New psychoactive substances and changing drug bans

The term designer drug sounds as if a substance is always just outside the law. Since the introduction of substance group bans, this image has become even more misleading. At the same time, the other conclusion, that every new chemical is automatically banned, is also not careful. In the event of a suspicion, the composition, applicable legal description, specific act and date are decisive. Our analysis: treat a substance issue as a verifiable combination of chemistry and law. A store name, packaging label or old news item cannot replace that combination. The register must also include changes after the original ban.

Designer drug is not a closed legal category

An advertisement can call a substance new, experimental or legal. However, the Opium Act works with concrete prohibitions, lists and descriptions. In the event of a suspicion, have it determined which substance or preparation was examined and which legal route the accusation is based on. The word designer drug can explain the reason for an investigation, but does not yet indicate which provision applies. A broad market term and a legal substance description fulfill different functions.

That distinction is practically important for material with varying names. A product may be sold under multiple names and packaging may contain incorrect information. An abbreviation in a chat is also not automatically the chemical identity of what was later seized. Therefore, ask what connection has been made between product, sample, analysis and relevant behavior. Without that connection, a discussion about a ban can end up on the wrong topic. This connection makes it clear which expert and legal questions are actually open.

The substance group ban changed the way of checking

The government introduced a ban on certain groups of new psychoactive substances on July 1, 2025. The official news report about the start describes that not only individual substances are designated, but also chemically described groups. As a result, a new variant can fall under an existing group description. The question of whether an abbreviation is literally on a sample list is then insufficient to determine whether the substance falls outside the ban. (official news item about the start)

The independent conclusion for file research is that name searching is a limited audit method. A search engine may find a popular product name, but not provide a full legal classification. Ask which legal definition the expert used, which structure was established and which version of the scheme was applied. That research must be recorded in an understandable manner. A conclusion that falls within the law is less easy to verify than a report in which identity, applicable group and possible exception are discussed separately.

A fourth substance group was added in July 2026

An important topical issue is the expansion of list IA to include benzimidazolo opioids, also called nitasenes. Staatsblad 2026,179 published this addition on July 8, 2026; the decision entered into force the following day, according to Article III. It also added isotnitazepyne separately to Schedule I. An explanation that only mentions the three original groups from 2025 is therefore not a complete overview for October 2026. The legal change and the applicable date must be compared with older information.

That's a useful warning for anyone who saves sources. A reputable government website may correctly describe an older moment while a later change is published elsewhere. The source quality is therefore not only determined by the logo, but also by the function and date of the document. For a specific case, keep the amendment publication and the applicable consolidated text. Explain which piece describes the introduction and which piece reflects the law on the relevant date. This way, historical and current information remains recognizable.

A list of examples is not a closed exemption list

The official sample publication dated July 1, 2025 says it contains examples of banned substances. Anyone who does not find a product name on it cannot infer general consent from it. Furthermore, the same substance can also be listed separately on a different list. Therefore, first check the function of a list: is it the legal appendix, an explanation, a public example or a commercial overview? Only the first type itself forms the legal classification to which the associated prohibition fits.

A useful source note not only lists the URL, but also the question the document can answer. A list of examples can help you find a recognizable term. It cannot simply demonstrate that every variant not mentioned is freely tradable. This distinction prevents an argument from relying too much on absence in a document that never promised completeness. It also makes clear why a later supplemented list does not automatically mean that every previous conduct was already covered by exactly the same regulations.

Ordering, receiving and being present are different moments

Determine the relevant actions separately: ordering, payment, shipping, border crossing, receipt and possible later presence. The fact that different moments occur around a change in the law requires more precision than one purchase date above the file. Let it be determined for each alleged act which rule applied at the time. The principle that a ban cannot simply be applied retroactively does not mean that previously obtained material may be kept or traded indefinitely after a change. The concrete action remains the starting point.

Therefore, save invoices, shipping information and original correspondence without compressing them into one convenient date. A statement can show payment while receipt was delayed. An account message may mention an order without proving what content actually arrived. These various evidentiary questions deserve their own place. The quality of the timeline lies in the source per moment, not in making the story as short as possible. The lawyer can then assess which dates actually make a legal difference.

Ask how the sample under investigation is connected to the case

A laboratory report becomes more readable when it is clear which sample was examined and from which object it came. Record identification numbers on the seized items, sample identification, description of packaging and link to the report. Then ask what exactly has been established: a substance identity, mixture, concentration or other limited conclusion. Do not use your own chemical assurance to supplement a technical report. A relevant ambiguity can actually give rise to a specific question to the expert.

Not every possible laboratory question is useful in every case. The value of counter-research depends on the specific point of discussion. When only the trade name is disputed but the identity has been properly established, this requires a different response than when the origin of the sample is unclear. Therefore, first make it visible which conclusion is based on which source. This prevents valuable attention from being diverted to an abstract debate, while the real problem concerns the link between the material found, the person and the alleged action.

A legal application must be tested against real conditions

The regulation has exceptions and options regarding permitted applications. The government information on opium exemptions refers to the exceptions in Article 2a, second paragraph, for list IA. Do not treat a label as evidence that such a legal exception has been met. A supplier who writes solely for research purposes does not independently determine the legal status of the delivery, possession or a particular application. Which exception is meant and what facts must be present for this? (government information about opium exemptions)

Create a separate document set when actual professional research, a drug context or an exemption is cited. Consider the concrete application situation, responsibilities and the applicable conditions. Share those documents specifically with the lawyer. A general professional description is often less informative than a verifiable assignment and the correct consent document. Also, do not use, move or resell the content yourself to test an exception. First it must be assessed which action is possible under which regulation.

Fictional example: an old product page and a new arrangement

In a fictional case, Eva keeps a product page that states in 2025 that a substance is not among the examples mentioned. She will receive a package with a similar trade name in August 2026. After seizure, it refers exclusively to that old page. However, the relevant questions are broader: which substance was found, which legal classification applied during receipt and possession, and what did Eva actually know about the product and destination? The old screen image does not answer all these questions.

Good preparation does save the screen image, because it can provide context about the information provided. In addition, the real report, receipt date and legal changes are collected. The fictional example does not predict guilt or punishment and does not assume that the content necessarily concerns the new substance group. Rather, it shows why context and classification should be examined separately. An outdated commercial communication may be relevant to a question about knowledge, without replacing the current legal description.

A small registry makes source versions verifiable

Create a register with one line per product or sample actually examined. Avoid having your own encyclopedia of all conceivable drugs: it quickly becomes uncontrollable and distracts from the matter. Note which data comes from the file and which questions are still open. The Public Prosecution Service guideline for list I and list IA is policy for criminal procedure and should be read as such. It does not independently determine the chemical identity and is not a guarantee for the judge's decision. (OM guideline for List I and List IA)

  • Product: trade name, packaging, original description and origin of that information.
  • Sample: seizure number, sample identification and link to the contents examined.
  • Finding: exact conclusion of the report, including limitations and possible mixtures.
  • Time: relevant alleged acts with date and source of evidence per event.
  • Law: applicable list or group description and the version in effect on that date.
  • Exception: concrete grounds provided and documents that can support the conditions.
  • Open question: which missing technical or legal information can really change the assessment?

Current events require more than a well-known government link

Our conclusion is that substance issues mainly require accuracy between disciplines. A chemical name without an appropriate date is insufficient; so does an article of law without a reliable link to the material examined. The expansion with nitasenes in 2026 makes visible how quickly an apparently current explanation can become outdated. A good article and a good preparation file should keep that change history visible. This is more substantively useful than a long string of popular product names that the reader might mistakenly treat as a safe or complete list.

Use the drug possession guide for the broader trial questions and the explanation of the criminal file when reports or decisions are missing. Have the precise fabric classification and your own involvement assessed based on the real pieces. Avoid firm conclusions based on a store text, experience report or packaging. If you sort out the source version, monster identity and timeline, you can ask more specific questions and prevent the discussion from starting from the wrong starting point.

Questions from litigants

Frequently asked questions

Have all designer drugs been banned since 2025?

That general wording is too broad. The law uses specific lists, substance groups and exceptions. Examine the real substance and the applicable regulation on the date of the alleged act. LijstIA was also expanded in July 2026.

Is a substance legal if its name is not on the list of examples?

That does not follow. An exemplary list is not necessarily complete and a substance may fall under a chemical group description or individual list entry. Have the identity and legal classification checked.

Does the label not prove possession is permitted for human consumption?

No. A label does not independently determine the legal status. The actual composition, concrete act, applicable provision and any legal exception must be examined. Do keep the packaging as part of the factual information.

This article provides general information. The rules and options depend on your situation. Discuss your case and possible deadlines with a lawyer.
