Refusing a breath or blood examination
An investigation can fail because someone is unwilling to cooperate, does not understand an instruction or is medically unable to comply. These situations should not be equated without investigation. At the same time, refusal is not an easy way to make a suspicion of driving under the influence disappear. It can result in an independent criminal accusation. A careful assessment starts with the concrete investigation phase, the authority and what was actually requested and done.

What exactly was the investigation required?
In everyday language, everything is called blowing or a drug test, but the legal investigation route makes a distinction. A preliminary check may require a breath analysis or blood test. Permission, an order and execution also have their own meaning. The Road Traffic Act contains the powers and obligations. Anyone who does not determine the phase may apply the wrong rule to what actually happened. Therefore, read the official report for the successive actions. (Road Traffic Act)
Our analysis uses a research card with the time, officer, instruction and response for each step. This prevents an initial hesitation from automatically being summarized as a refusal of any subsequent investigation. It also avoids the converse error whereby compliance with one preliminary test means that any subsequent refusal remains without consequences. The precise penalty provision must be in line with the specific act. A lawyer can check the order and legal conditions against the documents, without relying solely on the word refusal in the header of the report.
Right to remain silent is not a general refusal to investigate
As a suspect you have rights regarding explanations and legal assistance. It does not follow that every legal obligation to cooperate in traffic checks lapses. A statement about use and an obligation to investigate are different actions. The Public Prosecution Service's explanation about alcohol testing describes the transition to further investigation and a possible warrant. The concrete authority and conditions must be assessed; a general internet phrase about never having to do anything is insufficient and can be harmful. (OM explanation of alcohol control)
Ask what exactly is required of you and report misunderstandings. Do not physically resist and do not try to cause the investigation to fail. A problem with legality should be assessed by the lawyer and, if necessary, argued. The fact that you disagree with a suspicion does not automatically give permission to ignore a valid order. At the same time, an order does not make every procedural question redundant. The defense can later investigate whether the required basis and implementation were actually present.
No valid result does not yet tell us why
A breath analysis cannot provide any useful result. The cause can be technical, medical, communication or behavioral. An assessment of refusal therefore requires more than the end result. What were the instructions, how much was attempted, what observations were recorded and what explanation did the person involved give? The rules for research and the implementing regulations help establish the applicable framework. Not every error automatically has the same legal consequences. (rules for research · implementation regulations)
Make a factual description without diagnosing the technology itself. If you don't understand the device, mention that. If you tried but couldn't comply, describe what happened and who saw it. A retrospectively constructed explanation without connection to the events is less helpful than a direct report. The lawyer can investigate whether an alternative investigation route was appropriate and what documents exist about this. An unusable result is the beginning of the question, not the end of the legal assessment.
An obstacle must be reported in a timely and specific manner
A medical reason may be important for the possibility of carrying out a certain examination. When checking alcohol, the Public Prosecution Service describes that blood tests may be required if there is a plausible medical impediment to blowing. That is not a general exemption from every investigation. A problem with blood collection must also be assessed by the competent professional and within the legal framework. Provide necessary information immediately and request that it be recorded.
A doctor's note or relevant medical confirmation may be required, but the legal meaning depends on the situation. A diagnosis alone does not always prove that a concrete action was impossible. Conversely, a visible problem cannot be treated as unwillingness without further assessment. Share health data in a targeted and secure manner. The attorney can later compare the timeline, notifications, and professional judgment. This article does not provide a customized medical exception; it emphasizes that a real obstacle must be carefully examined without using it as one's own permission for total refusal.
A refusal of consent and further order
For blood testing, the procedure may include a request for consent and then an authorized order. The meaning of an answer therefore partly depends on what happens next and which legal conditions apply. An initial no does not automatically mean the complete process history. Nor can anyone assume that voluntariness excludes any subsequent obligation. The official OM explanation makes the importance of these steps visible. The lawyer tests the specific variant. (official OM explanation)
Ask which officer acted and what words or instructions were recorded. An official report can describe an order without the suspect understanding it in the same way. That difference requires actual research, including into language and explanation. It does not automatically invalidate an obligation, but it may be relevant for the legal assessment. Avoid making statements afterwards about what was never said if you don't remember the moment clearly. An accurate, fair reconstruction is the basis for an appropriate defense.
Understanding instructions is a concrete guarantee
A driver may understand everyday language but have difficulty with a technical instruction or legal consequence. Report this immediately and request appropriate explanation. It's not just about nationality, but about what was really understood at the time. The criminal law guarantees and the specific traffic framework must be assessed together. A practical demonstration, interpreter or other explanation can have different meaning in a concrete situation; have it recorded what was offered and what happened. (criminal proceedings guarantees)
It is important for the defense which instruction remained unclear and how you responded to it. A general complaint that everything was in a foreign language may fall short when other pieces show clear communication. Conversely, a signature or short answer should not be accepted as a complete concept without context. The lawyer can ask specific questions about the preparation of the report. The goal is not to use a language problem as a standard defense, but to reliably examine actual understanding and the ability to cooperate.
No measurement value does not automatically mean no case
Refusal or conscious obstruction of an investigation can constitute a separate traffic offence. The Public Prosecution Service's explanation about alcohol, drugs and medicines points to this. The lack of a definitive concentration does not automatically make prosecution for such an accusation impossible. That distinction is essential: the evidentiary route for a measured exceedance is not the same as that for a legal refusal to investigate. The applicable conditions must be determined per allegation. (OM explanation about alcohol, drugs and medicines)
Therefore, ask whether the Public Prosecution Service accuses you of driving under the influence, refusal or several facts. A blood limit defense does not automatically answer the question of why a validly ordered examination was not performed. Conversely, a research problem does not automatically prove every stated form of substance use. An accurate file keeps the facts and legal variants apart. Do not rely on the idea that no outcome is more favorable. The possible consequences of refusal can be significant and must be specifically explained in the document received.
The driving license status can also change immediately
A suspicion of refusal may have consequences for the confiscation of the driving license and other driving license questions. The police, the Public Prosecution Service, the judge and the CBR have different roles. A solution to the criminal evidence discussion does not automatically mean that a separate decision lapses. Keep all documents with the date of receipt and have the routes viewed together. A refund letter is not the same act as a legal remedy against a CBR decision.
Concretely realize work and care interests that are relevant to a request, without using them as your own exception to a ban. Ask in writing what the current driving authority is before planning a new trip. An unclear physical return of the document is not a complete status check. The in-depth information about research and driver's license rights provides more context. The practical aim remains that the various consequences are dealt with in a timely manner and on their own legal basis. (examination and driver's license rights)
Fictional example: try, but do not understand the instruction
A fictitious driver tries to blow and does not get a valid result. He reports that he does not understand the instruction, after which a later report states that he did not want to cooperate. The defense must not only dispute the final conclusion, but reconstruct the actual instructions, attempts, notifications and any subsequent steps. It must also be examined whether a medical or other explanation existed and when it was made known.
The lawyer requests relevant documentation and compares it with his own memory and any other sources. The example does not guarantee an acquittal and does not make every failed test a communication problem. It shows that no result and punishable refusal are different questions. The final assessment must be based on concrete facts and the correct framework. An honest distinction between what you know, what you thought and what remains unknown provides more guidance than a completely ironed out story afterwards.
A research card per step and reaction
Complete the card as quickly as possible with reliable information. She does not give permission to refuse research or medical advice. The intention is that legal assistance can assess the jurisdiction, actual implementation and a possible obstacle. Keep original documents and indicate uncertainties. A timeline prevents different studies and responses from being summarized in one unclear label.
- Phase: preliminary test, breath analysis, blood test and exact accused refusal.
- Basis: request or order, authorized official and known legal basis.
- Instruction: content, language, explanation and what you actually understood.
- Execution: attempts, observations, technical outcome and next steps.
- Obstacle: medical or other concrete reason, immediate reporting and professional assessment.
- Consequences: criminal document, confiscation of driver's license, CBR and individual terms.
- Follow-up: lawyer, relevant documentation and specific questions without changing material.
Frequently asked questions
Can I refuse an investigation because, as a suspect, I have the right to remain silent?
The right to remain silent and legal research obligations are different things. Have the specific authority assessed and do not assume a general exemption.
Is a failed breath analysis always a punishable refusal?
No. The cause, instructions, actual cooperation and applicable conditions must be investigated.
Is a medical reason enough to refuse any examination?
Not by itself. Report the obstacle immediately and request appropriate professional assessment; another research route may be appropriate.
