Suspected of driving under the influence again

A second suspicion of driving under the influence often immediately raises the question of how much heavier the punishment will be. That question only makes sense when the previous history is precisely established. Previous inspection, conviction, sentencing and registration are different events. The driver's license status can also have several causes. Our analysis: first build a timeline of decisions and dates of crime and then investigate which regulation can attach which consequence to recurrence. This prevents two incidents from automatically leading to one incorrect conclusion or from missing an important previous settlement because the warning letter has not been kept.

The word again can hide different histories

Someone may have previously been checked without prosecution, received a criminal order or been irrevocably convicted. Those situations are not the same. Therefore, start with documents instead of a reminder that there was something going on with alcohol at the time. Write down the conduct, settlement and status for each previous case. The Public Prosecution Service's explanation of the recidivism scheme makes visible why the final settlement is important. An arrest can be the starting point of a case, but is not the same as an irrevocable criminal decision. (OM explanation about the recidivism regulation)

Also write down which questions are actually at hand. Is an increased penalty being discussed, has a registration notice been received or has CBR ordered an investigation? By keeping these parts separate, the lawyer can specifically determine which arrangement is relevant. A general prediction that the driver's license is always lost the second time, may miss conditions and exceptions. The opposite reassurance that only the new measurement counts can actually leave important previous decisions out of the picture. Both conclusions must be replaced by a complete history.

Previous facts may weigh differently than a legal registration

The new criminal case revolves around the specific accusation and the available evidence. Previous relevant settlements may have significance in the criminal question, but do not automatically determine that the new suspicion has been proven. Therefore, keep evidence about the current check recognizable next to information about the history. A lawyer can assess the content of the new case without ignoring the previous settlement. A complete file requires both: verification of the current investigation and a correct representation of what was previously definitively decided.

Distinguish between the legal description of an earlier fact and your own global summary. Driving under the influence of alcohol, drugs, combined use and refusal can affect various provisions and consequences. Also include the type of vehicle and driving position if relevant. A previous fine for something else in traffic is not automatically the same as a relevant previous settlement for driving under the influence. The precise qualification helps prevent incorrect history from being adopted as an aggravating principle.

The legal conditions require more than counting to two

In the recidivism scheme, the Public Prosecution Service describes, among other things, the importance of a new offense within five years after the previous irrevocable settlement and the applicable form of offence. For certain alcohol determinations, the Public Prosecution Service specifies a limit of more than 570 µg/l or 1.3 per mille for the second offense. Other conditions apply to other types of offenses mentioned. Do not take that overview as a simple personal calculation. Have the correct legal provisions, dates and information tested for your own case.

The practical preparation is a decision tree with source references. Which previous decision counts according to the Public Prosecution Service, when did it become irrevocable and which new behavior is now being assessed? If a measurement is relevant, note the unit and type of study. A blood alcohol level and breath value should not be confused without the correct context. A casual reminder that the value was approximately on the limit is insufficient. Request the original result and have a boundary question assessed precisely before assuming a consequence for validity.

Date of commission and irrevocability belong in separate columns

A common mistake is to use the date of the first inspection where the arrangement corresponds to the final settlement. Another mistake is to only write down the new sentencing date, while the new committal date can be decisive for the term question. Therefore, put at least the inspection or commission date, decision date and date of irrevocability on the history card for each case. Note the source for each date. A registered letter can indicate receipt, but does not automatically confirm every other legal date.

Have uncertainty flagged immediately. Where a previous legal remedy has been filed, this may affect when a decision became final. Do not gamble yourself because the matter happened a long time ago or the fine has now been paid. Request the documents and have the status of the process explained. A precise timeline can both reveal incorrect application and confirm that a previous decision is being rightly taken into account. The goal is a reliable history, not a calendar that has merely been reasoned back to a desired outcome.

A missing letter does not erase a previous settlement

The Public Prosecution Service will separately deal with the question of a missing warning letter. Therefore, do not use the absence of a letter without assessment as proof that no relevant registration exists. Find the previous decision and ask what data has been recorded. A procedural or administrative question about the provision of information is not automatically the same as the question of whether the legal conditions for a consequence are met. If necessary, have both aspects examined separately and formulate which document or answer is missing. (OM will separately deal with the question of a missing warning letter)

Save received correspondence completely, including date and reference. Make an overview of what has and has not been received without drawing a legal conclusion. For example, a client may have used an outdated address or misunderstood a letter. That requires factual research. It is stronger to describe the concrete information history than to say that no one told anything. The lawyer can then assess whether and how an incorrect information, missing message or disputed status should be raised via the correct route.

The administrative driver's license status is listed next to the criminal case

The CBR explanation about the relationship with the Public Prosecution Service makes it clear that criminal law and fitness to drive have different goals and decisions. A penalty can end while a CBR measure or invalidation still has consequences. Conversely, a course taken does not automatically provide an answer to criminal proceedings. Therefore, keep a separate status line for confiscation of the driving license by the police, withholding of the driving license by the Public Prosecution Service, denial, validity and CBR decisions. Having the physical ticket in your hands is not a complete confirmation that driving is allowed again. (CBR -explanation of the relationship with the Public Prosecution Service)

When a legal invalidation is involved, the RDW also describes information about regaining a valid driving license. Read the concrete route and requirements before planning work or transportation. Serving a previous sentence or paying a fine is not the same as fulfilling all the conditions for a new usable driver's license. At the meeting, confirm which obstacles still exist and which decision can change each part. This prevents a new traffic case from arising due to too limited an explanation of the existing status. (RDW information about getting a valid driver's license back)

Bill and applicable law must remain separate

The parliamentary file on improving the approach to driving under the influence describes a proposal that aims to replace the recidivism regulation with other measures. As of October 19, 2026, as checked during this elaboration, the proposal is still being considered by the House of Representatives. A message about intended abolition does not therefore mean that the new system applies to every current case. In addition, always check any entry into force and transitional rules when the law changes later.

For your own preparation, this is mainly a source check. Place the date of an explanation next to the date of the commission and applicable decision. An old document may accurately reflect the previous situation, but it may not be an up-to-date manual. A new explanation of a proposal can conversely describe future law. Ask which rule is actually applied and why. This is more informative than a discussion based on the title of a news item, especially when several procedures are ongoing while legislation is still being processed.

Fictitious example: two controls and three different dates

In a fictitious case, Bas was checked in 2022 and the punishment order later became final. In 2026 he is suspected again. He calculates from the first check and thinks that only the number of calendar years between incidents counts. His partner refers to a message about a proposal for abolition. In the meantime, there is also a CBR decision. None of those individual impressions provide a complete answer. The earlier definitive date, the new conduct and the administrative law status must first be compared.

A good history card collects both criminal files, the registration letters and the CBR decisions. The lawyer can then determine which conditions are really relevant. This fictional example does not predict invalidity or punishment. It shows how a simple term breaks down into multiple legal questions the second time around. Precisely because of this distinction, an incorrect assumption can be corrected in a timely manner and it is possible to practically plan what legal assistance, evidence and any driving license recovery steps are required. A general punishment prediction would not replace that preparation.

Seven parts for a reliable comparison

Use one line per case and one additional line per individual driving license decision. A complete overview does not have to be long, as long as each piece of information has a source. Have the lawyer check which previous facts count for which consequence. A document from one authority does not automatically explain the decision of the other. The map is therefore also an overview of open questions: which number, which date or which status still needs to be confirmed before a substantive conclusion is justified?

  • Current case: concrete suspicion, date of commission, vehicle, driving position and investigative documents.
  • Previous case: exact fact, legal provision, decisive authority and full settlement.
  • Final: date of irrevocability with source and any history of legal remedies.
  • Measurement: original outcome, unit, study type and the question of which limit is relevant.
  • Registration: received messages, characteristics and specific ambiguity about the data used.
  • Driving license: criminal decisions, CBR measures, validity and any recovery process separately.
  • Follow-up: appropriate legal assistance, next term and confirmation of what is or is not currently allowed.

Repetition deserves precision before talking about consequences

Our conclusion is that being suspected again requires an exact file. The past can have major consequences, but only if it is clear what that past legally entails and how the relevant regulations relate to it. The current suspicion must also be judged on its own evidence. A good history card prevents both overly quick reassurance and an incorrect automatic conclusion. It makes visible which questions about punishment, registration and driving license status still need to be resolved separately.

Use the guide on driving license recovery due to alcohol for the first driving license questions and have your own coincidence assessed in a timely manner. Avoid driving until full validity and authority are clear. Organize alternatives for work and care while the procedure is being investigated. This way, practical preparation does not remain dependent on an uncertain prediction. The useful next step is a verifiable history of the real decisions, so that legal assistance can specifically explain which consequence has which basis. (driving license suspension due to alcohol)

Questions from litigants

Frequently asked questions

Does a second arrest automatically mean that my driver's license is invalid?

Two arrests alone do not meet the legal requirements. Have the previous irrevocable settlement, new date of the offense, applicable provision and relevant measurement data assessed. CBR decisions can also have individual consequences.

Does the first inspection date count as the start of each recidivism period?

You cannot generally assume that. The relevant arrangement may be in line with the irrevocable settlement. Therefore, set the date of the commission, date of judgment and final date separately and have the applicable period checked.

Can I assume that the recidivism scheme will be abolished?

Not without checking the law, its entry into force and any transitional rules. The status of October 19, 2026, verified in this elaboration, states that file 36586 is still being processed by the House of Representatives. A proposal is not an already applicable replacement.
