Temporary exclusion from the home alongside a criminal case

A temporary restraining order can change your home, contact with children and daily organization in one afternoon. At the same time, the police can investigate a violent incident. This combination makes it tempting to treat everything as one criminal case. That is risky: the restraining order has its own decision, purpose and legal protection. Our analysis is that the initial preparation requires two tracks: acting safely and verifiably within the current restrictions, and having a separate assessment of which decisions and accusations can be contested.

Safety and criminal law answer various questions

According to the national government, a temporary restraining order can also be used in a threatening situation, when criminal intervention does not offer the same options. The goal is to break an unsafe situation and organize help. A police investigation into, for example, abuse or threats has a different approach: investigating a suspicion and a possible criminal response. The fact that both procedures refer back to the same incident does not make their conditions identical. (Central government, a temporary restraining order can also be used in a threatening situation)

For the preparation, this means that you have to separate documents according to sender and decision. A decision on behalf of the mayor, an official report and an appointment by emergency services each have a different function. Anyone who only calls the lawyer about the police interrogation can leave the administrative law side undiscussed. Anyone who only challenges the restraining order has not yet put up a defense against the criminal accusation. Make both requests for help explicit during the first legal conversation.

Read people, place, contact and time accurately

The Temporary Restraining Order Act is the legal basis for this measure. Ask for a legible copy of the decision and check which property, persons and period are mentioned in it. Don't rely on a short verbal description like not coming home. The ban could also limit contact. Make a note of the time of presentation or receipt and the contact person you can reach for questions. If the police also communicates another prohibition or other obligation, have it determined which document belongs to which authority.

A calendar can help, but do not enter an end date based on a rounded number of days in a conversation. The central government describes an initial period of ten days and a possible extension of up to four weeks. Check the concrete decision and any subsequent changes. A new letter can change the actual situation, even if an agreement about return had already been made. Request written clarification when information is contradictory and let the attorney assess the legal significance.

Consent from a housemate does not automatically change the decision

An invitation from a partner can carry emotional weight. However, a housemate cannot independently set aside a government decision. The idea that you can go back because the other person asks for it can therefore cause a new legal difficulty. The same applies to messages via family members if the decision prohibits contact. Have it assessed which forms of contact exactly fall under the restriction and which route for necessary communication is permitted.

Immediately communicate any necessary practical problems to the designated care provider, contact person or lawyer. Think of medicines, identity documents or items for work. Ask how this can be arranged safely without organizing a prohibited visit or message yourself. Record the agreement and the permission of the competent authority if this is the case. A failed practical arrangement does not automatically justify its own exception. The goal is that no one has to improvise in an already tense situation.

Appeal and an urgent request are separate steps

The Rotterdam court describes an appeal against a restraining order and a request for interim relief. Such an urgent request can request that the ban be suspended while the judge deals with the case. The administrative route must therefore be examined independently. Do not assume that a complaint to the police, a letter to the mayor or a challenge during a criminal interrogation opens the same procedure.

Ask immediately which submission method and deadline apply and which documents must be included. A quick hearing does not mean that the ban until the hearing is ineffective. Additionally, discuss which decision is being challenged: the original imposition, an extension, or both. If a new decision is made during the procedure, the lawyer must assess how this will be incorporated into the current case. An overview of decision dates prevents a well-substantiated request from focusing only on a period that has now passed.

A security question requires more than denying one detail

The assessment of a restraining order concerns the applicable legal conditions and the situation on which the measure is based. A relevant response may address factual inaccuracies, the assessment of danger, the motivation or proportionality. Which points are actually significant depends on the decision and file. A small error at a time does not automatically make all information about a threatening situation worthless.

Therefore, make it clear for each disputed point what happened according to the decision, why you think it is incorrect and what verifiable source exists about this. Also leave unfavorable data. A defense that leaves out all tensions may be less credible and less useful than an accurate description of what is and is not acknowledged. In addition, ask the lawyer what significance new developments, assistance and concrete safety agreements may have in the assessment. That requires more than a general promise that things will remain calm from now on.

Discuss statements in their own process context

In addition to the restraining order, there may be a criminal suspicion. The rights and guarantees under the Code of Criminal Procedure are relevant to that procedure. The desire to have the restraining order removed quickly is not a good reason to make an extensive statement about a criminal offense without preparation. Tell the lawyer which conversations have already taken place and which data has been shared with which agency.

Do not automatically treat assistance as a confidential conversation with the same protection as legal assistance. Ask in advance about the purpose, reporting and sharing of information. This does not mean that necessary safety agreements should be postponed. It means that you make a distinction between practically cooperating with safety, providing personal information and substantively responding to a criminal accusation. The Public Prosecution Service's instructions on domestic violence make it clear that the approach can be broader than just the wishes of one person involved. (OM instruction on domestic violence)

Fictional example: medication and a message from the partner

In a fictional example, David gets a restraining order. His medicine and work pass are still in the house. That evening, his partner sends a message asking him to come over. David experiences this as a solution for both the practical items and the conflict. But the message does not prove that the decision has changed and says nothing about other restrictions that may apply. A spontaneous visit can make the situation less safe and legally more complicated.

A more careful route is to report the problem to the designated contact person and have it recorded how necessary items can be accessed. At the same time, a lawyer can assess the decision and any urgent request. These two actions are not mutually exclusive: compliance does not have to mean a waiver of legal protection. The example does not predict an outcome in a case, but shows why practical urgency and legal permission are different questions. Especially in an emotional situation, it helps to keep that separation visible.

Accessibility and reception are also facts in the file

Anyone who has to leave their home may have difficulty sleeping, working and receiving mail. Arrange a contactable address and telephone number for the procedure. The official form for appeal and urgent request asks for information with which the court and the authorities involved can handle the case. Inaccessibility can lead to missed information without resolving a substantive dispute.

Also discuss what support is available to the various stakeholders. Children have different needs than adults and a temporary stay elsewhere can be organizationally complicated. Record practical bottlenecks factually, but do not use them as a means of exerting pressure on a housemate. A good substantiation makes it clear which safe, feasible arrangement is possible and which authority has a role in this. Whether this gives reason to change the decision is a legal assessment and not a consequence of the seriousness of your discomfort alone.

Make a map of decisions and necessary agreements

Work with one overview in which the two procedures are shown side by side. For each document, note the sender, date, scope and question for the lawyer. Limit the distribution of personal information to what is necessary for the purpose. Sending a complete collection of private messages to different authorities can unnecessarily spread sensitive data and does not automatically clarify the core of the dispute.

  • Decisions: original imposition, concrete restrictions, period and possible extension.
  • Legal protection: chosen route, filing, confirmation of receipt and hearing information.
  • Criminal case: suspicion, invitations, lawyer and statements already made.
  • Safety: designated contact persons and existing agreements that actually apply.
  • Practical: accommodation, accessibility, medicines, work documents and necessary items.
  • Evidence: concrete disputed points, original sources and recognizable uncertainties.
  • Change: new decisions or agreements that must update the overview.

Compliance and testing can coexist

Disputing a restraining order and complying with the decision in the meantime are not contradictory choices. Legal protection is precisely about the way in which government interventions can be carefully assessed. It is also possible that the administrative judge and the criminal court answer different questions. An outcome in one procedure should therefore not be used as an automatic response to the other without legal investigation. The precise legal basis and decision are decisive.

The most useful first step is to make both tracks fully visible to legal aid. Have urgent deadlines assessed, organize necessary practical matters via a permitted route and prevent new uncertainty about contact. The in-depth on domestic violence as a suspect discusses the criminal accusation; the guide to restraining orders discusses other bases and limitations. This article focuses on the temporary restraining order's own position and how to prevent it from disappearing between the two topics. (domestic violence as suspect · restraining orders)

Questions from litigants

Frequently asked questions

Is a temporary restraining order the same as a criminal conviction?

No. It is its own security measure with an administrative legal process. There may also be a criminal case pending. Have the legal significance of each decision or procedural document assessed separately.

Can I go back if my partner agrees?

Not without more. The consent of a housemate does not automatically change an applicable decision. Ask the designated contact person or lawyer how necessary items or other practical questions can be arranged within the restrictions.

Will the restraining order be stopped as soon as I file an appeal?

An appeal does not automatically suspend the operation. Therefore, discuss whether an interim measure is also necessary and possible. Check the specific procedure, the term and which decision is being challenged.
