An unidentified driver: the registered keeper and the criminal case
A car is registered in your name, but on the said day several people drove it. Then comes a letter from the police, Public Prosecution Service or CJIB. The idea that you only have to say that you were not driving may be too simple. The idea that the license plate holder always receives the punishment is also incorrect. Our analysis: start with the legal basis and your role. An administrative traffic sanction, a penalty order for an infringement and a demand to name the driver have different rules and require a different response.

First know in what capacity you are being approached
Read at the top and bottom of the letter who the sender is, what fact is mentioned and what is expected of you. Are you being approached as a license plate holder, as a suspected driver or as an owner who must provide information? A form can request information about the vehicle without establishing all aspects of a criminal case. A summons or criminal order has a different function than an initial request for information. The role chosen influences the rights, obligations and available response.
Therefore, do not just write down the fine amount. Save the reference, the legal provision, the requested response date and the explanation. The CJIB explanation of different types of fines can help recognize which document has been received. A letter with the letter M belongs to a different system than a criminal order. Use the letter as a starting point for classification, not as a reason to immediately send a random objection letter. A correct substantive response can still cause difficulties through the wrong procedure. (CJIB -explanation of different types of fines)
An administrative traffic sanction has its own license plate rules
Article 5 of the Administrative Law Enforcement Traffic Regulations Act contains a regulation for imposing on the license plate holder if the driver has not been immediately identified. This is an administrative traffic system and not a general rule of evidence for every traffic crime. The law also contains specific exceptions that must be applied to the specific situation. Simply saying that a family member was driving does not automatically make a sanction based on license plate incorrect within this system.
The practical consequence is that the question of who actually drove sometimes has a different legal meaning than the recipient expects. A holder may have lent the car and still remain the recipient of the sanction. The mutual agreement about who pays is then different from the question of whether the decision was imposed according to the law. Discuss legal exceptions with supporting documents when they seem relevant. A discussion within the family does not replace the official legal remedy route and does not automatically suspend the applicable period.
The basis must also be distinguished within the WVW
The Road Traffic Act contains a special provision in Article 181 for certain violations where the driver remains unknown upon discovery. The regulation and its exceptions must be distinguished from personal criminal liability for a traffic crime. For example, the mere fact that a license plate is in your name does not automatically prove that you were driving under the influence. But that does not mean that every criminal traffic notice to a holder can be ignored without further obligations.
So ask which offense is being prosecuted and why you are being addressed. Is it an offense for which the license plate scheme is applied, a separate ownership obligation or proof that you were actually a driver? These questions can make the same letter read very differently. Avoid a blanket appeal to innocence without examining the legal construction used. A lawyer can determine whether the charges and the file correspond to the correct person and legal route, and what information is needed to specifically contest this.
A question for the driver can be an own obligation
Article 165 WVW contains an obligation for the owner or holder to disclose the name and full address of the driver upon request, in the situation described there of a traffic offense by an unknown driver. The period to be set therein is at least forty-eight hours. Check whether you have actually received such a claim and which period and vehicle are mentioned. A formal claim should not be treated as a non-binding inquiry without assessment.
This does not solve every difficult situation. There may be questions about your own involvement, reliability of the memory or the actual possibility of identifying the driver. Have the relationship with your own procedural rights immediately legally assessed. The instruction to remain silent as a suspect cannot simply be attached as a standard answer to every legal obligation to provide information. Conversely, it is irresponsible to randomly appoint someone out of fear of consequences. The correct response requires an honest reconstruction of the facts and assessment of the concrete basis.
Investigate who had access and what you really know
Create a trip overview with date, time period, key use and concrete sources. Consider an agenda, work schedule, loan appointment or existing journey administration. Write down separately what you observed and what someone else said later. Proof of payment elsewhere can provide context, but does not prove who was driving the car in every situation. Let the conclusion match the evidentiary value of the piece. A memory that changes after much consultation must remain recognizable as such.
Approach other stakeholders to clarify information without jointly creating a conclusive story. Ask what they know independently and keep original messages. When ambiguity exists, an accurate description is better than a confident guess. Also communicate relevant facts to the lawyer if they do not seem favorable. An incorrect driver's statement can create a new problem out of the attempt to resolve an old traffic case. Care sometimes means that it must first be legally discussed what can be declared responsible on the basis of the available data.
A personal obligation may be independent of the director
Some traffic matters are primarily about the vehicle or its holder, for example certain inspection or insurance obligations. The RDW describes the register check and its legal background. Then the statement that you were not driving yourself may not be an answer to the alleged defect. Check whether it concerns on-road behavior or an obligation associated with owning or registering the vehicle. The factual description on the letter is important for this. (RDW describes the registry check)
Various administrations can coexist with a company car: license plate register, lease data, usage administration and a contract with an employee. An internal agreement that the driver pays all fines does not automatically change legal responsibility. Record which legal entity or person is being addressed and who is authorized to respond. A driver may have substantive information while the formal term lies with another recipient. A responsible company addresses these roles explicitly, so that the letter does not keep circulating between fleet management, manager and employee.
Check incorrect vehicle coupling aiming
When the location, vehicle characteristics or time do not fit at all, a reading error or license plate fraud can be an investigation question. The police provide information about license plate fraud. Compare concrete data such as make, model, color and available image with your own car. A general belief that you never drive there is less informative than a visible difference between two vehicles. Save relevant images and indicate what is visible on the original source and what remains only a suspicion.
A report or declaration may be necessary if there are actual indications of fraud. But such a report does not automatically annul a sanction or criminal order received. Respond separately using the appropriate procedure and attach the relevant evidence. In the event of a vehicle registration error, ask which agency can correct the source data. This way, two necessary steps remain visible: investigating the possible abuse and combating the specific letter in a timely manner. The hope that all systems will immediately accept the report is not reliable protection for a current period.
Fictional example: same car, three different letters
In a fictional example, two roommates share a car in the name of one of them. The first letter concerns an administrative traffic sanction on license plate. A second, separate letter formally asks for the driver if a traffic crime is suspected. A message about insurance registration will follow later. The owner always answers the same: I wasn't driving. As a result, it remains unclear whether he answers the legally relevant question in each document and whether the official deadlines are used.
Better preparation creates three files, each with a basis, addressee, information request and response route. The license plate scheme is examined for the first letter, the claim for the second and the vehicle obligation for the third. An existing work schedule can help with the reconstruction, but does not solve every file in the same way. The example does not promise any exemption. It shows why the director question only becomes meaningful when it is known which legal responsibility is invoked in the document in question.
A letter and role recognition that prevents errors
Create a short card on the first page. Do not write in advance that there is an objection, opposition or a witness statement if the document type has not yet been determined. Copy the terms and legal references used verbatim into the folder and formulate your own questions. This way, a lawyer can see more quickly which documents concern the same fact and which only mention the same vehicle. This also makes conflicting data and incorrectly linked case numbers more visible.
- Sender: police, Public Prosecution Service, CJIB, RDW or another agency.
- Document: information request, formal claim, decision or summons.
- Role: director, suspect, owner, holder or legal entity.
- Basis: mentioned law, article, fact code and period.
- Facts: vehicle data, trip information and independently known driver data.
- Response: correct procedure, requested information and deadline.
- Proof: original documents, dispatch and acknowledgment of receipt.
An appropriate response recognizes the differences between the procedures
If you disagree with a punishment order, the procedure for legal objection to the punishment order of the Public Prosecution Service must be examined. Different rules apply in the case of an administrative sanction. A formal information obligation may also require its own answer. Our conclusion is therefore that good advice starts with dividing the questions, not with a universal registration letter. The actual driver is important, but the meaning of his identity is determined by the legal regulations used and the specific accusation.
Take all the documents with you, even if you think one letter is just a memory. Indicate whether anyone else has already responded and what exactly was entered. Use the main sentencing guide for that decision and have the specific driver question assessed separately. The goal is a truthful, timely response that is appropriate to one's own role. This prevents an apparently simple traffic letter from developing into a file with contradictory statements and missed legal opportunities. (main guide to sentencing)
Frequently asked questions
As a license plate holder, am I always punishable if someone else was driving?
No, there is no general rule that automatically attributes every traffic crime to the license plate holder. There are specific license plate regulations and own owner obligations. Therefore, read which fact and legal basis are stated in the received letter.
Can I reject any director question using my right to remain silent?
Don't use that as a general answer without advice. A formal claim under Article 165 WVW may entail its own legal obligation. Have the basis and the relationship with your concrete process position assessed, especially if your own involvement is involved.
Can I name a family member if I don't remember?
Don't name a person at random. Reconstruct original trip information, distinguish between memory and information obtained later and have the correct response legally assessed. An incorrect statement can cause a new problem and does not make the file more reliable.
