Insult or violence against police officers and emergency workers

An incident with a police officer, boa or care provider can quickly be described as aggression against the public task. However, for the criminal case, the concrete conduct, role and legal conditions must be examined separately. Since October 1, 2026, a new Public Prosecution Service policy applies to certain forms of physical violence. That policy determines the starting point for the claim and is not an automatic judicial conviction.

Start with the fact that is really being blamed

An official report can contain several qualifications. Ask what behavior is associated with each accusation and when it occurred. An exclamation, push, attempt to get away and later threat are not automatically one legal act. The Criminal Code has separate provisions with different conditions. A general statement that someone was aggressive can provide context but does not replace the actual description. Therefore, put concrete words and movements on a timeline before a legal position is determined.

Also check whether different people have observed the same thing. An officer can sense a movement without having heard all the preceding words, while a bystander saw the conversation but not the physical moment. That doesn't mean one statement is worthless. It makes the scope of each source visible. A good defense discusses exactly where agreement, difference or unfamiliarity exists. It does not have to declare the entire action right or wrong at once in order to specifically investigate a specific allegation.

Public task and civil servant are not the same legal concepts everywhere

The job context is relevant for certain statutory aggravating or special provisions. In the event of insulting a civil servant, Articles 266 and 267 of the Criminal Code may come into play; other provisions and aggravating circumstances may be relevant for abuse. Have the concrete capacity and the relationship with the performance of the task tested. A uniform, employer or job title is not the complete answer to every legal question. The precise legal category must be compared with the facts, including any requirement of lawful performance of duties.

The Public Prosecution Service policy for the public task uses its own broad description of officials. This does not automatically make every professional mentioned therein a civil servant for all criminal provisions. Keep the policy target group and legal components separate. Ask what role the person fulfilled at the time of the incident and why that role is relevant to this specific accusation. Work-related behavior outside normal working hours may also require attention, depending on the basis and context. A discussion about function must therefore be concrete and cannot be based on the mere presence of a service vehicle.

Insult requires precise wording and circumstances

Record which words are attributed to you, who they were directed at, and who could hear them. A loose summary can give a different picture than the complete exchange. The question of whether words are offensive and whether the applicable legal conditions are met requires an assessment of content and context. Dissatisfaction with an inspection is not the same as every possible criminal accusation. At the same time, anger does not provide a general exemption for an expression that does fall under a criminal provision.

Save existing messages or recordings where this is lawful and state what cannot be heard on them. A later memory must remain recognizable as a memory. Do not coordinate statements with bystanders to make differences disappear. If desired, ask them to maintain their own observations and discuss through the lawyer whether a witness request is relevant. Our editorial analysis is that precise words are more important than a debate about who caused the most irritation. The legal question must be based on real expressions, with their full relevant environment.

A movement, pain and injury must be described correctly

If there is a suspicion of abuse or another form of violence, the actual action and consequences are important. A lack of visible injury does not automatically prove that no criminal offense is possible. Depending on the accusation, pain or an attempt may also be legally relevant. Conversely, an injury description does not automatically prove which person performed a certain action or with what intent. Therefore, keep movement, person connection, causality and legal qualification separately recognizable in the preparation.

For a report, ask what was observed yourself, what was later determined and what time elapsed between the incident and the investigation. An image fragment can show a movement without making any force or intention visible. Medical data can support consequences without reconstructing the entire event. This requires an appropriate combination of sources. Do not make your own medical judgment based on a photo and have any expert questions formulated specifically. The meaning of the specific accusation must be explained, instead of deducing the complete outcome from one favorable or unfavorable fact.

A complaint about police behavior and defense in the criminal case has its own routes

Anyone who believes that a check or arrest went incorrectly can discuss this with the lawyer. The conduct may be relevant to the factual or legal assessment, but a complaint about it is not automatically a legal remedy against the criminal accusation. Nor does dissatisfaction confer its own general authority to use violence. Describe the sequence: instruction, response, physical action and further outcome. Then determine which legal consequences or individual complaint options may follow from the concrete facts.

An appeal to defense against an attack or another question of justification has its own conditions. It is not enough just to say that you protected yourself; the situation and behavior must be carefully examined. Also mention circumstances that nuance your own initial image. A reliable timeline helps the lawyer assess possible defenses without adapting the factual material to a desired conclusion. The criminal procedure rules determine how requests and defenses in the case are handled. A pending complaint does not automatically suspend other deadlines or calls.

Since October 2026, a new principle applies to certain violent cases

The OM guideline 2026R005 came into effect on October 1, 2026. It contains criminal procedure principles for, among other things, open violence, assault and attempted serious assault against officials with a public task. The starting point is to summon and demand a prison sentence. The Public Prosecution Service news item about the introduction links the new approach to physical violence from that date. So also have the event date and applicability assessed; do not mindlessly use an old general rate as a current expectation. (OM Directive 2026R005 · OM news item about the introduction)

This is Public Prosecution Service policy on sentencing. The judge must independently assess the proven case, legal conditions and appropriate punishment. The directive does not automatically turn a single insult into physical violence and does not stipulate that every suspect will certainly receive a prison sentence. Special situations and the applicable juvenile or adult law also require your own assessment. The practical importance is that possible consequences become clear in a timely manner, so that evidence, personal circumstances and legal assistance can be carefully prepared. A policy change should not replace the actual test, but neither should it be missed during the preparation.

A busy emergency response situation with different sources

Fictional example: an altercation occurs during an ambulance deployment. Ruben is suspected of insult and a push. A short video only starts after the first contact has taken place. A care provider describes the push, while a bystander mainly heard the preceding words. The preparation creates separate rules for the expression, movement and functional context. The date of the incident is also compared to the current policy. None of this data is treated as proven based solely on the general word aggression.

Ruben discusses his own memory independently and saves the original video with available context. The lawyer investigates which other images or statements may be relevant and, where necessary, requests preservation or investigation in a timely manner. The fictional example does not predict an acquittal or punishment. It shows why a later excerpt can be both useful and limiting. The gap about the beginning of the incident needs to be pointed out rather than filled with a confident reconstruction. Your own complaint and the criminal defense also remain separately recognizable.

A timeline with roles, resources and legal questions

Create a line with a limited time indication for each relevant action. Give an estimated moment as an estimate and do not use false precision when the clock has not been checked. Link each part to the available source. The map must show what is visible, audible, explained or still unknown. This makes a targeted request for additional research possible. A long general description of the atmosphere can provide context, but does not replace the necessary information about the individual allegations.

  • Moment: place, sequence and reliable time or recognizable estimate.
  • Role: person, position and actual task at that time.
  • Behavior: exact words or movement without a direct legal final label.
  • Source: own memory, official report, image, sound or separate witness.
  • Limitation: missing start, line of sight, sound quality or uncertain person link.
  • Question: Which legal element, defense or consequence requires further investigation?
  • Continued: securing, requesting, discussing, term and person responsible.

Add the original origin and any editing to each image file. A cutout may remain recognizable as a cutout. Where possible, retain the entire lawfully available file and share it via an appropriate secure route. Do not post private information of care providers or bystanders online to gather public support. That does not help the evidence check and can raise new problems. The card serves the professional assessment of the concrete incident, not a public judgment about the people involved before the facts and legal conditions have been carefully examined.

Timely retention of evidence and appropriate support can make a difference

Camera images and other registrations are not always available indefinitely. Therefore, discuss in a timely manner which specific request may be necessary to retain or investigate relevant information. Do not assume without a source that a bodycam recording exists or that it shows every action. Ask what is registered and what parts are available. A document about deployment or task may also be relevant to the context. The lawyer can connect the question to the specific accusation and choose the appropriate procedural route.

In addition, consider personal circumstances that can influence communication and understanding, such as language problems or care needs. Discuss this factually and with appropriate documents where necessary. A problem does not automatically explain every behavior, but it should not remain invisible because only the incident label is used. Ask for necessary support in a timely manner during an interrogation or hearing. The goal is for information to be understood and explained reliably. Later recovery from a misunderstanding becomes more difficult when an essential communication problem was not previously identified or investigated.

Read the final decision by fact and consequence

After the assessment, the results may differ per accusation. A conviction for one offense does not automatically prove every other accusation arising from the same event. Therefore, read which conduct has been proven, which qualification has been used and which punishment or measure will follow. Compare the decision with the Public Prosecution Service's demand without equating the two. Have any legal remedies and implementation consequences assessed in a timely manner. A verbally withheld principal amount or sentence duration may not tell everything about the decision and any additional components.

Our analysis is that careful preparation is essential, especially for incidents with a public task. The social importance of safe assistance and investigation is great, while every suspect has the right to a concrete test of facts and legal conditions. Organize words, movements, function and evidence separately and include current policy where it actually applies. This allows the case to be assessed substantively without a general picture of aggression replacing the evidentiary questions or a new guideline being wrongly read as an automatic judicial outcome.

Questions from litigants

Frequently asked questions

Does the new guideline always lead to insulting a police officer in prison?

No. The aforementioned guideline concerns certain forms of physical violence and contains principles for the Public Prosecution Service requirement. Insult has its own conditions and the judge assesses the case and sentence independently.

Is abuse not possible without visible injury?

That conclusion does not automatically follow. The concrete conduct, pain, consequences and applicable accusation must be assessed. Moreover, an injury question is something different from the question of who performed the act and with what intent.

Does my criminal case stop if I complain about police action?

Not automatic. A complaint and criminal defense have their own routes. Discuss the connection with the lawyer and monitor calls, requests and deadlines in the criminal case separately.

This article provides general information. The rules and options depend on your situation. Discuss your case and possible deadlines with a lawyer.
