Illegal fireworks: possession, storage and the criminal case
In a fireworks store, an old memory of what was once allowed can lead to the wrong conclusion. A national consumer ban has been in effect since August 1, 2026, which significantly changes the previous framework. At the same time, research remains necessary for each case into the type of product, the date, the action and the person to whom it is attributed. Our analysis: do not start with an online fine table, but with an outdated inventory of object, regulations and actual role. This makes it clear what legal assistance is needed and what information in the file cannot yet be checked.

Place the event before each legal comparison
The Government Gazette with the entry into force decree stipulates that the Safe New Year's Eve Act will come into effect on August 1, 2026. The current government explanation states that consumers are no longer allowed to purchase, possess or light fireworks from categories F2, F3 and F4. F1 has a separate position and there are specific routes for professionals and exemption holders. However, a criminal case concerning an earlier date must be examined according to the law applicable at the time; a current public explanation does not rewrite the past. (Official Gazette with the entry into force decree · current government explanation)
Therefore write a date or period for each alleged action: purchase, import, storage, transport and, if necessary, cutting off. These moments do not have to coincide and can be legally assessed differently. A receipt from before the change in the law does not automatically answer the question of later ownership. Also have transitional law and any subsequent more favorable regulations legally assessed when relevant. The most important practical principle is that old rules of thumb should not be stuck on a new case without a date.
The name on an advertisement is insufficient
Make it visible to the lawyer what the official inventory says about the product. A nickname, a photo on social media or a sales text does not always prove the legal category of the actual found item. Packaging, labelling, composition and technical research may be important. Ask which product is registered under which good number and how the classification was established. A mixed batch should not be described as one similar quantity without explanation.
The government explains what information should be on the packaging of F1 fireworks, including category and Dutch usage information. This does not mean that any label irrefutably proves the content or that products with different letters are automatically legal consumer fireworks. Have technical differences specifically investigated. Do not attempt to recreate missing packaging or purchase a similar product to reconstruct a site. A relevant question may be what certainty is possible when packaging and contents are not reliably linked.
Ask what mass or count was used
For fireworks, quantity can be described in different ways: numbers of items, packaged mass or explosive content. These terms are not interchangeable. Ask which criterion is used in the file and in the applicable rule and how it was weighed or counted. Your own estimate based on the size of a box is not an expert determination. Keep available original receipts or inventories, but leave hazardous products where they are safely shielded and follow professional instructions.
Also check the link between inventory and location. Are different parties registered separately? Is it clear which box belonged to which room and whether the data is reflected in the original photos? A deviation does not automatically make the entire study unsound, but it can raise a specific question. Describe the difference in numbers or weight exactly and indicate which source you use. The aim is a verifiable assessment, not a general claim that every weighing error must lead to acquittal.
A location does not say everything about the person involved
A box in a shared shed raises questions about access, knowledge and action. Who used the space, since when and how? Who ordered, paid for or moved the items according to the file? Have the lawyer investigate what legal conduct is being accused and what needs to be proven. Simply saying that the shed belongs to someone else may not be enough; merely possessing a key is also not a complete evidentiary argument for every possible action.
Make a timeline of your own observations and highlight information you only learned after the find. Do not consult with other parties involved to reconcile statements. For example, a proof of payment can say something about a purchase, but without context not always about ownership of the entire lot or knowledge of technical properties. Conversely, a missing payment cannot automatically exclude another role. Good preparation examines what each piece of information really carries and where the file combines different roles too quickly.
An exemption works within its own conditions
The Safe New Year's Eve Decree details the exemption route for associations and foundations. This includes conditions regarding, among other things, organization, safety plan, location and implementation. The existence of such a route does not mean that every member is allowed to keep fireworks at home or that an announced request constitutes permission. Take the complete decision and regulations with you when you rely on them. Also check who is the holder and which actions, products and periods are actually covered. (Decision to have a safe New Year's Eve)
A professional capacity or permission from a foreign seller does not automatically remove Dutch regulations. Therefore, make a separate list of permits, exemptions and documents for transport, with sender and validity. Have them assessed as to whether they relate to the accused person and the activity under investigation. A permit for a show is not simply a general storage permit. Especially with multiple coherent rules, a false sense of certainty arises: one real document is then wrongly given the meaning that everything surrounding the party was permitted.
Acting safely and preserving evidence require coordination
Potentially dangerous fireworks should not be opened, tested, repackaged or taken to an authority in a car without professional instruction. A suspect does not have to create a safety risk to substantiate his position. Report an acute dangerous situation via the appropriate emergency service and follow instructions. Discuss with the lawyer what existing data can be safely retained: an original advertisement, invoice or photo that already exists. Securing documents is different from carrying out technical research on explosive articles yourself.
If fireworks are taken or destroyed, ask what registration and research information remains available. The possibility of checking classification and quantity may be relevant for the defense. This does not mean that every object must be kept indefinitely, regardless of the danger. Have a timely and targeted assessment of what additional research is needed and how this can be done safely. The general guide to attachment and return describes the other legal track; a request for restitution is not equivalent to contesting the criminal case.
Fictional example: an old box after the change in the law
In a fictional example, two boxes of fireworks have been stored in a garage since New Year's Eve. The resident remembers an old explanation about permitted consumer quantities and assumes that an unopened package is sufficient. The party will be found in October 2026. The important questions now are which articles are involved, which act and period are blamed and how ownership is attributed. The earlier purchase date is a relevant factor, but does not automatically solve the assessment of the later possession.
The lawyer collects the official inventory, available photos and purchase documents and checks the applicable provisions after August 1. The resident does not move the party to take his own photos and does not invent a destination for an association that was never involved. The example mainly shows why dated legal research is necessary. An old rule may have been correct and yet not answer a new suspicion. The outcome remains dependent on the legal basis and proven facts in this specific case.
An inventory of official qualification questions
A usable file card prevents technical and legal terms from being mixed up. Make one line per distinct batch or location and refer to the official good number. Note which data are established, which are based on a communication from someone else and which are lacking expert verification. Do not give access to hazardous materials to a private reader to complete the form. The card is intended for the lawyer interview and for specific requests within the procedure.
- Time: date or period of purchase, import, storage, transportation and, if applicable, use.
- Item: official description, category, packaging, labels and good number.
- Quantity: counting or weighing, unit used and the origin of the measurement data.
- Location: original site, access and recorded use of the space.
- Role: concrete own action, knowledge and information that comes exclusively from others.
- Permission: full permit or exemption, conditions, holder and validity period.
- Follow-up: Missing report, time-sensitive investigation request, and securely coordinated action.
Then read each conclusion back to the underlying line. If a document only states packed mass, a summary should not change that to explosive mass. If a batch consists of different categories, it should not be treated as one product without explanation. This precision does not guarantee a favorable outcome. It does prevent a defense from focusing on a standard that the accusation does not use or from an incorrect summary later becoming more important than the original document.
An amount or table does not predict your punishment
A criminal settlement is related to the proven conduct, legal qualification and circumstances. Online fine amounts may be old or relate to a different product group. Therefore, immediately take with you any punishment order, summons or summons you have received and check the response options. A quick payment to get rid of the uncertainty can have legal consequences that go beyond the amount. Before making a decision, have it explained what the document means and what legal remedy period applies.
A Public Prosecution Service directive is also not the same as an automatically binding sentence for the judge. Quantity may be relevant, but should not replace the analysis of danger, role, recidivism and other circumstances. Young people also have their own procedural and pedagogical questions. This guide therefore deliberately does not mention a general price tag for a fireworks store. Specific advice requires the file, the applicable date and the individual position; a popular comparison with the business of an acquaintance can already go wrong with the product category.
Keep a separate view of a criminal case and other consequences
In addition to the criminal accusation, there may be other consequences, such as damage, rental problems or an administrative decision. A letter from a landlord has a different purpose and a different procedure than a criminal order. Create a line per document with sender, receipt, decision and deadline. Don't assume that fighting one piece automatically stops all other consequences. Let a lawyer determine which connection exists and which information is sensible and necessary in which procedure.
Our editorial conclusion is that fireworks cases are extra sensitive to outdated security after the change in the law. The practical solution is not to memorize an even longer list of exceptions, but to link each statement to date, product and action. This also helps to recognize real uncertainty in the file. With official classification, carefully preserved documents, and timely legal assistance, the discussion can be about what needs to be proven, rather than about an internet rule that applies to another year or party.
Frequently asked questions
Can I keep old F2 fireworks because I used to buy them legally?
Don't assume that. The government has described a consumer ban since August 1, 2026 that also includes possession. Have the specific date, category and applicable rules assessed. Do not move or deliver material on your own initiative without safe professional instruction.
Does an exemption from an association make my own stock legal?
Not automatic. Check who is the holder and which products, actions, locations, times and conditions are covered. An application or membership is not the same as a valid exemption for the situation being investigated.
Do I have to weigh the boxes myself for my defense?
No. Opening, moving or testing can be dangerous and disrupt the research. Ask the lawyer for the official count, weighing and classification. Save existing documents and have additional technical research assessed safely and within the correct procedure.
