When compensation awarded in a criminal case is not paid
An awarded compensation feels like a conclusion to the criminal case. However, if payment is not made, another phase begins with its own questions. Who collects the amount, is the decision final and is the compensation covered by an advance payment arrangement? The answer does not only lie in the sentence in which the judge grants the claim. Our analysis: Read the decisive part of the statement as an execution map. Split the right to compensation, the collection route and any advance payment. This makes it clear what action is needed and to which authority a specific question belongs.

Start with the full deciding part
Request the full ruling and read which damage items were actually awarded. A claim may be partially granted, partially rejected and partially not dealt with substantively. Note the amount, any interest and the further decision for each part. Your own total from the original claim form is therefore not always the amount that can now be exported. Also check whether multiple people are liable and how this is described in the decision.
Then distinguish between the order to pay the injured party and an imposed compensation measure. Article 36f of the Criminal Code provides the framework for that measure. The text of the ruling determines whether it has been imposed in the specific case. The presence of compensation does not mean that every implementation route is automatically the same. Have unclear formulations explained using the actual dictum, instead of just using a verbal summary of the hearing.
The date of the hearing is not always the start date
A judge may have ruled while an appeal or other legal remedy is still pending. Therefore, ask whether the decision is irrevocable and what date applies. The information from the Public Prosecution Service for victims links the final ruling with information from the CJIB. Anyone who starts counting from the day of the hearing may conclude too early that a term has expired. Keep the confirmation of the status of the proceedings, especially if the criminal case contains different prosecutor's office numbers or parts.
Make a separate line in the administration for the ruling date, any legal remedies and the confirmed final date. This separation prevents discussion about a self-calculated calendar that is based on the wrong starting point. If a legal remedy is still pending, ask what information is already available and what must await the outcome. Do not allow a lack of reporting to continue because it is unclear who to contact. A specific question about the final status is easier to answer than the general complaint that nothing happens after the hearing.
The CJIB process requires the correct case number
When a compensation measure is implemented, CJIB plays a central role in collection and payment. The central government describes this route for compensation after a criminal offense. Check whether the case is known to CJIB and whether your contact and payment details are correct. Use the number from the corresponding correspondence. A previous police report number can provide useful context, but is not necessarily the identifier used to locate the payment record. (The government describes this route)
Then ask specifically what is still missing: the decision, the final status, an account number or other necessary processing. Write down the date, answer and any next step. A general repeated question when will my money arrive can be understandable, but provides less insight than a targeted status question. Keep expectations realistic. An announced collection action is not proof that the amount has already been received. Ask which phase has been confirmed and what information is not yet available, so that an administrative problem is not unnecessarily interpreted as a payment refusal.
Check conditions and maximum separately
The CJIB page about the advance payment scheme describes that victims can, under certain conditions, receive a full or partial advance payment if payment is not made. For the judicial compensation measure, the irrevocable judgment is an important starting point for the eight-month period. The scheme distinguishes between the applicable category and conditions; For crimes other than the designated violent and sexual crimes, the advance is in principle capped at €5,000. Do not take a general guarantee based on the word violence alone in a story about the case.
Make a distinction between the total amount allocated, money already received and the part that may be paid out as an advance. An advance payment is not a second compensation on top of the same damage. The convicted person continues to be confronted with the payment obligation under the applicable scheme; collection and payment to the victim are different movements. If in doubt, ask which category is applied to your own decision and what amount is still eligible. An individual confirmation prevents a general public example from being treated as a payment promise.
Without action, the executable title must be examined
If no compensation measure has been imposed, you cannot simply expect the same CJIB route. Have it investigated whether the assigned civil claim in the criminal judgment constitutes an enforceable title and what steps are required for implementation. A lawyer or bailiff can look at the real decision. Discuss costs, recoverability and available information about the person liable for payment in advance. A right to payment and a practically promising collection action are related, but not the same.
Allocated legal costs and unallocated damage components also deserve their own place. Do not assume that every amount in the ruling automatically falls under the same measure or advance payment scheme. A clear breakdown prevents a bailiff and a government agency from working at cross purposes. When proposing further action, ask exactly which part is being collected and why. This makes it easier to weigh the costs and prevents the next step from mainly producing extra paper without a recognizable route to the outstanding amount.
Create one administration for all amounts received
A payment can come directly from the convicted person or be paid through an agency. Therefore, keep one overview with the date, amount, origin and the damage item to which the payment relates according to the documents. Report relevant payments to the collection agency. The same damage cannot be treated as fully outstanding each time. If descriptions are unclear, it is wise to first ask how the payment should be processed before presenting your own settlement as established.
If there are multiple payers, extra attention needs to be paid to the wording of the statement. Joint and several liability does not mean that the total awarded damage amount may be doubled for each individual. Have your own situation explained and keep payments from everyone involved together. Joint administration prevents a partial payment on one route from remaining invisible on the other. It also helps when an advance payment is made later and it is necessary to determine what part of the compensation has not yet been received by the victim.
Fictitious example: € 7200 allocated and yet different amounts
In a fictitious case, Sara is awarded €7,200 in damages. She also sees a decision on interest and legal costs. The ruling contains a compensation measure for a certain amount and will later become final. One convicted person pays €1,000 directly in the interim. Sara initially expects to receive the full amount again on the day eight months after the hearing. That expectation does not take into account the final date, the direct payment and the precise scope of the measure.
An implementation card first splits the components and then confirms which advance conditions apply. With an applicable maximum, the advance may be different from the entire remaining amount. Process costs may also require a separate route. This example does not capture any individual calculation; for that, the real decision and applicable rules need to be looked at. It shows why three columns are needed: assigned, received and yet to be collected. Without this separation, different amounts are quickly read as one payment promise.
Non-payment does not disappear automatically due to deprivation of liberty
The CJIB explanation of hostage taking describes this means as a last resort to enforce payment. It is important for a victim that deprivation of liberty and fulfillment of an obligation to pay compensation are different things. A notice that someone is in custody does not prove that the damage amount has been paid or that the obligation has disappeared. Ask about the status of the payment case and do not base conclusions on rumors about the detention situation. The precise implementation rules must be applied to the decision. (CJIB -explanation of hostage situation)
Do not seek your own means of pressure via social media, employer or family of the convict. This can escalate the situation and does not help to clarify the legal collection route. If you receive threatening messages about payment, keep them separate and seek appropriate support. A payment question and a security problem can occur at the same time, but require different actions. Have the payment administration run through the correct agency or authorized representative and prevent necessary protection from becoming dependent on private negotiations about money.
Seven pieces of information make a status question concrete
Keep a compact execution chart next to the complete pieces. This means you do not have to retell the entire criminal case with every contact. Also mention anything that has not yet been confirmed, such as the final date or the applicable advance maximum. Use the card to ask questions, not to pass off your own legal opinion as established. The broad explanation of the criminal procedure can help to distinguish the different phases of the case. (criminal proceedings)
- Decision: full judgment, date, case number and any subsequent decision on appeal.
- Amounts: awarded damages, interest, legal costs and separately treated or rejected parts.
- Measure: whether a compensation measure has been imposed and for what amount.
- Status: Confirmed date of irrevocability or pending remedy.
- Collection: responsible authority or bailiff, reference and last concrete status message.
- Receipts: all payments and advances with date, source and processing in the balance.
- Follow-up question: which document, data or decision is missing to determine the next step?
Executing a statement requires clarity per part
Our editorial conclusion is that non-payment will not be resolved with one standard action. Sometimes administrative information is missing, sometimes the decision is not yet final and sometimes a different collection route is necessary. The implementation map helps make that distinction. She gives the victim more control without promising an advance or successful collection. It also makes it clear when legal assistance is mainly necessary for an explanation of the operative part, for recovery of assets or for a separate residual damage component.
Therefore, always place a status question next to the real decision and the payment administration. Ask an agency to confirm what it carries out and what falls outside its route. Separate legal rights, collection opportunities and money received. This prevents silence from continuing unnecessarily or the same damage being incorrectly reported in different places. Careful execution does not change the consequences of the offense, but it can prevent compensation from becoming a source of problems again due to unclear data and incorrect expectations.
Frequently asked questions
Will I automatically receive my money eight months after the hearing?
You can't accept that generally. In the case of a judicial compensation measure, it is important, among other things, when the judgment became final and which advance conditions apply. Have the initial status and applicable amount confirmed.
Damages have been awarded, but no compensation measure. What now?
Have the ruling assessed for the possibilities for civil implementation and the required title. A lawyer or bailiff can explain the steps, costs and recovery options involved. Don't automatically expect the same CJIB route.
Do I need to submit a direct payment?
Yes, keep careful records of payments and inform the agency collecting the fee. The same damage may not be collected twice. Keep evidence and if in doubt, ask which part a payment should be processed on.
