Documenting personal circumstances for a criminal hearing

I work hard, my family needs me and I started getting help. These are understandable messages, but often too general for a session. The judge must be able to see which facts are actually established, how current they are and what they mean for the decision. Our analysis: the best preparation is not an impressive pile of recommendation letters, but an overview in which a relevant circumstance is linked to a reliable piece and a concrete conclusion. That also helps to guard boundaries. A criminal case does not require unlimited disclosure of every private information of the suspect and his family.

The judge also deals with the person behind the file

The information from Rechtspraak about the criminal proceedings describes that the judge deals with personal circumstances. This gives room for relevant facts about the suspect's life, in addition to the assessment of the accusation. It does not mean that work, children or treatment automatically lead to a certain punishment. The seriousness of the facts and other legal factors remain important. A preparation must therefore make clear what a specific circumstance adds, without suggesting a general right to a reduced sentence.

Start with the decision at hand. Data may be relevant for sentencing, the enforceability of conditions or another separate question. The same letter does not have to be sufficient for every purpose. An employer can confirm that someone is working, but does not decide whether a particular punishment is appropriate. A practitioner can describe progress, but does not have to provide legal disclaimers. Our analysis is that pieces become stronger when their own expert or factual reach remains recognizable. This makes the contribution more verifiable and prevents exaggerated expectations.

An earlier situation may have changed in the meantime

There can be a lot of time between the event, interrogation and hearing. An address from the first official report may be outdated, training may have been completed and treatment may have just begun. Create a short development timeline with major changes and their associated pieces. This makes it clear what was going on on the date of the crime and what the situation is now. Both may be relevant, but should not be merged unnoticed. A current improvement does not prove how someone acted before, while an old diagnosis does not necessarily reflect current limitations.

For each document, note when it was drawn up and which period it describes. A letter from a year ago may still be useful for a situation at that time, but may require additional information before the hearing. Ask the lawyer which information needs to be updated and which older documents remain sufficient. Also report changes if they are unfavorable, for example if a work contract has been terminated or a program has been stopped. Concealing this can make a plan appear feasible on paper, while the necessary basis is now lacking.

An employer's statement must be factually usable

A work statement can describe what position someone has, since when, how many hours and under what practical conditions the work takes place. It may also be relevant to an implementation question whether adapted work, a schedule change or temporary leave is actually possible. Only let the employer confirm what he knows and can promise. A general statement that the employee is indispensable provides little insight into what happens in the event of a specific disability. A brief explanation of tasks, alternatives and their limits is often easier to assess.

Don't exaggerate the consequences. If replacement is possible, it is not necessary to say that the entire company will close immediately. If a contract is temporary, do not make it a permanent position. Relevance does not have to come from exceptionally dramatic consequences. Ordinary job stability can also have factual meaning, if described correctly. Give the lawyer the documents and let him determine what argument follows from them. This way, responsibility for the content remains with the actual source and a desired legal outcome is prevented from driving the employer's statement.

Describe the need and the actual division of tasks

Care tasks require precision. Who is cared for, what actions does the suspect perform and how often? Are other caregivers available, is there professional support and what agreements apply? A general reference to children or a vulnerable parent does not explain what a decision means on a daily basis. Explain the real division of labor with as little unnecessary personal data as possible. Where a specific care need must be confirmed, a specific statement may be more useful than the complete file of a child or family member who is not a party to the criminal case.

Also make visible the difference between emotional meaning and practical dependence. A loved one can be an important support without being the only available caregiver. That does not detract from the relationship, but it does change the actual argument. Don't look for an explanation that artificially omits other help. Discuss what shelter or support is possible and where real gaps exist. The judge can only make a realistic assessment when the limitations of his own story are clear. A careful care overview therefore protects both reliability and the loved ones involved.

A registration is not yet an ongoing process

Seeking help may be relevant, but different phases must be distinguished. Registration, intake, waiting list, treatment start and treatment actually completed are not synonyms. Request factual confirmation of status, attendance and any appropriate progress. It is not necessary for a practitioner to promise on behalf of the judge that recurrence is excluded. Such certainty often cannot be given. Let the content remain within the scope of expertise and discuss with the lawyer what information is required for the specific decision, especially when medical data is sensitive.

Also describe the feasibility of a proposed condition. A process that is based solely on uncertain financing requires a different explanation than a confirmed treatment location with a start date. Mention relapse or interruption honestly and explain what response actually followed. An imperfect but real process can provide more guidance than an error-free story that does not correspond to documents. Our analysis is that the demand for improvement mainly becomes concrete when behavior, support and follow-up agreements are visible. Only the desire to act differently from now on provides less basis for this.

A probation report has its own assignment

The probation service explains how it prepares advice, including on the basis of conversations, available data and relevant information from the environment. The advice can address the personal situation, risks and appropriate interventions. It is not an automatic plea for the suspect's desired outcome. Read the factual data carefully and discuss any inaccuracies with the rapporteur and lawyer. Distinguish between a verifiable error and a professional assessment with which you disagree. Those questions may require a different response. (probation explains how it prepares advice)

A custom folder can supplement a report, but does not automatically replace the research needed for a specific decision. Ask in a timely manner whether additional advice is desirable and who can make a request for it. Do not wait until the hearing day when important questions about treatment or supervision are still unanswered. At the same time, not every positive fact of life needs to have a separate expert. The preparation must remain proportionate: use simple confirmations where simple facts are substantiated and targeted expertise where an assessment is really needed that the suspect or lawyer cannot provide themselves.

Determine in advance which information will be included in the criminal file

Giving a document to the lawyer is not the same as deciding that it should be added completely to the case file. Discuss which passage is relevant, whether a more limited explanation can be obtained and the consequences of submission. Do not assume that sensitive information remains private and beyond public knowledge due to the label. The applicable procedural rules and method of treatment must be assessed. This requires particular attention to data of minors, medical information and descriptions of others who are not themselves the suspect.

Targeted restriction should not turn into deception. Tacitly omitting an unfavorable but directly relevant passage from a document can give a distorted picture. Rather, ask for a new statement of fact that independently answers the necessary question and provide the attorney with the original document for context. Save original versions and mark changes. In this way, privacy and reliability can be monitored together. The goal is not to collect a maximum amount of intimate information, but to provide sufficient verifiable material for the decision that the judge must make, with recognizable limits to what the source actually says.

Fictional example: three strong attachments instead of twenty letters

In a fictional example, Lotte collects twenty expressions of support for her hearing. Most say she is a good person. At the same time, there is no evidence of her new job and it is unclear whether an announced treatment has already started. The lawyer therefore requests a current work confirmation, specific confirmation of the treatment status and a brief care overview with the actual division of tasks. General support is not prohibited, but the most important factual questions are given priority. This makes the preparation clearer and uncertain commitments can be recognized earlier.

Upon inspection it appears that the first treatment appointment only takes place after the hearing. This is stated honestly, together with what has already been done. The fictional example makes no prediction about the punishment. It shows that quality does not equal size. Three reliable documents can provide more clarity than a large folder in which no one can find the decisive facts. The legal argumentation then remains a separate step: what meaning do those facts have, how do they relate to the seriousness of the accusation and what decision is substantiated by them?

Seven fields for a useful attachment

Make an overview of a maximum of a few pages and refer to numbered appendices. Don't add every document automatically: decide with the lawyer what will actually be submitted and when. Note for each fact which question is still open and who can answer it. The card also helps in preparing for questions at the hearing. A suspect can then explain briefly and clearly what the current situation is and where a document supports that description, without having to improvise amounts, dates or commitments from memory.

  • Fact: Which current personal circumstance should be described and for what period?
  • Relevance: which concrete decision or implementation question can be affected by that fact?
  • Source: who can confirm the fact and within what own knowledge or expertise?
  • Attachment: document date, intended period, original version and appropriate limited submission.
  • Feasibility: which facilities have been confirmed and which remain intake, waiting list or expectation?
  • Privacy: which data from suspects and third parties are necessary for this specific point?
  • Action: missing addition, person responsible, delivery date and check for changes before the hearing.

A reliable view of life is stronger than an ideal story

Our conclusion is that personal circumstances become especially useful through the connection between fact, document and meaning. A judge can do more with a current and verifiable situation than with general promises about character or the future. This requires honesty about limitations and changes, without the suspect having to reveal his entire private life in an unfocused manner. The preparation must also leave room for the legal debate about the accusation. Facts about work, care or treatment can also be collected for a conditionally conducted criminal defense when the substance of the accusation is disputed.

Read the explanation about the summons for general hearing preparation and about the penalty for responding to the Public Prosecution Service's argumentation. Provide documents in a timely manner so that the lawyer can assess their meaning and method of submission. Just before the hearing, check whether relevant facts are still up to date. This means that the circumstances map remains a tool for actual consideration, instead of a collection of hopeful explanations whose practical basis only comes into question during the treatment. Frequently asked questions

Does a job or family automatically lead to a lower sentence?

No. Personal circumstances may be relevant, but are assessed in addition to the facts, seriousness and other factors. Substantiate the concrete meaning without assuming a right to a specific discount. The lawyer can explain which argument the available data supports.

Does my complete medical file have to be sent to the court?

That is not automatically necessary. Discuss what targeted information can answer the relevant question and what the consequences of submission are. Leave medical conclusions with competent experts and do not share third-party data without necessity or appropriate coordination.

Can I mention treatment if only an intake is planned?

Yes, provided you describe that status correctly. A planned intake is not a started treatment and not a confirmed completion. Mention the appointment, any waiting list and what has actually happened. A realistic plan is easier to assess than an overly firm commitment.
