The Dutch violent crime compensation fund alongside a criminal case

After violence, the criminal case can remain uncertain for a long time, while the consequences continue to have an impact on a daily basis. The Violent Crime Compensation Fund can offer financial compensation under certain conditions. That route has a purpose other than fully recovering every amount of damage from an perpetrator. Our analysis: victims mainly benefit from an overview that separates recognition, recovery and different payment routes. This prevents both unnecessary waiting for a criminal judgment and the expectation that one application will resolve all financial consequences. A careful application file describes the event, injury and other compensation without disclosing more personal information than necessary.

Recognition and recovery of damages fulfill different roles

The Compensation Fund is a provision for situations that fall under its legal conditions. The central government describes the compensation in addition to other options for compensation for damage. Therefore, do not view the application as a procedure in which every invoice or loss of income is automatically fully allocated. The legal route to the perpetrator may remain separately important. Anyone who understands these differences from the start can make a more targeted choice as to which documents are needed for which decision and which expectations are realistic. (The government describes the compensation)

Our editorial analysis is that the word compensation often hides too many different things. A fixed compensation can provide support and recognition, while a civil or criminal claim for damages requires its own substantiation of damage and liability. An insurance payment can again be based on contract terms. None of those routes therefore have to be useless. They must be viewed together. A simple overview of the purpose, decision-making authority and requested information prevents a victim from treating three different files as one application.

Not every criminal offense falls under the same regulations

The current questions and conditions of the Compensation Fund make it clear for which victims an application is possible. Violent and sexual crimes, their consequences and the position of the applicant all require attention. Surviving relatives and relatives also have their own conditions. Damaged property following a simple theft does not give rise to the same claim simply because of the existence of a criminal offence. First have it determined which legal category belongs to the situation before extensive medical documents are collected for an unsuitable application.

Describe the event factually without trying to prove its seriousness with a legal name. What happened, where and when, what information is available about it and what consequences followed? This gives the assessor starting points. The lack of an exact date due to long-term events does not have to be solved with a made-up date. State the available period and explain how this is handled in the application. Consistent description comes from honestly distinguishing between memory, documentation, and unknown details, not from ironing out every uncertainty.

Waiting for a conviction is not a general condition

The Compensation Fund independently assesses the plausibility of victimization. A conviction is not required in every situation; Even the absence of a declaration does not automatically rule out an application. This does not mean that a self-declaration is sufficient in all cases. Ask what objective data can support the event and circumstances. Consider available police information, medical records or other relevant documents. Keep the function of each piece clear: a treatment report can describe the consequences without determining every detail of the circumstances.

A dismissal or acquittal also requires accuracy. Read why that decision was made and have it assessed what it means for this application. An application is not a way to make a criminal determination of guilt without the associated guarantees. The Compensation Fund has its own defined assessment. This distinction also protects the quality of the file: do not write that an agency declared an offender guilty when it has only established that an application meets the fund conditions. Different outcomes can answer different questions.

Describe consequences without making diagnoses yourself

The explanation of serious injuries and the applicable injury list provide guidance for the assessment. Both physical and psychological consequences may be relevant, but the requirements and substantiation must be applied to the concrete situation. An everyday word like trauma is not itself a medical diagnosis. State which complaints have been identified, by whom and in what period. Underlying information must match the purpose of the application. Let a practitioner provide factual information within his expertise, without prescribing a desired legal conclusion.

A consequence overview can be useful for preparation. Describe limitations in work, education, sleeping, contact or daily care with time of onset and development. Keep observation and medical assessment recognisably separate. Someone may say that traveling has become difficult, but should not provide a permanent prognosis on behalf of a specialist. Improvement can also be relevant information and should not be omitted for fear that recovery would make the event less serious. The goal is a reliable picture of the injury and the applicable criteria, not the most serious possible story.

The request date determines which rules are consulted

For applications from January 1, 2026, the Compensation Fund published a new policy bundle and injury list. The announcement explains that the application date in principle determines the version used, with transition rules for earlier applications. Therefore, check which policy version corresponds to your own application or decision. An old brochure, a saved search result and a current decision may be worded differently. That difference must be explained before anyone concludes that the evaluator misapplied the rules.

For important preparation, save the name and date of the document used. In addition, make a short note of which question it answers. This makes it visible later whether a discussion is about the type of injury, the applicant category or the concurrence of payments. A source reference is only truly useful if it leads to the relevant version. Do not copy a table amount from another situation without checking the category and explanation. A high benefit in an online example says little about the individual assessment of another file.

A long submission period is no reason for unnecessary delay

The information about the filing period generally mentions ten years. There are special starting points for minors and certain situations; Under certain circumstances, a late application can still be assessed. The precise calculation must be checked at your own position. So do not automatically take the date of the criminal sentence as a starting point. Keep details of the event and relevant personal circumstances. When the deadline may have expired, explain the reasons for the delay rather than deciding that each request is pointless. (information about the filing deadline)

Waiting within the period may also have consequences for the availability of documents. A treatment contact ends, a file must be requested or a person concerned moves. This does not require a hasty application with incorrect data, but a timely inventory meeting. Ask what information is already available, what information will follow and how additions can be made. Make a note of agreements made. Make sure that a contact about missing documents is not confused with a formally submitted application: the receipt and registration of that application must be independently recognizable.

Payments must be returned to the same claim

The policy bundle regulates how damage that is also compensated in another way is dealt with. In the event of overlap, settlement or reimbursement may be required. Therefore, keep track of not only requests, but also actual receipts and the damage to which they relate. A promised payment is different from an amount in the account. The same applies to a judgment that awards damages while payment has not yet been made. Report relevant developments according to the fund's instructions and save the response.

Create a separate rule for the injured party in the criminal case, any insurer, direct payments and a compensation measure. The latter route can run via CJIB and has its own implementation. The overview prevents the same damage from accidentally being presented as completely unreimbursed. It also helps explain why an amount collected later does not always fully replace an earlier compensation. Discuss a proposal for final settlement carefully before signing: such an agreement may have consequences that go beyond the current application form.

Fictional example: recognition while the investigation is still ongoing

In a fictional example, Mila has long-term complaints after an incident of violence. The police investigation is ongoing, her employer continues to pay temporary wages and some healthcare costs are covered by her insurance. She thinks that a Compensation Fund application only makes sense after the criminal case. A supervisor first helps to inventory her position and available information. The file contains its own description, police data and specific information from the practitioner. The still uncertain criminal outcome is stated as uncertain. No condemnation is suggested where none exists.

Later, the criminal court partially granted a claim for damages. Mila keeps a separate record of the decision and subsequent payments and reports the relevant development to the Compensation Fund. The fictional case predicts no award and no amount. She shows that two routes can be useful at the same time if their goals and mutual connections remain clear. Good administration not only serves the authority here. It also protects the victim against the confusion that an allocated, received and settled amount always concerns the same money and the same damage.

Seven parts for application and follow-up

Maintain one workbook with a brief table of contents and separate appendices. Send sensitive documents via the prescribed secure route and check what is already available at the authority. For unclear requests, ask for an explanation of the purpose of the information without ignoring a response date. Record what has been submitted and when receipt has been confirmed. A helpful loved one can provide support, but permission and authority must be clear before anyone requests substantive data or passes on decisions on behalf of the victim.

  • Position: victim, next of kin or surviving relative and the appropriate conditions.
  • Event: place, period, factual description and sources that support the facts.
  • Injury: established consequences, relevant treatment data and distinction between complaint and diagnosis.
  • Deadline: assessed starting point, application date and any reasons for delay.
  • Policy version: applicable bundle and injury list with document date.
  • Payments: other requests, decisions, receipts and the damage to which they relate.
  • Follow-up: additional questions, contact person, decision letter and assessed objection or appeal period.

The dossier must enable support without distorting expectations

Our conclusion is that the strength of the Compensation Fund lies precisely in its own function. Compensation can be meaningful without replacing a full damage assessment or a criminal conviction. A usable application therefore matches the real fund conditions and leaves room for other suitable routes. It makes clear what happened and what consequences have been substantiated, while uncertainties remain visible. This does not require an exaggerated story, but a careful file in which the event, the injury and the financial context are not always mixed up.

Use the explanation about the injured party and damages for the separate criminal damage claim. Anyone who receives a rejection must have the reasons and legal remedies in the decision letter assessed in a timely manner; a general telephone conversation does not automatically replace an objection. Check with a supervisor or lawyer to see what missing information or substantive discussion is relevant. The choice of next steps must be tailored to your own situation and available documents, so that the application remains a targeted route in addition to the criminal case, rather than a new source of unnecessary uncertainty.

Questions from litigants

Frequently asked questions

Can I apply without a convicted offender?

This is possible under certain conditions. The Compensation Fund independently assesses the plausibility of victimization. A conviction is not always necessary, but relevant objective information may be necessary. The other conditions, including those regarding injuries, also remain applicable.

Will the Compensation Fund reimburse my entire damage?

The compensation is not full individual compensation. The assessment and amount follow the applicable fund rules. A separate claim against the perpetrator or another route may remain relevant. Coordinate those routes and keep any overlap in payments visible.

Do I have to report a later payment from the perpetrator?

Report relevant other compensation according to the instructions of the Compensation Fund. For the same damage, settlement or reimbursement may occur. Keep both the decision and proof of actual payment and ask for an explanation of what that development means for your compensation.
