A modified e-bike or fatbike in a criminal case
The name fatbike says little about the legal category of a specific vehicle. A bicycle may look the same, while motor assistance, power or a throttle lead to a different assessment. After an inspection, it is therefore not only the reported speed that is important, but also what exactly has been investigated and what use is being blamed. Our analysis: first build a verifiable vehicle map, and separate technical classification, actual driving and the sanction document received. This article is about preparing for legal help, not about adjusting to avoid an audit.

Start with technical properties, not with the product name
According to the government's explanation of electric bicycles, a normal electric bicycle has pedal assistance up to a maximum of 25 kilometers per hour and an electric motor of a maximum of 250 watts. A vehicle with different characteristics may require a different admission category. A throttle that provides support above 6 kilometers per hour without pedaling is an important example. The bicycle sticker or the message from a seller does not decide the legal question. Have it determined which properties have been investigated for the specific vehicle and which category is derived from this. (explanation from the government about electric bicycles)
That distinction is important because the following questions depend on it. What permission is required, what usage rules apply and what document may be missing? A speed pedelec is not simply an ordinary bicycle that happens to be ridden fast. Conversely, a sporty appearance does not prove an illegal technical change. Write down the make, model and identification number, but keep the legal category as a separate point to be assessed. This way, an initial conversation is not driven by marketing language or a general assumption that all vehicles with wide tires have the same legal regime.
The condition during the inspection requires your own determination
A vehicle may have been modified, repaired or set up differently than when purchased. Note what is actually known about this, with available invoices and original correspondence. Do not describe an unknown modification history as definitely factory original. The reverse assumption is also incorrect: not every deviating feature has necessarily been introduced by the current user. For legal assessment, purchase, possession, technical condition and actual use may raise various questions. Keep these events on a timeline and let the lawyer determine which of them are decisive for the specific accusation.
Do not change the situation after a check to make an earlier situation invisible afterwards. This actually makes a reliable assessment more difficult and can cause new problems. If repair seems necessary, first ask how the existing condition and relevant data should be preserved. Also keep a received ban, warning or agreement about further investigation. A vehicle card should be a verifiable description of what was found and recorded, not an ideal image of how the vehicle should have functioned according to an advertisement.
A dynamometer test is not the same as an observed road speed
The police explanation about roller test benches distinguishes inspections of mopeds and scooters from research into the loss of support for electric bicycles. Therefore, read which investigation is included in the official report. A number displayed on a chassis dynamometer is not, without further context, the same statement as someone riding at that speed along a certain cycle path. Record test method, vehicle identification, conditions recorded, and author's conclusion. A lawyer can then assess whether the data used actually supports the stated technical characteristic.
Do not use a photo of a display as a complete test report. Which unit is shown, who operated the vehicle and what correction or next step is recorded? The answer can be in the file and does not have to be apparent from a separate image. Ask for the original report and any attachments, instead of carrying out a similar test on public roads yourself. This article does not provide setting codes, measurement circumvention or technical limit tests. The relevant legal work is to understand what the official audit shows and what uncertainties remain about it.
Separate vehicle authorization from driver behavior
A file may concern a vehicle that is not permitted on public roads, specific traffic behavior or several accusations at the same time. Read per fact which action, which person and which place are mentioned. The technical capabilities of the vehicle do not automatically prove every stated driving behavior. An observed traffic action, in turn, does not automatically determine all technical characteristics. The Road Traffic Act forms an important part of the framework, but the specific document must make clear which provision and behavior are subject to assessment.
Also note the difference between user and owner. A parent who purchased a vehicle, a young person who drove it, and a friend who previously borrowed it do not necessarily have the same legal standing. That does not mean that an owner always remains out of the picture. This means that involvement and possible blame must be investigated per person. Explain the actual relationships without passing responsibilities onto someone else with a made-up agreement. Use existing purchase data, loan notices or statements only for what they can actually show.
A warning, fine and penalty order require different actions
See exactly what you received. A warning may acquire meaning later, but is not the same as a court ruling. A seizure notice is not a final decision that a vehicle will be destroyed. A payment document may have a specific sanction route with its own dispute option. Write down the letter code, agency, date and remedy information without guessing which procedure applies based on the amount. If necessary, have the entire document reviewed before paying, waiving, or filing a response that has a different outcome than you expect.
Do not use an old news report to determine the current amount or the only available penalty. The police page about new test benches dates from 2024; historical amounts have deliberately not been included here as current rates. The date of the fact and the applicable regulations count. This choice of source prevents a useful technical explanation from unintentionally functioning as a current price list. An editorial article can explain the route, but the concrete sanction document and applicable law remain necessary for an assessment of your case.
A vehicle taken with you is not automatically permanently lost
When a vehicle is taken, ask for written information about basis, registration and further handling. Keep the identification number and proof of ownership if available. The general guide to legal attachment of goods or assets discusses the criminal route in more detail. Do not issue a waiver without understanding the consequences. The difference between temporary investigation, keeping the vehicle and a later decision about the vehicle is practically large. Have a lawyer assess which route suits the specific measure and which term or next step is relevant.
An earlier warning may play a role in a file, but do not adopt a general, fixed formula for attachment from a separate summary. Ask what policies and legal authority were applied in your case and how previous events were recorded. A repeat entry is information that must be able to be linked to the correct person, the correct vehicle and the correct previous action where this is necessary for the assessment. Any lack of clarity about this does not automatically mean that a refund will follow; it does make it clear which information needs to be checked further.
Role and support are extra important for a minor
If the driver is a minor, have his or her age and legal status determined early. A technical traffic citation may be accompanied by questions about interrogation, legal assistance and the involvement of parents or guardians. The guide to a minor suspect provides the broader context. A parent can help secure documents and organize appointments, but should not compose a statement for the child. Record who observed something themselves and who heard the story later. This protects both careful handling and the reliability of available information.
Discuss separately what the family should practically do with the vehicle while its status is uncertain. Continued daily use because the school is far away will not resolve a potential admission or safety issue. Arrange a different route and have it assessed under what conditions use can be lawful again. A purchasing conflict with the seller is also its own issue. Keep the advertisement and invoice for this purpose, but do not confuse a possibly incorrect sales story with automatic cancellation of a traffic law accusation against the user.
An announced obligation to wear a helmet is not yet an introduced obligation
The current official information distinguishes normal electric bicycles from vehicles that fall under a different regime. In addition, the government announced an approach for fat bikes on April 24, 2026, with further elaboration of age rules and local options, among other things. Such announcements require separate verification of legislation and entry into force. In the source check of October 19, 2026, the general government explanation for regular electric bicycles does not yet mention a general minimum age or helmet requirement; an announced plan may therefore not be presented as an already applicable obligation. (April 24, 2026 an approach for fat bikes)
This does not affect existing rules for other vehicle categories and safe behaviour. For a concrete file, it must first be clear to which category the vehicle belongs. The question then follows which regulation applied on the date of the offense. Our analysis: never put current rules and policy plans in the same checklist without status. An intention may be useful to discuss future purchase or use, but cannot replace a missing legal basis for a past accusation. Also save the publication date of a source you use for this purpose.
Fictional example: same name, three different questions
In a fictional case, Noor's father buys a vehicle that the seller calls a regular fat bike. During a check it is recorded that the support does not stop at the expected point. Noor has also received a document about use on public roads. She thinks that a receipt is sufficient to resolve the matter. The receipt can support the purchase and the sales description, but does not independently determine how the vehicle technically worked or what rules applied to its actual use. The three questions must be examined separately.
The family keeps the advertisement, the receipt, the inspection report and the information about the vehicle taken. It has the situation assessed without presenting its own road test or subsequent change as proof of the old situation. The lawyer then investigates the vehicle category, the test recorded and the accusation against Noor. A possible issue with the seller will have its own file. The example does not predict an acquittal or compensation. It makes it clear that a disappointing purchase, a technical classification and a criminal or other sanction route touch each other without being the same legal question.
Make technical data and process steps readable together
A good vehicle map prevents individual screenshots from determining the entire discussion. Write down what you know, what it shows and what is still unknown. Save the source documents and have a technical conclusion assessed by someone with appropriate expertise. Also use the overview to keep track of new correspondence. The practical value lies in a traceable link between vehicle, inspection and document, so that legal assistance can specifically investigate which part is decisive and which action is now required. Adding more files does not automatically make an unclear identification reliable.

Frequently asked questions
Is iedere fatbike juridisch een bromfiets?
No. This concerns the concrete technical properties and applicable admission category. A trade name or broad ties are not decisive. Have the recorded properties and the legal classification assessed separately.
Does a dynamometer number prove that I was driving that fast on the street?
Not without further context. A test can examine a technical characteristic, while a complaint about road speed requires different data. Read the full report, the method and the specific accusation together with a lawyer.
Do announced age rules or mandatory helmet use apply immediately?
An announcement is not a regulation that has come into effect. Check vehicle category, date of occurrence and current official legal status. Rules for a moped or speed pedelec may be different from those for a regular electric bicycle.
