An imitation weapon or alarm pistol in a criminal case

It doesn't really shoot is an understandable first reaction when the police take a replica or alarm pistol. Legally, that only answers part of the question. External similarity, technical implementation, legal category and the concrete act can each have meaning. A possibly permitted toy object can also raise other legal questions in a threatening situation. Our analysis: have the object actually found assessed and make a distinction between classification, possession and what would have happened to it. A product name, color or purchase abroad is not a complete legal conclusion.

Start with the item, not the sales name

The Weapons and Ammunition Act has categories and rules for various actions. Ask how the found object is officially described and under which property number it is registered. An advertisement containing a toy does not automatically prove that the item found meets all relevant conditions. The same applies to its own name as a decoration or starting pistol. The legal assessment must be consistent with properties and the applicable standard, with attention to the version that applied on the date examined.

Check whether the photos, technical description and packaging, if any, actually belong to the same item. For multiple items, an unclear inventory can lead to incorrect conclusions. Have a lawyer ask specific questions about missing data instead of ordering or testing a comparable product on your own initiative. It is about the object examined in the case, not about what a new copy could do according to an online store. A concrete link between source and object is the first step towards a testable qualification.

An unusual color is not a general disclaimer

The police explain that similarity in shape and size can be relevant for fake firearms. A bright color does not automatically take away that question. A short photo can also give a different impression than the entire object. Therefore, ask which visible features are mentioned in the report and which legal provision applies to them. Avoid a self-invented rule that only a black model can be prohibited or that a colored cap is always sufficient to determine the legal position.

The observation of a bystander or police officer is also a different question than the final technical classification. From a distance, an object can be mistaken for real, while later it turns out that it functions differently. These different perspectives do not have to be contradictory. Other circumstances may become relevant for a suspicion of a threat than for the mere possession of it. Therefore, do not let the technical outcome automatically answer all questions about a previous situation. The file must indicate who could see what and what action is blamed.

An alarm pistol requires an assessment of the implementation

According to the police, the position of an alarm pistol depends, among other things, on age and design. That makes the precise properties important. Ask whether an expert report is available and which legal category is adopted. A statement that someone has never purchased real ammunition does not replace that investigation. An unusable or modified object can also raise legal questions that cannot be answered solely with an impression of its current operation. Have it determined what was present on the date charged.

Do not attempt to demonstrate, block or change the operation yourself to achieve a favorable category. This can be dangerous and make the original condition unclear. This guide therefore does not contain any technical instructions for use or adjustment. The useful question for the defense is which properties have been expertly determined, with what limitations and on which object. If research appears to be incomplete, the lawyer can have the need for supplementation assessed. A secure procedural question is better than a private trial whose reliability and legality cannot be checked later.

A marking must fit the correct legal framework

A toy context may be relevant, but a separate CE mark or age indication is not a universal answer to every criminal law question. Regarding the marking, check whether it belongs to the specific article and which legal conditions are invoked. The police's public information makes it clear that toy position and use do not coincide. Anyone who only remembers the word toy can miss the difference between keeping it at home, taking it with you and behaving towards someone else. Have the entire situation assessed.

Bring original packaging, manual and purchase information as documents when available. Do not create replacement packaging that is presented as historical evidence. A statement from the seller can provide information, but is not automatically an independent legal qualification. Ask which data actually follows from which document. For example, it can be determined what was proposed at the time of purchase without concluding that the item was therefore permitted in the Netherlands and for any use. The boundaries of the source are part of the substantiation.

Consent to possess is not consent to any use

Different rules may relate to possession, transport, carrying, importing or using. A permit, exemption or special arrangement must therefore be read carefully. A membership or foreign sales permission is not automatically a general Dutch permission. Ask which person, category, action and period the document refers to. This prevents a real document in the defense from acquiring more meaning than the authority that issued it attached to it. A limited exception may be relevant without resolving all remaining questions.

The actual situation must also be described precisely. Was the object in a box at home, was it visible on the street or was an action performed on someone with it? This description is not an invitation to organize a more favorable location after an incident. Keep the original data and write down what you saw yourself. A later photo of a neatly stored item does not prove how it was previously found. The lawyer benefits more from an honest timeline than from a reconstruction in which unfavorable details are eliminated.

Ownership and actual power are separate questions

In HR March 31, 2020, ECLI:NL:HR:2020:510, the Supreme Court discusses the availability of an airsoft weapon in a shared home. The judgment concerns, among other things, awareness and actual power, not just about who was the owner. It does not support automatic debt from everyone living in the same space. Therefore, ask which concrete data bear the relationship to the object. A product classification and a proven involvement of this suspect are two necessary but different parts of the analysis.

Note when you knew the object, what access there was and which personal actions are relevant according to the file. Knowledge of every technical detail is not automatically the same as knowledge of the presence. An argument that you did not know the exact type may therefore not answer the legal question. Conversely, proximity should not fill the entire knowledge and power relationship without substantiation. The gun ownership guide covers that general relationship in more detail; Here the specific classification of replica and alarm version remains central.

Fictional example: a set piece purchased online

In a fictional example, Elise buys an object that is offered online as a set piece. After a report, the police will take it away. Elise wants to prove that it is not a real firearm by making a video of how it works. However, in doing so she could change the original object or create an unsafe situation. The legal questions are also broader than real or fake: which category is assumed, what were its properties and what behavior is attributed to it? The sales text does not answer those questions independently.

The lawyer requests the inventory, photos and available expert findings. Elise keeps the original advertisement and payment with the date, without asking the seller for a more favorable subsequent description. Any errors in classification are specifically investigated. The example does not predict that the purchase was legal or criminal. It shows how the defense can do source work without technical demonstration. A safe and verifiable file helps more than a convincing video of which it is not later established whether it shows the same condition and the same object.

Expert questions without instructions

Make a question card for the lawyer about the object and the investigation. Indicate which question is factual and which requires a legal answer. An expert can determine properties, while the judge assesses the final qualification. A research question does not have to describe how someone can use or change the object. Rather, the card must ensure that missing information is obtained through the competent procedure, while maintaining security and the original condition.

  • Identity: which item number, which photos and which object are associated with the accusation?
  • Properties: which relevant characteristics have been established and which have not been investigated?
  • Condition: what is known about the moment of discovery and subsequent actions on the object?
  • Category: which legal provision is used and which characteristics are decisive?
  • Documents: packaging, marking, source of purchase and its limited meaning.
  • Involvement: own knowledge, access and concrete action regardless of the classification.
  • Addition: which specific question can really reduce the existing uncertainty?

Do not add your own technical conclusion because a term from a report sounds familiar. Ask what the term in this study means and how the expert came to this conclusion. A missing investigation may be relevant, but not every conceivable investigation is automatically necessary. The lawyer must be able to explain what the possible outcome can add to a decision question. This makes the request more substantive and prevents the defense from getting stuck in a long list of tests that do not touch on the actual accusation.

Behavior during an inspection can prevent new risks

The police advise distance and contact if in doubt about a possible fake weapon. Anyone involved in an inspection should not make a quick movement to show that it is fake or pull it out of the bag without instructions. The agent cannot have the same certainty about the object at that time. A later classification does not automatically make that direct observation situation simple. Have the actual course of the inspection assessed afterwards without using a dangerous demonstration on the spot as evidence.

Afterwards, make a note of what instructions were given, how the object was taken and what documents were received. Ask where the seizure is registered and whether relevant investigation information remains available. A complaint about the performance of an audit and the defense against the accusation may have different routes. Let the lawyer explain that connection. Nor is reclaiming or not reclaiming the item the same as terminating the criminal case. Clear administration keeps the various decisions accessible without having to organize new actions with the object.

A correct category is the start of the legal assessment

After the technical investigation, the conclusion must be compared with the other legal conditions and facts. The Criminal Code may be relevant to an alleged threat or other conduct, while the Code of Criminal Procedure regulates procedural rights. An indemnity for one type of possession does not automatically say what a proven use means in relation to another. Read any subsequent document for its own content and have the response option assessed in a timely manner.

Our editorial analysis is that fake is a description of an impression, not a complete legal position. Anyone who examines classification, action and personal involvement separately can provide a more precise defense and avoid unjustified certainty. This is especially important because an innocent demonstration can make the subject more dangerous. Save documents, have the object professionally assessed and ask specific questions. This way, the discussion can focus on what has actually been established and which rule applies to it, instead of about a sales name that promises more than it can legally bear.

Questions from litigants

Frequently asked questions

Is a fake gun allowed because it doesn't fire real bullets?

Not automatic. Appearance, technical version, category and action may be relevant. A toy name or foreign purchase is not a general exemption. Have the item actually found tested against the correct legal standard.

Does a CE mark prove that every situation is permitted?

No. The marking must be viewed with the specific article and applicable framework. The action and context also remain relevant. Using permitted toys is a different matter than threatening to use them or visibly taking them in a certain situation.

Do I have to demonstrate the operation myself to prove an error?

Don't do that on your own initiative. A demonstration can be dangerous and change the original state. Save existing documents and ask the lawyer for the technical findings and any targeted additional research.
