Confiscation of proceeds after cannabis cultivation
A separate financial procedure may follow the criminal case regarding a cannabis farm. The Public Prosecution Service will then determine what unlawful benefit has been obtained and request a payment obligation. A large amount in a report quickly feels like a fixed debt, but behind that amount are assumptions about the period, revenues, costs and distribution. Our analysis: first check those building blocks and only then the final sum. An arithmetically correct table may still be based on the wrong starting point, legally or factually. The defense must therefore understand both which legal basis is used and which concrete data support the stated proceeds and personal benefit.

A financial claim requires its own substantive response
The procedural explanation of Rechtspraak describes the handling of a confiscation claim, including possible written rounds and a hearing. The basis lies, among other things, in Article 36e of the Criminal Code and the procedural rules of the Code of Criminal Procedure. A decision on the penalty does not automatically conclude that financial assessment. Therefore, keep announcements, claims, calculation reports and calls separately. Ask which ruling or procedural step relates to which file and what response is now required from the defense. (procedure explanation of Rechtspraak · Sr · Code of Criminal Procedure)
The meaning of an amount must also be determined. Is it an initial estimate, a claim from the Public Prosecution Service, a decision by the judge or an implementation notice? Those are different stages. A verbally stated maximum amount is not automatically the final obligation. Conversely, an early report cannot be ignored because the judge has not yet decided anything. It actually offers starting points for research. Good preparation starts with version management, so that no one responds to an old calculation while other periods or items have been added to the claim.
Not every financial disadvantage or asset is the same advantage
Article 36e has various legal inputs. Therefore, let it be determined on which basis the claim is based, which criminal offenses are involved and which conditions apply to that entry. It is not simply about everything someone owns after a drug case. The relationship between facts, benefits and person must be assessed legally. A challenge to the main case and a response to the confiscation calculation are separate topics that must be carefully linked together. The defense does not have to acknowledge an unproven calculation principle in order to discuss the calculation.
Taking away the Public Prosecution Service's designation places confiscation next to other options for taking away criminal benefits. This explains why seizure, settlement or other financial steps can also appear in a file. A seizure amount does not automatically indicate how much personal benefit the judge will ultimately determine. It can have a security function. Ask what title underlies each financial transaction and what is secured or settled with it. Without this distinction, a person involved may wrongly think that a seized amount has paid for everything or that a frozen account already entails a final confiscation order. (Take OM clue)
The number of assumed revenue moments controls the outcome
A calculation after hemp cultivation can be based on previous yields in addition to what was found upon discovery. Ask what data the stated period and number of revenue moments are based on. Are they direct observations, explanations, records, or inferences from traces? A standard period is not the same as a concretely determined duration of use of this location. Make it visible where the calculation is based on general assumptions and where file data support a shorter or longer period. Disputing one period can be more important than a small discussion about an individual cost item.
An alternative starting point must be consistent with real data. For example, a statement that the space was only available for a short time can be tested against an existing agreement, key transfer or other documentation. Let the lawyer assess what is relevant and how it can be introduced. Do not invent a later start to make the sum more favorable. Even an uncertain period must remain honestly uncertain. The defense becomes substantively stronger by showing exactly why a conclusion is too certain than by replacing every missing date with a favorable date.
There are several steps from an observation to an amount of money
A yield calculation can combine several factors. Each factor has a source and application question: what has actually been determined, which assumption is used and why would it fit here? A general standard can provide a starting point without deciding every deviating concrete situation. Ask for the version used and the underlying explanation. This article does not provide current cultivation yields or sales prices. The legal point is that the calculation must be checked against the actual assumptions used and not against a proprietary table that happens to give a lower result.
Distinguish between gross proceeds and the amount estimated as benefit after applicable adjustments. It must also be clear whether a monetary amount from a statement describes a turnover, personal payment or expected amount. These concepts can easily become confused in a conversation. An amount that someone has heard mentioned is not money received automatically. Have original statements read in full and compare them with context. The calculation may not hide a substantive difference between expectations and actual benefit obtained by placing both under the same yield column.
A stated expense is not automatically deductible
Expenses must be examined to determine whether they have actually been incurred and whether they are legally eligible for deduction. A receipt, payment and own estimate do not have the same evidentiary value. Moreover, the fact that something has cost money does not yet indicate how the legal confiscation calculation will deal with it. Have the attorney review the relevant item and basis. Do not adopt a universal rule that every expense is deducted, but neither do you assume that a calculated gross amount always reflects the personal benefit without further explanation.
A claim for damages, tax bill or payment arrangement with another party requires special attention. The fact that someone has to pay an amount to a third party does not automatically mean that that obligation has already been included in the confiscation amount. Save the decision, the reason for the payment and proof of actual execution. Ask how any overlap or concurrence in the specific file should be handled. This prevents an item from being submitted twice or from not being discussed because everyone thought that another agency had already settled it. The calculation must remain transparent about what is and is not included.
The advantage of a location is not automatically an advantage for everyone involved
A case can name multiple people with different roles. An estimate of the total benefit does not necessarily say what benefit each person received. Investigate the stated agreements, payments, actual power of disposal and involvement. An equal distribution by the number of suspects is not a universal solution; Attributing it entirely to one person also requires a basis in the concrete assessment. Show what information actually exists and where there is only a suspicion. The label of co-perpetrator does not automatically replace the investigation into personal benefit.
Distinguish between distribution of income and responsibility for a payment obligation. In special legal situations, the legal form of the obligation may have its own consequences, so that simply looking at the amount received may be insufficient. Therefore, ask the lawyer how exactly the Public Prosecution Service justifies the allocation and which legal provision is used. Moreover, a statement about the role can get to the heart of the matter. First discuss additional information carefully, so that a response to the financial calculation is not unnoticed as a broader admission that the suspect did not want to make.
Fictitious calculation example: one disputed assumption doubles the sum
This example is completely fictional and uses made-up amounts of money, without cultivation standards. A report assumes two revenue moments of €20,000 each, with an accepted cost of €4,000 per moment for this example. The calculation is then twice € 16,000 and therefore € 32,000. If only one revenue moment is considered plausible, the result will be € 16,000 with the same other assumptions. The arithmetic change comes entirely from the number of moments. No amount in this example is a current standard or an estimate for an actual farm.
The comparison shows where a research question can lie, not how a lower outcome is guaranteed. Perhaps existing data actually supports two moments. The assumed revenue, cost deduction and personal allocation must also be assessed separately. Therefore, do not simply divide the fictitious outcome by the number of people involved. Then a new unproven assumption is added. Our analysis is that a good response identifies a limited number of decisive principles and explains why they require scrutiny. That is more meaningful than just declaring at the end of an otherwise misunderstood calculation that the total feels too high.
A targeted defense links every criticism to a source
Make it clear for each disputed post what the report states, why, according to the defense, this is incorrect or insufficiently substantiated and what material can answer the question. An arithmetic error requires a different response than a disputed legal principle. Keep those categories apart. Ask in a timely manner which documents are missing and what period applies for written explanation. A pending request for information does not automatically mean that a response date will expire. Have agreements about replenishment or planning confirmed and work with the most recent version of the claim.
Any settlement also requires understanding of the magnitude. What amount or what transfer is agreed, what confiscation request is it settled and what remains outside the scope? Do not assume that a financial agreement automatically closes the criminal case, a tax file and all third-party claims. Have the text and consequences legally assessed before signing. The advantage of a clear calculation is that such a choice can also be made more concrete. A data subject then sees which uncertainties in the proposal are settled and which individual obligations may continue to exist.
Seven lines to make the assumptions visible
Use a table showing original calculation, disputed point, and source of response. Save the report and clearly set your own calculation aside. Indicate for each change whether it is established, legally advocated or merely a sensitivity example. This prevents an illustration from circulating unnoticed as a proven alternative. The map supports the consultation with the lawyer and makes it clear which questions still need to be answered by additional research. It is not a self-declaration of profit and not an acknowledgment of facts that are substantively disputed.

The quality of the sum starts with its principles
Our conclusion is that a confiscation report should not only be checked with a calculator. The biggest differences can arise before multiplication takes place: the period, the number of returns and the person to whom the benefit is attributed. A careful defense identifies those choices and links criticism to existing facts or the correct legal question. It remains open for data that correctly support the calculation. This creates a verifiable financial assessment in addition to the criminal case, instead of a battle between a large amount on paper and a general denial thereof.
The explanation of drug possession and suspicion of drug trafficking addresses related criminal law questions. Have your own financial procedure prepared separately and check which decision applies to which file. An estimate is not random, but neither is it a personal prediction based on one internet example. Bring together the claim, the full report and relevant original documents. This allows the lawyer to discuss specifically which facts, standards and calculation steps are actually still available for assessment. (drug possession · suspected drug trafficking)
Frequently asked questions
Is confiscation the same as a fine?
No. Confiscation focuses on unlawfully obtained benefits and has its own legal assessment. A fine has a different function. Seizure and a civil claim for damages are also separate subjects that can be related to the confiscation case without coinciding with it.
Can the Public Prosecution Service estimate an amount without exact administration?
An estimate may be possible within the legal framework, but the assumptions and substantiation used remain verifiable. Ask what period, data and factors are used. A lack of administration is no reason to treat any arbitrary final sum as fixed.
Can I just divide the yield by the number of suspects?
Not as a general rule. The personal allocation and possible distribution require investigation into the facts and legal basis. The number of people involved alone does not indicate who received what benefit or what legal form of payment obligation is required in the specific case.
