Online marketplace fraud: buyer, seller or suspect?

A buyer pays and receives nothing. A seller sends a package and sees no real payment. Or someone discovers that an advertisement has been placed under their name. These situations can all lead to a report, but do not require the same legal analysis. Anyone suspected of fraud via a sales platform therefore needs more than the reassurance that it was just a commercial dispute. Our analysis: examine the transaction from the first offer and record which representation led to which action. That is often the difference between a failed agreement and a criminal accusation.

A trade dispute starts with what has actually been agreed

Save the original advertisement, including description, price, photos, contact method and any conditions. Then record what the parties have subsequently agreed on: shipping or collection, payment in advance or payment afterwards, one product or multiple items. A later summary may differ from the offer on which someone based their decision. When a product is not delivered, it is tempting to immediately talk about guilt. However, it must first be clear what the transaction entailed and which action is considered misleading.

The police themselves make a distinction between feeling scammed and fraud in a legal sense. That distinction does not remove a buyer's disappointment or damage. It does prevent every contractual problem from being classified as criminal law without further substantiation. Therefore, put the payment or delivery problem and the possible deception in separate columns. This way, a lawyer can assess whether the file contains more than a failed appointment and which documents are actually relevant to this. (the police themselves make a distinction)

Fraud requires more than an unfavorable outcome

Article 326 of the Criminal Code mentions specific means of fraud, including a false name or title, devious tricks and a fabric of fabrications. In addition, the required connection must exist with the act to which someone was moved and the intention of unlawful advantage. This legal framework makes it clear why a loss of money does not automatically constitute complete evidence. Have the lawyer identify which means is being accused and what specific conduct this entails according to the accusation.

This approach also prevents reverse oversimplification. A transaction is not automatically exclusively civil because an agreement or invoice exists. An agreement can actually be part of the representation given to the buyer. Nor does a real bank account number rule out all forms of deception. The question is how the relevant data works together. A defense becomes more concrete if it identifies one disputed link than if it only labels the entire file as a trade dispute.

What the summary judgment on internet sales really shows

In ECLI:NL:HR:2016:2889, the Supreme Court emphasized that not every lie or civil shortcoming is fraud. However, in the specific case, several specific circumstances were established: telephones offered were not available, false names were used and incorrectly referred to stores where collection would be possible. The Supreme Court upheld the judgment on fraud. The judgment therefore links the definition of the offense to a concrete proven method, not to a general exemption for internet sellers.

Use this statement as a reason to look more closely at the meaning of pre-payment information. A store address can give a different impression than a random username. An announcement about available stock may play a different role than a later apology. Which information created the trust and which of them were incorrect according to the file? The practical value of the judgment lies in those questions. It is not helpful to cut just one favorable sentence from the general part away from the facts on which the outcome was based.

Distinguish one transaction from a profession or habit

In addition to fraud, Article 326e of the Criminal Code provides for a separate criminal offense for certain forms of online commercial fraud in which a profession or habit is made of selling or offering services for the specified purpose without complete delivery. That provision was still described as a bill in the 2016 judgment. Anyone who reads old case law should recognize that time difference. The absence of a specific means of defrauding does not automatically answer every possible suspicion under another applicable criminal provision.

Therefore, create a transaction list if more buyers or advertisements are mentioned. State per row what was offered, what payment followed, what was delivered and what concrete communication exists. A total number of complaints in itself says little about the exact similarities and differences. Nor is a list of only successful transactions a complete response to specific allegations. Do not discard unfavorable data, but make visible which events would together form a pattern and where the comparison may be flawed.

An account holder and an advertiser can have different roles

A bank account, telephone number or account is often the start of an investigation into a person. Carefully examine which connection has actually been made. Who had access, who placed the ad, who made calls, and who received or moved money? The fact that an account is in a name makes that information relevant. It is not yet the same as a complete reconstruction of all actions in a possible collaboration. Avoid both automatic exoneration and automatic attribution of every message.

Write down a possible misuse of data as specifically as possible. When was access lost, what warnings were received and what actions were taken? Keep that information separate from any statement prepared later. A general statement that anyone could use the account remains difficult to investigate without period, people or data. Do not enter other people's accounts yourself to look for evidence. Describe to the lawyer what sources exist, so that any additional research can be requested through the appropriate route.

A shipping receipt answers a limited question

A receipt or parcel code can show that a shipment has been tendered, but does not automatically tell everything about the contents, destination or agreed delivery method. Therefore, compare the shipping time, weight, address and correspondence with the specific transaction. Also explain deviations that seem unfavorable at first glance. A change of address after payment or a shared package code can gain significance in the file. It is better to recognize that information early than to only discover during an interrogation that one's own summary was incomplete.

For a buyer, comparable precision applies to payment information. An image of a transfer is different from an actual amount credited. Save what has been received and what the bank records show, with the corresponding date. Do not make another trial payment or repeat a suspicious procedure to prove how it worked. An auditable overview of existing data is safer and more useful. The ultimate meaning depends on the entire factual context and the allegation being investigated.

Fictitious example: delay, false inventory and a borrowed account

In a fictional example, Lotte sells a second-hand camera that she actually owns. Due to a hospital stay, she sends later and responds poorly to messages. In a second transaction, another person offers cameras that don't exist and points them to a made-up pickup location. In a third situation, a student receives money into his account for someone who says he does not have a bank account. In all three cases, a buyer may receive nothing, but the relevant research questions are clearly different.

At Lotte, ownership, preparation for shipment and communication about the delay are important. The second situation focuses on the misrepresentation and the link to the payment. The student's own agreements, knowledge and financial transactions must be examined, possibly also under other criminal provisions. None of these examples decide a real case. They show why not receiving the joint outcome is insufficient to equalize the legal analysis. Make the facts specific before choosing a generic label.

Refund is not an exchange for an explanation

Anyone who can resolve a dispute would be wise to discuss the practical and legal consequences. A real refund can reduce the outstanding damages. It does not automatically mean that a report disappears, that the Public Prosecution Service no longer conducts an investigation or that previous actions are no longer assessed. Please clearly record any payment in your administration and keep the proof. Do not make agreements whereby someone only gets money back if he or she changes a statement or waives rights under pressure.

Also have the description of a payment carefully assessed. An unorganized message like I pay everything so drop the case can be read in multiple ways and is usually of little help. An attorney can discuss how to record actual recovery without an improper admission or an unsustainable promise. In addition, do not negotiate with a complainant through threatening or repeated private messages. When contact causes tension, a business route via a representative is often more suitable than another round of discussion in the same chat.

Connect each accusation to the original data

Don't create a folder containing only material that gives a favorable impression. The value lies in being able to control the entire transaction. Include a brief table of contents at the beginning and indicate what information is missing. The explanation about the criminal file helps with broader preparation. Your own administration and the criminal file are different collections: let the lawyer determine which addition is necessary and how the data can be used carefully in the procedure.

  • Offer: original advertisement, date, product, price and stated availability.
  • Contact: full relevant conversation, channel, contact details and any changes.
  • Payment: real bank statement, amount, time of receipt and further money movements.
  • Delivery: agreements, proof of shipment, destination and verifiable correspondence about deviations.
  • User: Who had access to account, number or account in the relevant period?
  • Pattern: individual transactions with differences, deliveries, complaints and possible refunds.
  • Question: which fraud or other criminal provision is specifically cited and which fact requires investigation?

A good file explains the development of trust

Our analysis arrives at a practical main question: how did someone come to pay or deliver, and what role did the suspect play in this? That is more informative than just counting how much money is missing or how angry the communication has become. It also protects the quality of the conversation with a lawyer. A reconstruction in which offer, trust, payment and execution are distinguished makes the legal assessment more targeted. It can make essential deception visible, but can also expose where there are only assumptions about intentions.

Use the broader guide to fraud for concurrent allegations and the explanation of police questioning when a call is received. Keep in mind the difference between repairing damage and answering a criminal charge. Both can deserve attention without being the same problem. The purpose of the preparation is a verifiable explanation of the real events. A good-sounding story that does not connect to the original messages and transactions will actually undermine that goal. Questions from litigants

Frequently asked questions

Is non-delivery after payment always a scam?

No. The specific behavior must be tested against the applicable criminal provision. In the case of fraud, the means of fraud used and the connection with the other person's act are important factors. Other criminal provisions may also be relevant.

Does the criminal case disappear if I pay back the money?

Not by itself. Reimbursement can reduce damage and provide relevant context, but does not automatically decide whether to report, prosecute or provide evidence. Discuss recovery and criminal defense separately with an attorney.

My account was used, but I did not place an ad. What now?

Save the appointments, bank details and information about access to the account. Have your own financial dealings and science examined. Not posting an advertisement does not answer every possible suspicion, but neither does the account name prove all the actions of others.

This article provides general information. The rules and options depend on your situation. Discuss your case and possible deadlines with a lawyer.
