Legal assistance & costs

Legal expenses insurance and a criminal allegation

Legal expenses insurance can provide legal assistance, but not every criminal accusation is covered by every policy. The insured event, exclusions and conditions for reimbursement must be read. Free choice of lawyer and actual coverage are also different questions. Anyone who needs a lawyer quickly must therefore organize both the procedural step and the financing, without inferring from the insurer's silence that all costs will be paid.

Start with the insurance that applied at the relevant time

A product name such as legal assistance does not say enough about the coverage. Modules, insured persons, work or private use and the date of the event can make a difference. Ask for the policy and conditions that actually apply, including changes. A current sales page is not necessarily the version the business falls under. Insurance through an employer or association may also have a different scope than a private policy.

Our analysis starts with a coverage map: who is insured, what problem is reported, when did it arise and which provision is relevant? This prevents a rejection based on one word from being accepted without reading the concrete basis. It also avoids the converse error of considering every legal expense insured. A criminal case, labor dispute and driving license procedure can be related without automatically falling under exactly the same module or cost scheme. Have the parts named separately.

The accusation is not the same as the proven guilt

Policies may contain conditions regarding intentional actions, criminal offenses or compensation after a certain outcome. The precise text needs to be assessed. An accusation is not automatically a definitive finding of proof, but that does not mean that every policy must immediately provide full coverage. Some arrangements may require a different phase or outcome as a condition. Ask which specific provision the insurer applies and on what facts that application is based.

Avoid general promises that an acquittal always results in all costs or that a suspicion of intent precludes any claim. Both can be too broad. Collect the call, global accusation and decisions already available. Provide relevant information through a secure channel and discuss with the lawyer how confidential file data will be shared. The insurer needs information for the coverage request, but not every request needs to include the entire criminal file without delimitation. The rights and obligations must be applied to the specific question.

Report in a timely manner and ask what information is missing

Insurance has reporting and information obligations within insurance law of Book 7 of the Dutch Civil Code. Do not wait until after the final judgment to ask for the first time whether the case was insured. Report the event in a timely manner, save the file number and ask which documents are required for a decision. The precise consequence of a late notification depends on the law, conditions and circumstances; a late report was not assessed with one general sentence. (insurance law of Book 7 of the Dutch Civil Code)

Make the urgency concrete. If a hearing, hearing or legal remedy period has been fixed, clearly state that date. Ask for a written response and a contact person. An automatic confirmation of receipt is not permission to incur unlimited external costs. Conversely, a coverage discussion cannot make the process deadline disappear. The lawyer and client must therefore make a temporary working arrangement stating which necessary step will be carried out and how the costs will be handled while the insurance decision is still pending.

Separate the free choice of lawyer and coverage

The Financial Supervision Act, including Article 4:67, regulates the choice of a legal assistance provider in the situations referred to for legal expenses insurance. The concrete application requires an assessment of procedure and circumstances. A right to choice does not mean that the insurance suddenly covers every subject. Nor does it simply mean that every external rate and every amount of work must be reimbursed without limitation. Coverage and reasonable financial terms remain separate questions. (Financial Supervision Act, including Article 4:67)

When appealing to free choice, ask which time and which procedure are relevant and how the costs are confirmed in advance. Do not just explain any limitations verbally. An insurer can specify a specific budget or approval requirement; its legal tenability must be assessed in the concrete context. The practical lesson is that client, lawyer and insurer must discuss the same assignment. A preference for a lawyer and an agreement on payment are two decisions that do not tacitly coincide.

An assignment must be understandable even without insurance security

The lawyer can perform work for which the insurer will later not reimburse. Therefore, determine in advance who the client is, what rate applies and which activities fall under a possible budget. The professional rules for lawyers provide context for clear agreements and information. A lawyer who says he will send the declaration to the insurer has not automatically confirmed that you owe nothing if it is rejected. (professional rules for lawyers)

Complete the assignment in phases: necessary first process step, file analysis and further treatment. Ask how exceeding a budget is discussed and who must give permission. A fixed price can only be clear if the scope is defined. Experts, travel costs or a separate procedure may not be included. A coverage decision must be in line with the same scope. This way, a financing question is not only discovered at the end when the defense has already been conducted and a large, disputed bill arises.

Criminal case, work and CBR may require different coverage

One traffic incident can affect criminal law, driving license and work. An incident at work can trigger dismissal proceedings in addition to the criminal case. It is useful to register these legal components separately and have them assessed. A rejection for one route does not automatically mean that every other route is uninsured. Conversely, an agreement for a labor dispute is not automatically an agreement for the entire criminal case or an administrative procedure.

Make an overview of procedures, deadlines and requested assistance. Ask for each part which policy basis and cost scheme applies. Align advisors without unnecessarily spreading confidential information between all parties. If different coverage decisions seem to contradict each other, ask for a joint written explanation of the demarcation. The financial organization must be able to monitor the factual coherence, while maintaining legal differences. This prevents duplication of work as well as an uncovered part that everyone thought the other had taken care of.

A coverage dispute requires its own route

If rejected, ask for the precise determination, the facts applied and the available complaints procedure. A substantive disagreement about coverage is not the same as dissatisfaction with the quality of legal assistance. The AFM describes complaints about financial companies and refers to internal handling and possible follow-up routes. Which external complaint or judicial route is available depends on the connection, conditions and the specific issue. (AFM describes complaints about financial companies)

Keep track of deadlines for that procedure as well. A complaint does not automatically suspend a criminal deadline or payment obligation. Record what outcome you are requesting: coverage, permission, reimbursement or better justification. General anger about the insurance provides less support than a targeted comparison between policy and rejection. Keep all relevant versions and decisions. If there is a major financial interest, have it legally assessed whether a complaint or procedure is appropriate, without leaving the defense unattended in the meantime.

Subsidized legal aid is a separate framework

If insurance coverage is lacking, it can be investigated whether subsidized or designated legal assistance is possible. The Legal Aid Act has its own conditions and the specific criminal law situation can make a difference. Having insurance does not automatically mean that any grant of subsidized legal aid is impossible; actual coverage and applicable rules should be reviewed. Conversely, a rejection by the insurer is no guarantee of a subsidy. Have the lawyer assess this specifically. (Legal Aid Act)

Avoid double declarations or unclear financing. Ask which part is paid by which scheme and which out-of-pocket costs remain. In the case of an ongoing request for coverage, it must be clear whether an application for subsidized legal assistance is now necessary and what information is associated with it. The in-depth pro-deo conditions discusses the general framework. The aim is that access to necessary legal assistance is organized in a timely manner and is not only investigated after a deadline has been missed or a private assignment has unintentionally become too broad.

Fictional example: interrogation tomorrow, cover still undecided

A fictitious insured person receives an invitation for an interrogation at short notice. The insurer is requesting additional documents and has not yet made a decision. The client thinks that the lawyer can only do something after coverage has been established. As a result, preparation is in danger of being lost. The right solution is not automatically having unlimited work carried out, but a deliberate, limited urgent assignment with clear financial agreements and a parallel urgent request for coverage.

The lawyer discusses which first steps are necessary, which legal assistance arrangement is possible and which costs can remain with the client. The insurer will receive the specific date and requested decision. The example shows that process protection and financing must be organized side by side. A confirmation of receipt is not a blank check, but a lack of response is also no reason to leave an important process step undiscussed. The client must understand the choice and the remaining financial risk before the assignment grows further.

A coverage map for client, lawyer and insurer

Make the card compact and save underlying policy documents. Include the written source and exact scope with each permission. The map is not a statement of coverage and does not replace professional judgment on a disputed determination. It does help ensure that a quick practical choice and a later financial assessment concern the same matter, with a view to deadlines and possible alternative financing.

  • Policy: insured person, relevant period, conditions and applicable module.
  • Case: accusation, event date, procedures and urgent trial moments.
  • Coverage: written decision, provision used and missing information.
  • Choice: legal advisor, applicable free choice and confirmed consent.
  • Costs: assignment, rate, budget, exclusions and responsibility in case of rejection.
  • Concurrence: other procedures, granting of subsidized legal aid or designated assistance and clear demarcation.
  • Follow-up: internal complaint, external route where appropriate and responsible time monitoring.
