European arrest warrant: surrender from the Netherlands

An arrest for a foreign criminal investigation can be unexpected, even if you have been living in the Netherlands for a long time. The Dutch procedure then concerns possible extradition, not a complete new trial of the foreign accusation. Our analysis: let two questions be examined separately from the start. What should the Dutch judge assess about the European arrest warrant, and what assistance is needed in the country where the case is pending? Collect an emergency folder and discuss consent decisions only after the consequences have been explained. This article discusses tradition from the Netherlands; it does not provide substantive procedural advice on the law of another state.

Surrender within the European Union has its own procedure

A European arrest warrant can be issued for criminal prosecution or for the execution of a custodial sentence. The European Framework Decision and the Dutch Surrender Act regulate the cooperation and procedure. Surrender between EU member states differs from extradition to a state outside that system. Therefore, ask which warrant or alert underlies the arrest and which state the person is seeking. A general message that you have been flagged internationally does not contain all the information necessary to carefully assess the Dutch legal position and any defenses. (European framework decision · Dutch Surrender Act)

Save or request the documents from the lawyer and note the date of arrest. A loved one can help collect existing documents without having to improvise contact with foreign researchers themselves. Ask where the person concerned is staying and how the lawyer can be reached. The urgency is not just about a hearing date: choices about assistance, statements and consent can have significance early on. Therefore, start with the actual documents and the correct procedure, not with a general suspicion about an old foreign fine.

Dutch and foreign aid answers various questions

Article 43a of the Surrender Act regulates legal assistance in the Dutch surrender procedure and the appointment of a counselor in the event of arrest. Ask for assistance and indicate which language you understand. Also discuss interpretation and explanation of the essential documents. Knowing some everyday Dutch is not always enough to understand complicated choices about tradition. A lawyer can assess the formal position and prevent a signed statement from taking on a different meaning than you expect at that moment. Report problems with comprehension or ability to cope.

The European directive on access to a lawyer also pays attention to support in the issuing state. Discuss with the Dutch lawyer whether a lawyer is needed, for what task and with what financing. For example, that foreign lawyer can help obtain information about the underlying proceedings; the Dutch lawyer assesses the surrender question here. Ask who controls the order, a foreign judgment and any procedural statements, and how relevant information is exchanged securely without unnecessarily making multiple conflicting statements.

The content determines which questions should be asked first

Check identity, issuing authority, facts, period and purpose of the order. Is it a matter of prosecution or an existing conviction? What decision is mentioned and what punishment is still outstanding? An order can contain multiple facts with different backgrounds. A memory of one old contact does not say enough about the current size. Make it clear for each part what you recognize and which parts are missing. The lawyer can check whether the order meets the requirements and what additional information is required. A factual ambiguity thus becomes a specific question instead of a general denial.

In the case of an existing conviction, the method of summoning, presence and defense may be relevant to the surrender assessment. Therefore, prepare summonses, messages from foreign lawyers and received judgments. Don't say without checking that you never knew anything when an old address notice or authorized representation may exist. Conversely, a registration that a letter has been sent is not the same as actual knowledge for every legal question. The Dutch lawyer must be able to apply the relevant legal conditions to the specific procedure. This requires original information and sometimes explanation from the foreign lawyer or authority.

The Dutch court is dealing with the surrender conditions

The Public Prosecution Service's explanation of the proceedings describes the treatment by the International Legal Assistance Chamber of the Amsterdam District Court. This judge assesses the possibility of surrender; he does not retry the foreign accusation in its entirety. An extensive story about why a foreign witness is wrong may be important for the case there, but is not automatically a relevant Dutch extradition defense. The lawyer must determine which information has meaning within the legal framework. Even if you are convinced of your innocence, investigation into the applicable procedure and conditions remains necessary. (OM explanation of the progression)

That does not mean that facts about identity or obvious confusion are unimportant. However, they must be translated into the correct legal question. For example, show which identity data differs and which source supports that. Ask how a substantive defense about the foreign accusation is passed on to the competent defense there. Our analysis is that a good emergency folder therefore has two columns: relevant to Dutch tradition and relevant to the foreign main case. One document can appear in both columns, but the questions it answers do not have to be the same.

Dutch ties can be relevant without forming a general blockade

Nationality and permanent lawful residence may in certain situations have significance for a return guarantee or taking over the execution of the sentence. The current Articles 6 and 6a of the Surrender Act contain various conditions for this. Dutch nationality does not mean that surrender for prosecution is always refused. Long-term living in the Netherlands also does not give the same position in every case without further assessment. Therefore, collect existing residence, living and work data and have it assessed which arrangement suits the purpose of the order. A general reference to your life in the Netherlands does not yet describe all legal criteria.

In the case of a request for the execution of a sentence, the assessment is different than in the case of an order for prosecution. Moreover, if punishment is possible in the Netherlands, this does not mean that the conviction disappears. Ask what a possible refusal or takeover really means in the specific situation and what information is missing. Consider continuity of lawful residence and information about the sentence. Also communicate interruptions honestly. A file that only contains recent pay slips may leave a relevant period unanswered. The lawyer can determine which documents actually substantiate the applicable conditions.

Health and detention conditions require individual information

Concerns about treatment after surrender may be legally relevant, but require a concrete assessment within the applicable framework. General reports about a country do not automatically answer the question of what risk this person runs from this surrender. Provide the lawyer with specific information about a current medical situation, necessary care or specific previous experiences, with appropriate substantiation. Distinguish between your own observation, a suspicion and general public information. Have medical documents used in a targeted manner. Sending the entire treatment history without explanation can damage privacy without making the relevant legal question clearer.

Also ask what guarantees or additional information the competent authorities can investigate. A request for information, postponement of a decision and final refusal are different outcomes. Maintain that distinction when summarizing messages to family. The lawyer must be able to explain what risk is being investigated, what is still missing and what possible consequences the available information may have. A worrying situation deserves serious assessment, but is no reason to predict a guaranteed refusal yourself. The content of the legal test and the concrete facts determine which next step is appropriate in the Netherlands.

An abbreviated procedure requires a conscious choice

The law allows consent to immediate surrender. Article 39 OLW stipulates that the statement made cannot be revoked. Therefore, discuss the concrete consequences with the lawyer in advance and have unclear parts explained in a language you understand. Agreeing is not a simple administrative confirmation that the name is correct. Any waiver of the protection of the specialty principle also requires separate attention. That principle broadly affects prosecution or deprivation of liberty for previous offenses other than those for which extradition is permitted, with legal exceptions. Have the meaning for your case explained.

A choice for speed may have understandable reasons, but should not be based on an incorrect expectation about release, foreign sentence or return. Ask which points would still be examined during the normal procedure and what consent means. The judge remains involved within the law; the shortened route is not a private arrangement with the police. Don't make a decision just because someone else says everyone should sign right away. Our practical conclusion is that time pressure requires a short, clear decision discussion: which choice, which consequences and which questions must be answered before the statement?

Fictional: an old judgment and an incomplete residence file

In this completely fictional example, Aleks is arrested in the Netherlands on a warrant for the execution of a foreign sentence. He has lived here for years and thinks that surrender is therefore impossible. Moreover, he does not know exactly which hearing led to the verdict. His lawyer separately examines the foreign case documents, the relevant residence conditions and the options for sentencing. Only the current rental contract does not correspond to the period of stay. The mere memory that he once spoke to a lawyer does not answer the question about his involvement in the specific foreign procedure.

A relative collects existing residence information and correspondence. The lawyer will specifically request the missing procedural documents and discuss whether foreign assistance is necessary. Aleks does not sign a consent based on an assumed automatic return. The fictional example does not predict a refusal or admission of surrender. It shows that the same person can have several legally different questions. A quick but separate analysis makes it clear which source is needed for which condition and prevents a reassuring general statement from becoming an irreversible process choice.

Seven components that make specialized assistance immediately usable

The emergency folder does not have to be complete before you call for help. Start with the available pieces and identify what is missing. Make personal data and medical data accessible only to appropriate recipients. This card is intended for extradition from the Netherlands and is not a manual for conducting foreign criminal proceedings yourself or for circumventing an alert.

  • Arrest: date, place, residence location, known alert and Dutch contact and case details.
  • Order: full available text, issuing state and authority, facts and purpose of prosecution or execution.
  • Procedure there: verdicts, calls, attendance details and previous lawyer contacts, with clearly marked uncertainties.
  • Binding here: nationality, lawful residence, relevant periods, residential and work details and known Dutch procedures.
  • Rights and care: language needs, resilience and targeted information about concrete health or detention risks.
  • Choices: explanation of normal or abbreviated procedure, consent, specialty and any conditions or guarantees that still require investigation.
  • Collaboration: Dutch lawyer, possible lawyer in the issuing state, financing questions and who requests what information.

Keep the decision period, detention and actual transfer apart

The Surrender Act sets deadlines for the decision, with options for extension in certain and exceptional circumstances. Article 22 starts with a period of sixty days, but has a more extensive system than one universal end date. Therefore, do not draw the conclusion that after a fixed number of days all procedures end or release follows automatically. The legality and possible suspension of detention must also be assessed separately. Ask the lawyer what time period runs in your case, what decision has been made and what this means in practice. The date on a general information page is insufficient for this.

An authorized surrender and the actual transfer are also not the same moment. Possible postponement, ongoing Dutch procedures and special circumstances may require a separate assessment. There is no regular appeal against the ordinary surrender decision; therefore discuss the available protection in a timely manner and at the correct level. Keep contact details, decisions received and new information central to the lawyer. The essence of good preparation is that the Dutch test, the foreign main issue and the immediate consequences each have their own responsibility and documents. In this way, a substantive choice becomes possible under time pressure without promises about a procedure involving multiple authorities.

Questions from litigants

Frequently asked questions

Can the Netherlands never hand me over as a Dutch citizen?

That is incorrect. Nationality and certain residence status may under certain conditions have significance for guarantees or punishment, but do not constitute a general block against all surrender.

Can I withdraw consent later?

The declaration of consent according to Article 39 OLW cannot be revoked. Have your lawyer explain the consequences and any waiver of specialty in advance.

Does the Amsterdam judge assess whether I committed the foreign offense?

The extradition judge does not retry that accusation in its entirety. He assesses the surrender request within the Dutch and European legal framework.

This article provides general information. The rules and options depend on your situation. Discuss your case and possible deadlines with a lawyer.
