance. A complete set of documents makes it possible to first check whether the amount requested is correct, before just talking about payment terms.

Check whether a contribution is due in your situation

The Council gives examples in which no personal contribution applies, with additional conditions. Certain forms of criminal legal assistance may have a different financial regime than self-requested financing of legal assistance with government subsidies. Therefore, ask what type of legal aid financing with government subsidies has been provided and why this personal contribution is included. The fact that a previously serving criminal lawyer for first legal aid at the police station did not directly request payment does not prove that every subsequent criminal procedure is free. The concrete basis and phase are important.

Conversely, you should not automatically assume that every requested payment is correct because the lawyer has government-subsidized legal aid financing. The Legal Aid Act and the applicable rules determine the system. Have any doubts investigated in a timely manner and keep the correspondence. A check of the contribution is a different question than a request for customization in the event of actual payment problems. The two can walk side by side. A clear conversation starts with the distinction between a possible incorrectly determined amount and a correct amount that you cannot pay at the moment.

Show what specifically hinders payment

Make a brief overview of net income, necessary expenses, existing repayments and available balance. A bank position on one favorable day cannot show the entire month's problem. Conversely, the statement that money is always difficult does not explain which arrangement may be feasible. Also describe relevant changes, such as loss of work, seizure or an unexpected healthcare expense. This is a preparation for consultation, not a new calculation of the statutory contribution. The Council and a lawyer assess other questions than a household budget alone can answer.

Do not choose an installment amount that only fits on paper. If you still have limited space after fixed costs, varying necessary costs must also be taken into account. If necessary, ask for help from a debt counselor or social counselor with the overview. A well-founded conversation can reduce shame because it concerns concrete data. Share financial documents in a targeted manner and via an agreed channel. Not every communication to an office requires the sending of a complete private archive; ask what information is needed for the solution in question.

A payment arrangement is an agreement that must be confirmed

Discuss with the lawyer whether payment in parts is possible and what will be agreed. There is no such thing as a right to any desired payment rate for every contribution. Therefore, make it clear which terms are actually allowed, when the first payment is expected and what happens if the situation changes. A personal transfer of a small amount is not automatically an accepted arrangement. Keep the confirmation with the decision on the government subsidy for legal aid and the invoice.

Ask at the same time how the substantive assignment is carried out while the payment problem is discussed. The NOvA rules of conduct provide the professional framework for the relationship with the client. It does not follow from this that there is a simple general rule that every office must continue working indefinitely without an appointment. But a financial conversation should also not rest on unclear assumptions about a current session or term. Ask explicitly who will do what until agreement is reached. This clarity is especially important when the payment date and a legal decision point are close together.

Reference year change may be relevant, but is not a payment holiday

The Council assesses income and assets according to legal rules, often with data from a previous year. If the current financial situation has changed, a reference year change may be relevant under certain conditions. This is a substantive request within the statutory system for government subsidies for legal aid. Have it explained which conditions, details and term apply. A recent drop in income does not automatically make the personal contribution lower. A request must be assessed appropriately and may also lead to audit later.

Do not confuse this request with a confirmed payment plan. As long as no new decision or agreement exists, it must be clear what happens to the existing invoice. Tell the lawyer that a request is being prepared and ask what practical arrangements are possible for the outcome. In addition, retain proof of filing with the Council. A letter to one counter does not automatically result in a delay at the other. Good preparation connects the processes where necessary, but keeps the individual decision and expectations of each process visible.

Special assistance requires timely local assessment

A municipality may, under certain conditions, assess special assistance for legal assistance costs. The municipality of The Hague provides a concrete official application route for this; that is an example of local implementation and not a national delivery guarantee. Check the rules of your own municipality, including income, assets, necessity and application time. Do not wait for a payment reminder when early application is possible or necessary. Asking for compensation afterwards can create a different and more difficult position.

Ask at the local counter what documents are required and whether a decision on the government subsidy for legal aid, invoice or other cost information must be provided. Do not be deterred by the assumption that working always makes an application impossible, but neither do you assume that a low income will automatically be reimbursed for every contribution. The assessment is specific. Note who is handling the request and what applies as long as a piece is missing. An informative telephone call can provide direction, but is not the same as a formal application or award.

Attachments and debts may require their own route

In the case of structural debts, a payment agreement with one lawyer may be insufficient. In its information, the Council mentions special financial situations, such as debt restructuring, bankruptcy or attachment, with their own conditions and required documents. Check which scheme actually suits your situation and which current conditions apply. Do not exclusively use the term I am in debt assistance; formal status and evidence can make a difference. A counselor can help bring the right information to the lawyer and Council.

Also keep all other necessary payments in view. Anyone who promises the same available space to multiple parties at the same time cannot fulfill an arrangement. Ask for a joint look at the budget and existing agreements. This does not change the statutory personal contribution at your discretion, but can prevent a new payment problem from arising each time. In the meantime, the legal file must remain recognizable: which case is ongoing, which action is urgent and who monitors it? Organizing finances and organizing legal assistance are two related tasks that should not wait for each other without a clear agreement.

Fictional example: an award and unexpectedly less work

In a fictional example, Joost receives legal aid financing from a government subsidy with a personal contribution. Shortly afterwards, many working hours disappear. He thinks that the lawyer should therefore automatically cancel the invoice and does not respond. The substantive criminal case now has a hearing date. A useful approach starts with reporting the change in income, checking the decision and discussing payment. In addition, it will be examined whether a change of reference year or local support can be requested within the applicable conditions.

Joost keeps confirmations and explicitly asks who will prepare the hearing while the financial questions are still pending. The example does not promise zero settlement or municipal reimbursement. It shows that a new budget problem can require different solutions, with different decision makers. A lawyer can discuss a payment agreement, the Council assesses the statutory system for government subsidies for legal aid and the municipality assesses a separate application for support. By making those roles visible, a period of uncertainty is less likely to become a stagnant defense.

A budget and counter card for the first week

Create one overview with the problem and the requested decision per counter. This makes it clear whether you dispute a calculation, request installment payment or request support. Attach the necessary documents and mark where anything is missing. Ask for confirmation of receipt for formal applications. A folder that only contains telephone numbers is less useful than a card with date, request and next action. This card also helps when a care provider is involved later.

  • Decision: reference number of the legal aid financing decision, procedure, personal contribution and data used.
  • Account: sender, amount, parts and payment term.
  • Budget: current income, necessary expenses and demonstrable change.
  • Lawyer: arrangement, confirmed deadlines and agreements on substantive work.
  • Council: appropriate assessment, reference year change or special financial situation.
  • Municipality: current local conditions, application time and supporting documents.
  • Process: hearing, legal remedy period, person responsible and next contact.

A financial dispute deserves a concrete discussion

If you disagree with the amount or the way in which the office responds, please indicate which appointment or item is under discussion. The NOvA describes complaints and dispute options. However, a complaint is not a substitute for a necessary procedural step in the criminal case. First discuss how current interests are protected. Changing lawyers can pose its own financial and practical questions and should not be accepted as an automatic free solution.

Our conclusion: no money for the personal contribution requires an early, precise combination of decision control, budget and counters. Do not promise that every problem will be solved by the municipality or council. Ask what option exists in your actual situation and ensure confirmation. Use the main guide to lawyer fees for the broader distinction between payment and funding of government-subsidized legal aid. A workable solution keeps both the payment agreement and the progress of the legal assistance understandable. (Master Guide to Attorney Fees)

Questions from litigants

Frequently asked questions

Is financing legal aid with government subsidies always completely free?

No. Depending on the type of assistance and the applicable rules, a personal contribution may apply. There are also situations where no contribution is due, with conditions. Therefore, check the concrete decision on the government subsidy for legal aid and do not confuse a private bill with the statutory personal contribution.

Does my municipality have to reimburse the personal contribution?

Not automatic. Special assistance requires a local and individual assessment. Ask in advance which conditions, supporting documents and application times apply. A low income or financing of legal aid with a government subsidy does not automatically mean that every cost item will be reimbursed.

Can I wait to pay because the reference year change is in progress?

A request does not automatically result in a confirmed payment holiday. Discuss with the lawyer what applies to the decision and make a possible appointment. In addition, monitor the application period with the Council and the current deadlines or hearing in the criminal case.

This article provides general information. The rules and options depend on your situation. Discuss your case and possible deadlines with a lawyer.
