Received a CBR letter late or not at all?
You hear that you have not fulfilled an CBR obligation, even though you believe the invitation never arrived. Or a decision is only made when a specified date has already passed. This not only concerns mail delivery, but also disclosure, evidence and a safe process response. Our analysis: The most useful first step is a receipt timeline of pieces. A telephone report can help, but does not replace a timely objection to a decision and does not automatically give permission to continue driving.

Which letter is missing makes a legal difference
A CBR file may contain a decision on a measure, a request for payment, an invitation for an examination or a course and a later decision on the driver's license. First ask which letter you have not received. If the original decision has remained unknown, the announcement and the period for a legal remedy may be central. If only a course invitation has not been received, the main question may be whether missing the appointment can be assessed as non-cooperation. Both questions can also occur together.
Therefore, do not create a general file with the title post problem without distinguishing the documents. Note the sender, subject and consequence associated with each letter. A date stated by telephone is insufficient to determine exactly what was requested. Request a copy of the full letter and relevant previous correspondence. The legal framework for CBR measures and the Road Traffic Act must then be linked to the concrete action that has not been taken according to CBR.
Separate date, shipment and receipt
The date above a letter is not the same as the date of sending or the moment at which you actually learn the contents. Save the envelope, digital notification, a return notification and any delivery details. Make a note of when you first heard that there was a decision or agreement. A timeline becomes stronger when each point has a source: the envelope, a telephone note, an email or an overview from a portal. Indicate when you can only describe something from your own memory.
For example, ask four specific questions: when was the letter written, how was it sent, at what address was it presented and when did you become aware of its contents? These questions prevent different data in the conversation from always having the same meaning. Please ask CBR what shipping information is available. It is better to make missing shipping information visible than to accept the date as proof of actual shipping. The lawyer can then assess which uncertainty is legally relevant.
Check the address used without prejudging the outcome
Compare the address on the letter with the address known to the government at that time and in the CBR file. Consider a move, an addition to the house number, a temporary stay or an error in the street name. Keep a confirmation of an address change and note when you communicated it. Incorrect addressing may require a different assessment than correct addressing with a possible delivery problem. Simply saying that you have been living elsewhere for a long time does not make the relevant registration clear.
Own circumstances also belong honestly in the timeline. Anyone who does not open mail for months does not automatically have the same position as someone who has not received a correctly addressed letter. This does not mean that every problem is immediately your own responsibility; it means that the real cause must be investigated. Therefore, make a note of who had access to the mailbox, whether there were any known delivery problems and what you did after hearing of the decision. Do not replace a missing piece of evidence with a firm legal conclusion.
Registered and regular mail require different checks
In the case of registered mail, it may be relevant whether a piece has been presented regularly and what delivery details can be demonstrated. With regular mail, shipping administration can be important. A single standard notification that the letter has been sent may not solve every evidentiary problem. At the same time, denying that you saw the letter is not sufficient in all cases to remove the consequences. The file must show which suspicions are justified and which concrete circumstances are put forward against them.
Therefore, do not ask for impossible absolute certainty about every mail movement, but the data on which CBR is actually based. Track and trace, a signature or a collection message may play a role in a registered item. Regular shipping may involve registration of the shipment and correct addressing. Then investigate which data says something about this specific piece. A neighbor who regularly complains about mail delivery can provide context, but is not automatically proof that your invitation was delivered incorrectly.
From provisional judgment to ruling in the appeal
In the Limburg District Court on October 6, 2025, ECLI:NL:RBLIM:2025:9599, the preliminary relief judge examined the sending of a missed EMG invitation and temporarily suspended the declaration of invalidity. This was followed by the appeal judgment of 8 April 2026 in the same matter, ECLI:NL:RBLIM:2026:3257. Even then, CBR had not sufficiently substantiated correct delivery or presentation; there was also a lack of proof of correct digital transmission. The court declared the appeal well-founded, annulled the decision on objection and revoked the original declaration of invalidity. This follow-up judgment therefore goes further than just the previous temporary suspension. (District Court of Limburg October 6, 2025, ECLI:NL:RBLIM:2025:9599 · the judgment on appeal of April 8, 2026, ECLI:NL:RBLIM:2026:3257)
The statements do not provide a general rule that a denial of receipt will reinstate any missed course. The significance lies in the separate assessment of shipping methods, concrete evidence and the inference about cooperation. Interest in the appeal also remained after the CBR had already officially revoked the original decision; the court took into account the alleged consequences and legal costs. That is not general compensation for every mailing problem. In the case of a comparable file, have the current decision and your own evidentiary position assessed, including what has happened in the meantime during an objection or a follow-up procedure.
Request documents, but in the meantime monitor your own deadline
The General Administrative Law Act regulates, among other things, publication and deadlines for objections. Usually the objection period is six weeks, but the starting point and any excusability in case of late response require a concrete assessment. Do not wait for the outcome of a telephone inquiry when you already know a decision. Immediately determine which decision you are contesting and how you can submit a valid objection in a timely manner. A complaint about the post and an objection to the legal consequences are different actions.
If you really only heard about the decision later, immediately record how and when it happened and respond expeditiously. A later discovery gives no reason to wait weeks without advice. Request confirmation of the chosen submission route and save the sent document. A letter merely asking for a copy does not necessarily indicate that you are contesting the decision. The wording and the decision involved must be sufficiently clear to allow your legal position to be assessed reliably.
An objection does not automatically make an invalid driving license valid
A decision can have consequences despite an ongoing objection. The General Administrative Law Act stipulates that an objection or appeal does not suspend the operation. If the driving license has been declared invalid or suspended, you should therefore have its current status checked. The belief that the mail problem will be solved later is not permission to drive. Ask what restriction currently applies and what exactly any change or judicial suspension relates to. A telephone conversation about a complaint cannot replace that.
In case of urgency, a request for interim relief may be relevant, in addition to the required objection or appeal procedure. Discuss both the legal issue and the concrete urgency, for example demonstrable consequences for income or necessary care. Not every emergency request is granted. The National Ombudsman's information about CBR processes can help understand roles and problems, but a complaint to the ombudsman is not the same remedy as a judicial stay. Keep the chosen route and the expected legal consequence separate. (National ombudsman about CBR processes)
Fictional example: a new course date that no one confirms
In a fictional example, Rachid reports sick for a course day with permission. He expects a new invitation, hears nothing and calls after a few weeks. It then appears that a letter with a new date was sent and that it was registered as not appearing. His useful first response isn't just to say he's always willing to cooperate. He saves the approved sick report, requests the new invitation and shipping details and notes the telephone conversation.
If a decision is subsequently made about his driver's license, he will have it assessed separately and monitor the response. His earlier willingness is relevant to the story, but does not automatically prove what happened to the letter. The example shows how two tracks run parallel: restoration of the actual planning and legal protection against a decision. Arranging a new appointment does not necessarily have to change the previous decision. Therefore, ask explicitly which consequences have been repaired and what is still being formally assessed.
Build a receipt timeline with auditable supporting documents
Keep the receipt file compact. The first advice must quickly clarify which letter is missing, which decision now applies and whether there is a deadline. Add full pieces when a single screenshot omits sender or date. Also save the answers of the CBR; a reshipment commitment can explain why you expected a certain follow-up. Highlight differences between your own memory and an official registration, so that specific questions can be asked about them.
- Document: decision, course invitation, inquiry letter or payment request.
- Address: address details used and demonstrable changes on relevant dates.
- Shipping: Ordinary or registered mail, portal or other channel.
- Offer: concrete delivery details, return item and possible collection notice.
- Knowledge: first moment when you actually learned the content.
- Response: Contact, copies requested, objection filed, and acknowledgment of receipt.
- Status: current driving licence, next appointment and need for emergency advice.
Restore communication and have the decision assessed
Our conclusion is that a CBR mail problem requires more than one general complaint. Correspondence must run reliably again, the missed obligation must be substantively investigated and the legal consequences of a decision must be contested if necessary. Therefore, ask for written confirmation of new address or contact details and practical agreements. This will not prevent every delivery problem, but it will make it clearer what both sides expect in the future. Keep that confirmation together with the decision documents.
In addition, keep the criminal driving license route separately visible. An OM decision about holding the driver's license for a longer period of time and a CBR decision can coexist. A solution at one agency does not automatically eliminate the other limitation. Use the main guide to reclaiming a driver's license to understand this coincidence and have the specific CBR documents assessed specifically. A carefully restored file does not automatically provide a favorable outcome, but it does make it clear which event and which decision are really under discussion.
Frequently asked questions
Is it enough to say that I did not receive the letter?
That depends on the pieces and the shipping method. It must be investigated which address was used, how the letter was sent and what concrete information exists about the offer. Record your own circumstances and ask CBR for the underlying shipping information.
Can I continue driving while my objection is pending?
Objection does not automatically suspend a decision. Have your current driving license and the effectiveness of the decision checked. In urgent cases, a provisional measure may be necessary. A complaint or request for an explanation does not in itself give permission to drive.
Is there any point in responding when six weeks seem to have passed?
Seek legal advice immediately. Announcement, the start time of the term or excusability may play a role, but that depends on concrete facts. Record when you first knew the decision and respond expeditiously; don't wait for an informal answer.
