Negligent handling of stolen goods or money laundering?
An item appears to have come from a crime and the police ask questions about the buyer, recipient or user. This can lead to suspicion of fencing, money laundering or other involvement. The words are similar, but the legal questions do not fully coincide. Our analysis: start with the specific accusation and the time at which the person concerned knew or should reasonably have suspected something. A low price, unclear administration or later warning only becomes meaningful within that combination of object, conduct and form of debt. This comparison helps organize a file without automatically treating every unfavorable purchase detail as evidence of the same criminality.

Don't start with the label from the first conversation
Ask which fact and variant is being investigated. The police explain fencing as the criminal handling of goods of criminal origin, often in the context of second-hand items. The legal provisions in the Criminal Code are more precise than a brief description of the public. Healing is not just a question about a stolen bicycle and money laundering is not just a question about a large bank transfer. Check the legal basis in the documents before preparing a response to the incorrect qualification. (police explain fencing as a criminal offense dealing with goods of criminal origin · Criminal Code)
Then make a simple rule: which object, which action, which period and which person? The words possess or receive can summarize various factual situations in everyday conversation. A suspect who only says that he did not steal may not answer the charge of subsequent receipt or association. At the same time, the police may not conclude solely from the presence of an asset that all legal conditions have been met. The comparison therefore starts with demarcation, not with an assumption that a criminal origin gives everyone involved the same position.
Origin must correspond to the examined object
In the case of fencing, the legal analysis concerns, among other things, property obtained through crime. Money laundering provisions refer to objects that originate directly or indirectly from any crime, with property and property rights within the legal concept. That difference can be relevant when value is converted or moves through different steps. A document that indicates the provenance of one asset does not automatically prove the provenance of all assets in the same space. Always ask which object the evidentiary reasoning concerns and where the link is established.
A registration number, serial number or bank transaction can support identification. Check whether the source actually belongs to the object found. A general advertisement or similar article is not the same as evidence about this purchase. In the case of money or property rights, it may be necessary to distinguish between different incomes and conversions. Don't create a total that counts the same value multiple times. An overview that shows the limits of identification is more helpful than a categorical statement that every object must come from the same unclear source.
Acquiring, holding, transferring and concealing differences
The fencing provisions and money laundering provisions contain different behaviors and combinations of conditions. An accusation of debt settlement during acquisition requires different factual attention than a suspicion of concealment of a rightful claimant. The pursuit of profit can also be a separate part of a certain healing variant. Ask the lawyer to translate the alleged act into plain language and list the relevant events below. Without that translation, a defense can talk at length about the purchase price, while the accusation mainly concerns a later transfer.
In the case of money laundering, a complicated concealment scheme does not have to be proven in every variant. The law also recognizes other actions, such as acquiring, possessing, transferring or converting, in combination with the required criminal origin and form of debt. Conversely, not every technical move is without further proof of the chosen variant. Identify which component is supported by which facts. This prevents both the misconception that only secret constructions can lead to money laundering and the assumption that every unusual payment is automatically sufficient.
Put knowledge on a timeline instead of in one conclusion
Actual knowledge and reasonable suspicion are not the same form of guilt. The relevant time also depends on the legal variant. When healing is acquired or obtained, the situation at that moment is particularly important. A later warning does not automatically rewrite the science of the earlier acquisition. This does not mean that every subsequent act falls outside criminal law. A new transfer, use or other conduct may raise its own legal question that the lawyer must assess separately.
Therefore, make a note of what was known before the transaction, what was seen during the transaction, and what information only came afterward. Substantiate with existing messages, documents and own observations. Don't say afterwards that you had already checked everything if you only investigated after the police contact. A factual correction can be important, but a favorable story that combines different moments becomes difficult to verify. The key is not choosing the right verb, but honestly showing which information was available for which choice.
An eye-catching prize is a clue with context
An exceptionally low price may raise questions, but its meaning depends on condition, market, seller, method of sale and other circumstances. A defect or rapid termination of business can explain a lower price without removing all risk. A receipt can exist and yet not be authentic or substantively complete. Therefore, have several pieces of data assessed side by side. A criminal conclusion should not rest solely on the feeling that a deal seemed too good, but a suspect should also not dismiss such a concrete signal with the general word bargain.
The police refer to checking stolen registrations as a practical tool. A check and its date may be relevant, but a missing registration is no general guarantee of lawful origin. Not every crime or property is registered correctly straight away. Save the details of a real audit when you have performed it and include any limitations. Don't present a later searched result as if it was viewed before the purchase. In this way, a useful source remains a verifiable fact and does not become an after-the-fact safeguard.
Substantiating is different from assuming the burden of proof
In certain money laundering cases, a statement regarding legal origin may be required based on the facts presented. In HR 18 December 2018, ECLI:NL:HR:2018:2352, the Supreme Court explains that this is not a general reversal of the burden of proof. The Public Prosecution Service must substantiate the relevant suspicion and a sufficiently concrete explanation may require further investigation. This case involved cash payments for a boat. The ruling does not mean that every buyer without complete administration is guilty of money laundering. (HR December 18, 2018, ECLI:NL:HR:2018:2352)
A practical preparation brings together the economic source, transaction and available starting points. Consider a seller, account, contract or previous sale, with the period to which the data relates. Tell the lawyer what documents are missing and what can still be checked. Do not come up with a cash loan or donation because otherwise a gap will look unfavorable. An explanation may be limited, uncertain or incomplete; that limitation deserves discussion. An invented provenance does not reduce the original evidentiary problems and may raise new criminal law questions.
Fictional example: purchase and later resale
In a fictional example, Lina buys a used camera. She has messages with the seller, proof of payment and an address, but no original purchase invoice. Later she receives a specific message that the camera may have come from a burglary. The question of her knowledge at the time of purchase is not automatically the same question as the meaning of a later attempt to resell the camera. Each phase must be factually determined and tested against the correct determination. The mere possession of one receipt does not provide a universal answer.
Lina will keep the original communication and seek legal assistance before moving or transferring the property. The lawyer investigates identification, origin and the precise accusation. The example deliberately does not mention a fixed outcome: the content and reliability of the warning, the previous circumstances and subsequent actions may differ. The comparison above all shows that a timeline is necessary. A judgment about one moment may not unknowingly influence all subsequent behavior, nor does new information automatically change what was acquired earlier.
Compare qualifications to the same factual source
Create a matrix for the lawyer with columns for possible fencing, possible money laundering variant and the actual source. Only enter legal conclusions after explanation. The matrix must make differences visible without having to design the indictment yourself. The route to court documents helps to obtain the actual accusation and investigation data. An internet definition can provide orientation, but does not have the same function as the text on which your case is assessed. (route to procedural documents)
- Object: which concrete good or asset and which identification?
- Origin: which indication of crime and which legal explanation is verifiable?
- Action: acquisition, acquisition, retention, transfer, use, conversion or concealment.
- Form of guilt: knowing or reasonably having to suspect according to the accused variant.
- Time: When must the relevant knowledge or suspicion have existed?
- Special feature: profit motive, own prior crime or other qualifying question for the lawyer.
- Source and gap: existing document, own observation and targeted additional research.
Do not compare individual maximum sentences as if this determines the correct qualification. The legal variant and facts must first be clear. In addition, special money laundering questions may arise in the case of value from your own crime; a simple statement that a perpetrator can never heal or launder himself does not sufficiently explain all the different provisions. Have this connection legally assessed and prevent a complicated exception from being used as general permission for a subsequent action.
Seizure, ownership and criminality are different tracks
The property can be taken while the criminal assessment is still ongoing. The question of whether you are punishable is not the same as the question of who is the civil law owner or to whom an asset must be returned. An innocent buyer does not automatically have the right to keep the item in every situation. Conversely, the decision not to return the property does not independently indicate that debt recovery has been proven. Have the various decisions examined with their own basis and response options.
Keep a seizure certificate and ask what information is available about the object. Do not contact a potential original owner to pressure a declaration or declaration. A practical solution may require legal coordination, especially when several parties involved have conflicting interests. A refund by the seller does not automatically end a criminal investigation. Use existing sources for the defense and conduct investigation or contact through a careful route, so that resolving damages does not raise new evidentiary problems or harassment issues.
Choose precision over blanket denial
Discuss with the lawyer what you have already stated, which information is certain and which parts were only examined later. The rights under the Code of Criminal Procedure remain relevant, even if the case is presented as a simple question of where the good came from. A good explanation does not have to contain certainty everywhere. Above all, she should not adopt a plausible assumption as her own observation. Leave missing details until they can be responsibly checked.
Our analysis is that fencing and money laundering do not explain each other by simply calling one a small and the other a large form of the same thing. They require a precise comparison of legal act, object, origin and form of debt. A reliable timeline and origin matrix help make those differences visible. The guide to a stolen bicycle provides practical information for the purchase of a specific second-hand object. This is about the legal comparison that prevents a defense from testing the right facts against the wrong standard.
Frequently asked questions
Is fencing only punishable if I was certain that something had been stolen?
No. There are different variants, including debt healing. Have it investigated whether and when you should reasonably have suspected that the property had been obtained through crime. A striking purchase detail requires context and is not automatically a complete evidentiary argument.
Can the same transaction raise questions about money laundering?
That is possible, but the specific legal variant and facts must be assessed. Money laundering is not limited to a banking structure and fencing is not limited to one product type. Have the act, origin, form of debt and time explained separately.
Can I quickly resell a suspect item to get rid of it?
Don't do that as a solution to legal uncertainty. A later transfer can take on its own legal meaning. Keep existing documents and discuss with a lawyer and, if necessary, the competent authority how to act safely and lawfully.
