Missed your criminal hearing and convicted in your absence?

An unexpected letter about a criminal judgment can give the impression that the case is over before you have been heard. In absentia means that the judge has dealt with the case without your presence; it does not in itself say why you were missing or what response is now possible. The idea that the appeal period always only starts upon receipt of the judgment is particularly risky. Our analysis: immediately create a map of the hearing, the service and any previous knowledge, and then have the appropriate legal remedy assessed.

In absentia is a procedural position, not an explanation for your absence

A judge can hear a criminal case under legal conditions if the suspect does not appear. The accusation continues to require a judicial assessment. A default treatment does not therefore mean that every part is accepted without a test. However, you will not have the opportunity to personally respond to questions and information during that hearing. The description of the criminal proceedings helps to recognize which phase of the process has been passed. Request the judgment and relevant court documents instead of relying on the summary of a collection letter.

The default label also does not explain whether the summons was served correctly or why you were not present. Those are separate questions. Perhaps you knew about the hearing but thought it had been postponed; perhaps the call had never been noticed; perhaps an authorized lawyer appeared and the procedure turns out to have been legally handled differently than you expected. Therefore, do not start with a form letter. Have it determined what is stated in the official report and the ruling before choosing a legal remedy.

Collect the first documents before memories fade

Compare the summons, any summons for a further hearing, judgment, service and subsequent letters. Note the date for each item on the document, dispatch if known, presentation and actual receipt. Make a copy of envelopes and receipts. A letter that was only opened months later does not automatically prove that no relevant knowledge existed before then. Conversely, the date above a piece alone may be insufficient to establish the legal timeline.

Add messages to the lawyer or court that say something about what you knew and when. A question about whether the hearing will take place on Tuesday may have a different impact on the assessment than a message in which you ask about an unknown verdict months later. Leave the original text, including shipping information. A retrospectively formulated summary can lose important nuances. The goal is not to build the most favorable story possible, but to make the actual sequence verifiable so that the lawyer can apply the legal rules.

Not every default judgment has the same appeal route

For many criminal cases, an appeal is the normal legal remedy against a court decision. Rechtspraak's information on appeals also mentions limitations, including certain violations and minor sanctions. Moreover, a criminal order from the Public Prosecution Service is not a judicial default judgment and requires a different route. Therefore, first check the deciding authority and the type of document. Words such as decision, verdict, penalty and fine are easily used interchangeably in ordinary correspondence. (information from Rechtspraak about appeal)

A civil law internet example about opposing a default judgment can be misleading here. The same word default occurs in different jurisdictions, but this does not make the procedures the same. Ask the lawyer what remedy is available for this ruling, which authority it must be filed with and what formal requirements apply. Anyone who only sends a notice of objection to a general address may have to explain later why the correct remedy has been initiated. Prevent formal issues from dominating the substantive defense.

When do the fortnight start?

Article 408 of the Code of Criminal Procedure has various starting points. The period may run after the final judgment when the summons has been made or served in person, when the suspect appeared or when it follows from another circumstance that the hearing date was known in advance. In other cases it concerns a circumstance that shows familiarity with the final ruling. This is a simplified reading route; the lawyer must fully check the applicable provision and factual course of events.

Therefore, the statement that you never received the judgment at home is not in itself decisive. Anyone who knew the hearing date in advance may have a different term position under the legal rules than someone who only received relevant knowledge for the first time later. Have a possible deadline set immediately and do not act until every piece of evidence has been received. A request for copies does not automatically stop a period. In case of doubt, quick advice is mainly intended to preserve the possibility of a substantive assessment.

A judgment shows why the order of knowledge counts

In HR October 15, 2024, ECLI:NL:HR:2024:1433, the court found the appeal too late based on correspondence from the suspect. The Supreme Court did not find this reasoning immediately understandable: the documents involved did not show that the suspect knew the hearing day before it started. This concerned the distinction between knowing afterwards that a hearing had taken place and knowing in advance the day of that hearing.

The Supreme Court quashed the court ruling and dismissed the case. This is not a general statement that every default judgment can still be challenged indefinitely, nor an acquittal for the underlying facts. The editorial lesson is smaller and more useful: date, source and content of knowledge must belong together. Anyone who relies on late knowledge would do well to record exactly which document first provided which information, without deducing an automatic outcome from one favorable judgment.

The reason for absence and the term are separate questions

Illness, transport problems or a misunderstanding about postponement can be important for the proceedings. But a good explanation for missing the hearing does not automatically make an appeal timely. These are different assessments: should the case have been handled without your presence, was a request for arrest properly handled and has a legal remedy been instituted in accordance with the rules? Give the lawyer all the information, even if you are mainly angry about the reason for the default.

A postponement request is also not a granted postponement. Keep a written decision or ask immediately how the request was handled. When someone only reports by telephone that appearing is difficult and then hears nothing, a dangerous gap is created between expectation and process decision. Include that gap honestly in the timeline. The guide on postponement of the criminal hearing covers the preparation of such a request; After a ruling, one's own legal position must also be secured.

Fictional example: a hospital visit and a forgotten confirmation

In a fictional example, Sanne knows that her hearing is on Wednesday. On Tuesday she requests a postponement due to a hospital appointment. She only receives an acknowledgment of receipt and assumes that the hearing is cancelled. A month later she receives an execution letter and looks up the judgment. The error in her first reasoning is that the date of that execution letter does not automatically constitute the starting point of a new term. Her previous knowledge of the hearing remains relevant.

A lawyer will examine the request and the response thereto as well as the service and the professional rules. Perhaps there is a legal problem with the treatment; perhaps a term problem is dominant. Sanne helps the assessment by quickly collecting the original messages, medical appointment details and received documents. The example does not show a predictable solution. It makes clear that a strong reason for absence and a valid legal remedy may be separate conditions for a new substantive hearing.

A legal remedy and its implementation both require attention

Check which penalty or measure is stated in the judgment, whether the judgment is final and which specific implementation step is announced. A fine, community service, custodial sentence or criminal driving ban can provide various follow-up information. A filed legal remedy may have significance for implementation, but your own email protesting is not a reliable basis for ignoring a call. Ask for an explanation of the exact process and implementation status instead of deducing certainty from the word appeal.

In the meantime, the practical pressure can increase due to work, family or a driver's license. Tell the lawyer what execution is threatened and when. Take complete execution letters with you, including attachments and reference. A telephone agreement about payment is not the same as a court decision about admissibility. Also indicate when the police or another agency has communicated something about the verdict; that may be relevant to fame. It is precisely by comparing these topics that a targeted assessment can be made of what needs to be done first.

The document and data card for emergency advice

Create one line per process event: what happened, when, which document proves it and what did you know at the time? Write down when a date is just a memory. This makes it visible which parts are fixed and where data must be requested. Also take unfavorable information with you. Omitting an earlier message to the court can actually make the analysis unreliable when it later appears in the file. The attorney needs the actual timeline to carefully weigh the options.

  • Decision: court, case number, date and full judgment.
  • Summons: summons, further hearing date and delivery details.
  • Knowledge: initial concrete familiarity with the hearing and the ruling.
  • Absence: reason, support thereof and possible postponement request.
  • Representation: contact with lawyer and possible authorization.
  • Remedy: chosen route, deadline and proof of institution.
  • Execution: current call, impending step and agency involved.

Maintain the process capability and then prepare the content

Anyone who is unexpectedly confronted with a conviction often wants to immediately explain why the accusation is incorrect. That content deserves attention, but can only reach the judge if the process route is open and used correctly. Our conclusion is therefore that a default case starts with two files: the timeline of summons and notification, and the substantive defense. Neither replaces the other. A clear folder helps to answer the most urgent legal question first.

If an appeal is possible and valid, further preparation must also be discussed: grievances, research questions, presence and assistance. The mere setting does not carry the defense. Use the main appellate guide for that follow-up and the subpoena explanation to understand the original charge. Good legal assistance can both investigate the missed moment and prevent the next hearing from being missed again due to a misunderstanding. (main appeal guide · summons)

Frequently asked questions

Do I always have to respond within fourteen days of receiving the judgment?

Receipt of the judgment is not in any case the starting point. Article 408 contains, among other things, rules on personal service and prior knowledge of the hearing day. Have the concrete documents assessed immediately and do not wait for a self-calculated period.

Can I simply object to a criminal default judgment?

Do not copy a civil example. In criminal court decisions, appeal is often the route, with legal restrictions. A Public Prosecution Service punishment order requires a different procedure. The type of decision and the applicable provisions must first be determined.

Is calling the court enough to file an appeal?

A telephone call can provide practical information, but is not in itself a valid legal remedy. Check the formal route and provide a deed or other appropriate evidence that the legal remedy has actually been properly instituted.

This article provides general information. The rules and options depend on your situation. Discuss your case and possible deadlines with a lawyer.
