Recovery of criminal proceeds in a fraud case
In addition to a penalty, a fraud case may result in a claim to deprive of unlawfully obtained benefits. A large amount of money received is not the same as a personal benefit or the ultimate payment obligation without further analysis. The calculation requires a check of sources and assumptions. Keep that check separate from the question of what you can afford now.

A confiscation claim is not a new name for the fine
Article 36e of the Criminal Code contains the framework for deprivation of unlawfully obtained benefits. This is a different measure than a fine as punishment. A claim from an injured party also has its own function. The amounts may be related, but may not be equated without explanation. Ask which document you have received, which procedure is in progress and what the requested amount is based on. A criminal record or criminal case number does not indicate exactly how the benefit has been calculated.
Create a separate overview for the main case, the confiscation procedure and any compensation questions. Record hearing dates and legal remedies for each section. Completing one process does not automatically mean that all other obligations have been established or have disappeared. Seizures can also have their own purpose without establishing a definitive benefit. An object or amount that has been secured is therefore not automatically the same as the final decision. By keeping the documents apart, the lawyer can see which substantive and procedural questions are still open.
Ask how the presented total is arrived at
The Public Prosecution Service's Settlement Instruction describes various ways in which benefits can be achieved, including capital increases and saved costs. A fraud investigation can calculate transactions, revenues or a financial comparison. The method determines which data and assumptions need to be checked. Therefore, do not just ask for the final amount, but for the underlying calculation and source documents used. A spreadsheet with a convincing total may still contain duplicates, incorrect periods, or unproven person links. (Taking instructions from the Public Prosecution Service)
Start with the calculation itself. Have amounts been added that represent the same cash flow in different tables? Is a transfer between own accounts treated as a new receipt? Does an amount concern gross turnover, a bank balance on a certain day or an estimate of benefit? Those concepts are not identical. For any ambiguity, provide a concrete example with a location. This way, a defense against the calculation becomes verifiable and a judge does not have to reconstruct the possible error from a general complaint that everything is too high.
An accurate cash flow can still give an incorrect picture if the period is incorrect
Check which start and end dates are used and why that particular period was chosen. An account may contain other income before or after the facts investigated. The legal basis for the confiscation determines which facts and benefits may be included. Therefore, do not automatically assume that only an amount mentioned in the main case can count, nor that every receipt in the years examined is automatically unlawful. The applicable variant of Article 36e and the substantiation must be read in concrete terms.
Place important events next to the financial period: start and end of work, access to accounts and relevant changes in the organization. A transaction may actually be recorded correctly in a bank file, but may still be unclearly allocated. Ask about the distinction between date of action, invoicing and receipt. That difference can influence the explanation of an estimate. Your own overview must retain the original data, so that a correction of a period does not unknowingly move other items or result in a new unverifiable total sum.
A registered account does not say everything about actual benefits
Investigate who had access to money, for whom amounts were intended and what actually ended up with the person concerned. Joint involvement in fraud does not automatically prove that everyone has personally received the full amount. At the same time, a formal distribution on paper may be incomplete if the actual cash flows are different. Compare existing agreements, payments and access. The legal options for division or joint and several payment obligations require their own assessment; do not count only the amount that is still in your own account.
Moreover, a lost advantage is not automatically an advantage never obtained. Money may have been spent, transferred or processed in some other way. What is legally relevant depends on the specific course of events and basis. Therefore, describe what demonstrably happened, without drawing a final conclusion from a current empty balance. Our editorial analysis is that a good distribution question starts with traceable transactions and actual decision-making power. An abstract statement that everything belonged to the company or that everyone received the same amount does not replace that research.
Not every expense is automatically deductible
The question of which costs are eligible for deduction must be assessed against the applicable law and the relationship with the benefit. An invoice does not independently prove that every paid expense reduces the deprivation. The nature and context of the costs are also important. Therefore, separate possible costs with description, date, amount and source. Let the lawyer assess which items are legally relevant. An unspecified total operating cost provides few clues for a targeted decision on individual items.
Also note double processing. An amount that has already been included in a net proceeds should not be thoughtlessly subtracted again from the same outcome. A refund or compensation can also have its own legal meaning and requires accurate recording. Make it visible who paid, to whom and for what fact or purpose. Do not present an expected future amount as already paid. The calculation check must correspond to real documents, so that potentially relevant financial data is not lost between different tables with unclear definitions.
The amount of benefit and the payment option are different questions
The Supreme Court clarified the capacity assessment on March 16, 2021. In principle, capacity is discussed in the implementation phase. In the confiscation procedure itself, an appeal to a lack of capacity requires clear substantiation of the current and future situation within the applicable strict standard. Simply having little income now does not automatically mean that the payment obligation is set to zero. Moreover, the estimate of the benefit received remains a different question than the ability to pay.
In that judgment, the complaint against the assessment of capacity to pay failed. The eventual reduction in the amount to be paid was related to the passage of time in cassation, not to a defense of financial capacity that was subsequently granted. This distinction prevents incorrect use of the pronunciation. If you have financial problems, ask which documents about income, assets and prospects are required and in which phase a request fits. Other reasons for moderation may also require your own assessment. Let the lawyer formulate a concrete position instead of a general appeal to difficult circumstances.
Receipts on one account with different destinations
Fictional example: in a fraud case, a total of 24,000 euros is presented to Ivo based on receipts in an account. His overview shows that some transactions are recurring between own accounts, while other amounts have been paid to different parties. There are also expenditures whose legal meaning is uncertain. An advisor separates three questions: is the calculation correct, what benefit can be attributed to Ivo and which items may be relevant within the chosen basis? None of them are answered just with the current balance.
Ivo also has little income. This will be included in a separate capacity file, so that the calculation errors do not disappear in an argument about payment problems. The fictional example does not predict a lower amount; the continued payments can also be assessed differently depending on the context. It shows why every proposed correction needs a source and legal explanation. Your own spreadsheet is useful when the link with banking rules, documents and existing assumptions remains visible. A separate, more favorable total without traceable steps is much less helpful to the assessment.
A check sheet for sources and assumptions
Create a row by post with the amount from the claim and the own check. Use the same numbering as the calculation report where possible. Keep factual corrections separate from legal arguments. A double banking rule is a different issue than discussion about the deductibility of an expense actually incurred. Therefore, also put the type of objection in a column. This makes the calculation accessible to the lawyer and prevents a meaningful arithmetic correction from appearing to depend on another disputed legal principle.
- Item: report page, transaction line and description of the recorded receipt or saving.
- Period: relevant date and reason for including or not posting the post.
- Source: bank data, administration, statement or explicit estimation assumption.
- Person: substantiated link with acquisition, disposition and possible distribution.
- Correction: duplication, wrong value, missing context or legal costs question.
- Concurrence: reimbursement, compensation, attachment or previous inclusion in the calculation.
- Follow-up: desired piece, research question, own explanation and person responsible.
Below the overview, make a limited comparison between the original total and the various corrections. Mention uncertainties separately; don't subtract every possible item as if the judge has already accepted it. Show what outcome follows from an arithmetic improvement and what additional legal choice is still open. This way, a decision can be justified more precisely. Save the source file and work with recognizable versions, so that bank data added later does not invisibly change the previous figures. A verifiable calculation is more than a lower final amount.
A separate claim requires its own timely defense
Read the received call and ask which documents contain the financial substantiation. The criminal procedure rules have their own framework for the confiscation procedure. A defense in the main action does not automatically have to include every financial defense for the sequel. Therefore, discuss the required preparation and any research requests in a timely manner. For a comprehensive report, it may be necessary to involve a financial expert. This can help check figures while the lawyer assesses the legal significance and process route.
Any potential settlement or other settlement should also be read on its precise terms. What amount, what facts and what consequences will be settled? A payment proposal may have a different purpose than a substantive arrangement about benefits. Do not sign broad text because the monthly amount seems feasible without understanding the total obligation. Record agreements made and ask who monitors outstanding procedures. The administrative peace of a proposal is only valuable when it is clear which legal discussion is actually closed and which remains.
A payment agreement does not automatically change the judicial calculation
After a final payment obligation, CJIB can be involved in the implementation. The information about payment arrangements describes an appropriate practical approach. An application is not an automatic allocation and a scheme does not automatically make the determined amount substantively incorrect or lower. If there is insufficient capacity, also have it assessed whether a legal request is appropriate in the implementation phase. Keep up-to-date financial information and respond to mail, so that a practical problem is not unnecessarily exacerbated because no one follows the existing obligation.
Our analysis is that a good confiscation defense consists of two clear files: a check of benefit and separate substantiation of affordability where it is legally relevant. This means that a high amount is not accepted unquestioningly, but neither is it contested solely on the grounds that the money is now missing. Gather the sources, check assumptions and have the chosen basis explained. A precise calculation card makes the conversation about a fraud case more concrete and provides room for a careful decision about both the scope and appropriate follow-up.
Frequently asked questions
Is all turnover from a researched company automatically my benefit?
No, the chosen basis, cash flows, relevant period and personal allocation must be assessed. The distinction between turnover, revenue and benefit is also important. Ask for the underlying calculation and supporting documents.
Does a confiscation claim disappear once I have spent the money?
Not automatic. Current balance and previously obtained benefit are different questions. Have the actual cash flows and legal significance assessed and keep any capacity request separate from the calculation.
Can a low income already be a reason not to have to pay anything?
That does not automatically follow. In principle, carrying capacity is discussed during implementation; strict conditions apply in the confiscation procedure for a request based on this. Collect verifiable data and ask which route suits your situation.
