Financial loss and help after online fraud

After online scams, several questions are often confused: can payment still be stopped, how do you report it and who can ultimately compensate the damage? Each route has its own purpose and its own need for proof. Our analysis: Start by limiting further loss and then record the transactions and deception in an auditable manner. This prevents an extensive chat history from hiding the most important payment information or from a declaration being wrongly seen as a refund guarantee. This guide is aimed at victims who are seeking legal and practical help and want to prepare their next step in a controllable manner.

Limit new losses before developing the whole story

If payment details or access to a banking environment may have been misused, please contact the bank immediately via the well-known app or independently searched for official contact details. The police also recommend calling the bank immediately after telephone scams. Explain what actually happened and follow the bank's verification and security steps. Do not use a telephone number or link that the suspected scammer has sent himself. You do not have to first organize all the evidence files to report a possible ongoing risk. (police also advise calling the bank immediately after telephone scams)

Note the time of your report, the account involved and what the bank has confirmed. A request to investigate a payment is different from a confirmation that funds have been secured. Ask what follow-up is expected and what documents are needed. Do not share login codes with anyone who promises to solve the problem on behalf of a research team. If a payment service or recovery expert is contacted again after the initial fraud, check that request independently. A new offer to get money back against an advance can actually increase the loss.

A missed appointment does not always constitute criminal fraud

The police distinguishes different forms of fraud, with different reporting routes. A misleading payment page, a fake investment and an undelivered second-hand product are not necessarily the same thing. Therefore, describe what was suggested, why you relied on it, and what action you took next. A dispute about the quality or delivery of a product can also be a civil question. The fact that you have suffered damage does not in itself determine that all conditions for criminal fraud have been met.

Don't make the problem bigger or simpler than the existing data shows. A seller who does not respond after payment raises different questions than a demonstrably counterfeit banking environment. Save the advertisement, commitments and payment instructions so that someone can assess the relationship between deception and payment. Leave unknown identity recognizably unknown. A displayed name or profile photo does not prove that the person in the photo is the sender. This distinction prevents the victim from unintentionally publicly accusing an innocent account holder or someone with stolen personal data.

Create a transaction statement with amounts that can be found

Record each payment separately with date, amount, payment method, description and available account or transaction information. Add a reference to the original bank statement or payment overview. Place a refunded amount in a separate line so that the net loss does not become unclear. With multiple payments, the order is also important: which message preceded it and why was another payment made? For foreign currencies, use both the original value and a clearly stated settlement, without invisibly converting it to a favorable damage amount.

A transaction shows a movement of money and not automatically the full identity or role of the recipient. An account may have been used by someone else; a platform name may differ from the account name. Note those differences instead of fixing them with your own assumption. Ask what information the bank or police can investigate themselves. Your own overview does not have to become an investigation report. It must be sufficiently precise to distinguish actual payments from suspicions about the people or organizations behind an account.

Preserve the context around the decision to pay

A loose screenshot of a threatening message or low price cannot sufficiently show what happened before and after. Where possible, keep the original messages and exports with date, account name, page address and relevant attachments. Create a short reading guide with the decisive moments. Do not change original files to make them clearer; use a separately marked copy if necessary. A counselor should be able to go back to the raw source and see where your explanation begins.

Also pay attention to information that may disappear later, such as an advertisement or a message in a temporary account. Save what you can lawfully record and discuss with the police or bank how to deliver it safely. Do not try to enter other people's accounts yourself or obtain data through deception. This can cause new damage and legal questions. The practical benefit lies in carefully preserving what you have already received, not in conducting your own research that makes the origin and reliability of evidence unclear.

Choose the appropriate route and keep additions to the same case

For purchase and sales fraud, the police describes the online declaration and how to supplement it. If new relevant information appears after the declaration, that page advises supplementing the existing declaration instead of filing a new declaration about the same thing. Save the declaration number and the confirmation of receipt. A started form is not the same as a submitted declaration. If you have any doubts about the form of fraud, ask the police which route is appropriate, so that sensitive documents are not sent to an unsuitable reporting point. (police the online declaration and its completion)

A good declaration distinguishes between what you have observed, what is stated in received communication and what you suspect. You do not have to qualify the case perfectly legally before reporting the facts. Please also include refunds or later delivery when they occur. Don't make a change a reason to hide previous history. An up-to-date file helps assess what remains and prevents the bank, police and legal aid provider from working with different damage amounts or incomplete versions of the same event.

A bank investigation and criminal investigation have a different purpose

The bank assesses payments and possible measures within its own task and conditions. The police investigate criminal offences. These processes may require information from each other, but a report to one agency does not automatically mean that the other has all relevant documents. For each route, ask what has been received, what question is being addressed and what follow-up you need to do yourself. Write down a rejection or request for addition literally in your overview, with the date and the explanation given.

The police also explain a limited route for requesting bank details. This has conditions, including the type of fraud, Dutch account details and declaration. That is not a general claim to all personal data of every suspected perpetrator. Have us assess whether your situation falls within the route and what purpose the next step serves. Do not publish obtained data as a punishment or warning. Information that can be used for a civil assessment does not give license for threats, public address distribution or private collection at the door.

A demonstrable loss does not constitute an automatic allocation

Anyone who wants to recover damages must be able to explain what amount was caused by which event and which route is available. A claim in a criminal case presupposes appropriate criminal proceedings and its own conditions. A civil procedure has a different framework, with costs, other party and feasibility as important questions. The police's victim rights information points to possible assistance. Discuss not only whether a claim is conceivable, but also which party can be held liable and which documents are actually required for this. (victim rights information from the police)

Our analysis: add a security column to the damage overview. An amount paid with bank receipt is a different type of item than estimated future loss of income or general compensation for anger and time. The latter may require a separate legal basis and further substantiation. In addition, state what has already been reimbursed by the bank, platform, insurer or other party. A transparent overview prevents double counting and makes visible what remainder is still requested. A high total claim is not automatically stronger than a modest but demonstrable damage item.

Fictional example: two payments and a second deception

In a fictional case, Emma pays for a used camera. She then receives a message that an additional amount is needed to release the package. After both payments the advertisement will disappear. A week later, someone offers to get the money back for an advance. Emma's initial overview only includes the total loss and the seller's profile name. It is therefore not yet clear which message belonged to which payment and whether the later contact is part of the same fraud or is a new approach.

Emma then reveals three separate events: the purchase payment, the alleged package cost, and the new recall offer. She keeps the messages and does not pay a new advance on the basis of an unverified promise. Her bank report and declaration receive the same transaction overview, while retaining their own contact numbers. The example does not predict compensation. It shows that a structured reconstruction can both help limit further damage and support a later legal assessment. In particular, the relationship between communication, trust and payment becomes more testable.

One file prevents conflicting amounts and separate actions

Maintain a short file index with files, notifications, and pending actions. Choose a safe place and share only what the recipient needs. A family app in which everyone sends bank statements and suspected address details does not make the overview more reliable. If necessary, appoint one contact person to help organize things, while you or your representative monitor the formal steps. The map below is an editorial tool; it is not a declaration form and does not replace a specific instruction from the bank, police or legal advisor.

  • Event: type of fraud, first contact, commitment and reason for payment.
  • Transaction: date, amount, recipient, payment method and original proof.
  • Communication: relevant messages, advertisements, page links and original files.
  • Restriction: unknown identity, missing information and unconfirmed suspicions.
  • Notifications: bank contact, declaration number, platform notification and responses received.
  • Damage: paid, received back, other items and remaining requested.
  • Follow-up: addition, person responsible, concrete term and intended legal route.

Ask for help for the next decision, not for a promise

Online scams can cause shame, uncertainty and practical unrest in addition to loss of money. Report this to a care provider if this makes organizing the steps difficult. You don't need to have a perfect file before asking for support. Please indicate what is urgent now: new access to an account, a response from the bank, a current payment term or a proposal that you must sign. This helps legal and practical help focus on the next decision without fueling an unrealistic recovery expectation.

Our conclusion: separate the first safety step, reconstruction and damage recovery, and connect them to the same auditable data. The criminal procedure can form part of the route, but is not automatically a collection service. A clear transaction record makes it possible to ask the right question to the right authority and keep track of new information. This creates a usable file, even when it is still uncertain who the responsible person is or how much of the loss can ultimately be recovered. (criminal proceedings)

Questions from litigants

Frequently asked questions

Do I have to wait for a criminal offense to be reported to the police before calling my bank?

In the event of possible payment or bank fraud, direct contact with your bank via a reliable channel is wise. Do not wait for a complete file. The bank notification and declaration are separate steps; note what is confirmed per route.

Will I automatically receive my money back after filing a declaration?

No. Declaration, bank assessment and claim recovery have their own conditions and purposes. A criminal investigation or registration does not prove that recovery is possible or that a bank must compensate. Have the appropriate route assessed.

What do I do if there are new messages after my declaration?

Keep them original and ask how to supplement the existing declaration. The police describe a supplementary route for purchase and sales fraud. Also keep track of refunds, new approaches, and changes in claim amounts.
