A second CBR examination: purpose, procedure and costs
An unfavorable investigation report can have major consequences for your driver's license. A second investigation then seems like an obvious re-examination, but it must first be clear which procedure is in progress and what a new investigation can answer. Our analysis: the value lies not only in a possibly different conclusion, but in the question of whether a concrete medical or factual point of dispute can be reassessed. This requires insight into the first report, the procedural location and the current instructions of the CBR. A private report, a request for correction and a statutory second investigation are different routes that do not automatically replace each other.

The name re-inspection can hide various procedures
The CBR can have the suitability for driving assessed in different situations. A report after unsafe driving behavior does not lead to exactly the same procedure as a personal health declaration for a driving license application or renewal. Driving skills and medical fitness are also different topics. Therefore, start with the letter received: what legal route does it contain, what is being investigated and what decision has been announced? The common word second investigation does not say enough about this. An explanation from another process may be unsuitable for your own choice on important points.
The CBR policy rule for examining medical specialists, applicable from 2026, distinguishes between procedures and describes requirements for medical reporting. This is a different source than a personal invitation with date and payment instructions. Use both for their own function. The policy helps understand what a specialist does; the specific letter shows which step is now offered or required. If there is any uncertainty, have it determined which process is actually in progress before an appointment is made with another doctor, assuming that the CBR procedure has been complied with.
What article 134 WVW says about a second investigation
Article 134, third paragraph, of the Road Traffic Act 1994 describes, in the event of a proposed declaration of invalidity, the notification of the possibility of requesting a second investigation within two weeks. This legal connection point is part of the intended procedure. It is not a general two-week period for every medical question to CBR. Check the notification received, the start of the period and the prescribed course of action. A request for an explanation or a private appointment with a specialist does not automatically mean that a second examination is validly required.
The implementation and costs are subject to additional rules, including the Regulation on Driving Skills and Fitness Measures 2011. Therefore, follow the specific payment and application instructions and immediately ask for an explanation if they are unclear. Keep evidence of timely actions. Do not assume an automatic postponement because a report is still being studied or a lawyer is calling back. A decision on whether or not to use this option must be prepared in a timely manner, while collecting additional content may sometimes require more time. First read which reasoning needs to be checked
An unfavorable conclusion can be based on several sources: conversation, history, physical examination, laboratory data or other relevant information. Request the full report and investigate which findings are really decisive. A short results letter may present the reasoning too concisely to properly consider a second investigation. Note which passages appear factually incorrect and which contain a medical assessment. These two discussions require different expertise. An incorrect year can be corrected differently than a substantive disagreement about the meaning of research findings.
Put the reasoning in your own words next to the original piece and have it checked whether the summary is correct. What is each conclusion based on and what question remains open? An unfavorable term in the last paragraph is not the whole report. Conversely, a reassuring single measure may be insufficient when other findings are also used. Our analysis is that the best preparation starts with the underlying reasons. This allows any follow-up to be targeted, instead of seeing a new examination as a lottery where only a different doctor is needed.
Inspection and correction are not a new medical assessment
A viewing option helps check what the specialist has recorded. A correction request may be relevant to factual errors, but does not give an unlimited right to change the medical conclusion as desired. Discuss specifically which passage is incorrect and which existing data shows this. It is not enough to want to remove a passage because it is detrimental. Save the original text, request and response. This makes it visible later what was already discussed before dispatch or decision-making and how the substantive response was given.
Do not confuse the applicable response route with the statutory second investigation. Blocking a report also has a different meaning and can have consequences for cooperation and driving license status in a mandatory process. Anyone who just wants a new assessment should therefore not opt for blocking without explanation. Have the lawyer assess the connection between inspection, correction, sending and cooperation. The separate page about incorrect CBR reporting and the blocking question can help to keep the concepts separate, but your own letter and procedure remain decisive for the step to be taken. What can a second review really add?
Formulate one or more specific questions. Is a relevant medical circumstance not involved? Is the history incorrectly stated? Is the significance of a finding disputed? A second investigation can be useful when it is clear which uncertainty it should help assess. No one can guarantee in advance that the result will be more favorable. Another specialist may reach the same conclusion or describe additional findings. The consideration must therefore rest on information value and procedural position, not on a promise that a second chance will automatically result in a better driving license decision.
Note the period assessed. A current condition may have changed compared to the initial examination. That does not automatically make a later report proof that the initial assessment was wrong at the time. Conversely, a new report can provide relevant criticism of previous principles. These options must be kept separate in terms of content. Therefore, record the research date, period discussed, information used and the conclusion. Medical questions require appropriate medical expertise; the lawyer then assesses what legal significance a difference or addition has in this procedure.
A financial choice requires a concrete overview
A second investigation may entail costs, and not every part is necessarily included in one amount. Check the current CBR letter and rate information for the applicable inquiry and ask what other charges may apply. Do not use an old forum rate as security for the total bill. Note payment term, payment reference and what happens if an appointment is canceled. Even in the case of a financial objection, it must remain clear which action is procedurally necessary. Failure to pay out of protest is not automatically a valid objection or a recognized request for postponement.
Place costs next to the intended purpose. A private expert report may have a different assignment and position than the statutory second investigation. Ask in advance what an expert can investigate, what material is needed and whether the report can be useful for the relevant procedure. A favorable expectation from a provider does not constitute a legal guarantee. Make clear agreements about assignment and scope without demanding a desired conclusion. The reliability of a report stems from independent research, even when the outcome does not correspond to the client's hopes.
Objection to a decision remains a separate question
An intention, investigation report and final decision do not have the same procedural meaning. The General Administrative Law Act regulates legal protection against decisions, with a general rule of six weeks for objections. This general term does not replace the shorter investigation step in Article 134 of the WVW. So let us determine which document is currently available and which action is appropriate. A timely request for a second investigation does not necessarily make every subsequent objection superfluous, while an objection letter does not automatically count as a correctly requested second investigation.
Also check the current driver's license status. An ongoing investigation or objection does not automatically give permission to drive when validity is suspended or the driver's license is declared invalid. Restitution from a criminal justice process also does not automatically decide the CBR process. Request clear confirmation of the status and consequences of new decisions. An employer who expects a ride, a needed job or a personal belief about fitness to drive does not change that status. Make transport practically possible in a different way until it is established what is legally permitted.
Fictional example: an incorrect fact in addition to a medical conclusion
In a fictional situation, Eva reads in the first report that she completed treatment on a certain date. That is not correct according to existing correspondence. At the same time, she disagrees with the medical conclusion about her suitability. She thinks that one correction email will solve everything. The lawyer makes a distinction: the incorrect fact requires a targeted response, while the medical conclusion may require further investigation. The period for a statutory second investigation now runs based on the communication received and is not automatically stopped by that email.
Eva keeps the original report, substantiates the factual correction and discusses in a timely manner whether she wants to use the offered research route. A later report is then compared to the first for data, period and reasoning. This fictional case does not predict a favorable outcome. She shows that different substantive problems in one report can require different actions. A useful preparation keeps these actions visible side by side, so that attention to an apparent error is not at the expense of the term or the substantive dispute about suitability.
Seven fields to compare the first and second ratings
Create two columns with the same questions for both reports. Add a third column for the difference and why it is relevant according to the lawyer or expert. Do not include your own medical conclusions as proven facts. Use references to the relevant passage and original appendices. Update the map when CBR makes a decision to show how the second report was handled. The overview supports a targeted assessment and prevents only the desired final word suitable or unsuitable from being compared.
- Procedure: basis, investigation type, communication received and the next action.
- Term: start, required application method, payment and proof of timely execution.
- Period: date of examination and the medical or factual condition being assessed.
- Data: conversation, documents, history and additional research conducted.
- Reasoning: supporting findings, factual errors and the way in which corrections have been processed.
- Difference: new information, different valuation or changed condition, with expert explanation where necessary.
- Decision: CBR response, current driver's license status, and separately assessed remedies.
A second investigation has value because of a clear assignment
Our conclusion is that a second examination is not a general retake outside the procedure. The legal route can be important, but it must be used in a timely and appropriate manner. The substantive added value is related to the point to be assessed and the data available for this purpose. This requires both legal definition and appropriate medical expertise. A clear comparison file makes it visible whether a second report actually assesses the same subject differently, discusses a previous error or simply describes a different period. These differences determine which follow-up question is useful.
Use the explanation about the objection to the CBR and about reclaiming the driver's license for the connection with decisions and other processes. Check the personal letter immediately and do not allow an unclear period to pass while only the content is discussed. A good choice may also be that a particular route adds little, but that choice must be informed. The goal remains a verifiable assessment of the actual situation, while maintaining appropriate procedural options and clarity about when driving is and is not permitted. Frequently asked questions
Am I entitled to the same re-examination for every CBR examination?
No. The notification procedure, health declaration and other processes have different rules. Article 134 WVW contains a specific possibility for a second investigation. Check which route and communication apply in your situation before applying general information to your letter.
Is a private second opinion enough to request a second investigation?
Not automatic. A self-arranged report does not automatically have the same procedural position as the statutory second investigation. Follow the application and payment instructions and discuss in advance which assignment a private expert can fulfill and which formal action remains necessary.
Can I drive while disputing the report?
This depends on the current validity, possible suspension and other restrictions. A challenge or request for re-examination does not automatically make driving permitted. Have the status determined on the official documents and coordinate practical transport problems without accepting an exception yourself.
