Requesting urgent court relief against a CBR decision
A CBR decision can have immediate consequences, while an objection or appeal may take months. In the meantime, those who cannot work, care or reach necessary appointments need a quick solution. An interim injunction can provide a temporary court decision, but simply saying that you need the driver's license is not complete substantiation. Our analysis: connect the concrete decision to the concrete disadvantage and to the precise measure you request. This depth helps prepare an emergency file; the general objection route and a criminal complaint each have their own framework.

Determine which decision causes the disadvantage
Start with the full CBR letter, including attachments and remedies information. Has an investigation been imposed, has its validity been suspended, has a driver's license been declared invalid or has an application been rejected? These are not interchangeable decisions. Note which legal consequences are mentioned and when they take effect. A request to merely postpone a payment date has a different purpose than a request to temporarily lift the suspension of validity. Let the lawyer determine which decision the request should refer to and which formulation matches the problem that actually causes urgency.
Also map out the other routes. A criminal detention of the driver's license by the Public Prosecution Service for a longer period of time, a judicial criminal driving ban and a CBR decision can coexist. A favorable decision on one aspect does not give general permission to drive again. The guide to an ongoing CBR procedure after return elaborates on this coincidence. For the urgent file, it is particularly important whether the requested measure can actually reduce the alleged disadvantage. If another independent barrier remains, it should be discussed from the start.
Ensure that the associated objection or appeal procedure is running
According to Article 8:81 of the General Administrative Law Act, an interim measure presupposes an associated procedure. The explanation of Rechtspraak makes it clear that an objection or appeal must first be filed if this has not already happened. Therefore, keep the submitted document and the confirmation of receipt. A draft on your computer or a telephone conversation with the CBR does not prove that the required procedure is running. Have it checked which legal remedy is available, with which authority and within what period; an urgent request does not automatically repair a missed essential matter.
Article 6:16 of the General Administrative Law Act is based on the principle that an objection or appeal does not suspend the effect of a decision, unless otherwise stated. Therefore, treat filing an objection and requesting temporary protection as two separate tasks. Agree who will implement and monitor both. The guide to objection to the CBR helps read the main route. In the meantime, also determine which obligations continue from the decision, such as a response or cooperation. An application to the court is not automatically a license to ignore those obligations.
Shows why waiting is not possible right now
Describe the disadvantage in terms of time and magnitude. When does the problem arise, what happens before an expected decision, and why can't it be fixed later? A general sentence about loss of income says less than a concrete explanation of the work, starting date, necessary travel and available replacement. Use existing pieces and make uncertainty visible. If an employer has not yet made a decision, do not write that dismissal has been finalized. An inflated emergency claim can weaken the reliability of an otherwise serious request.
Urgency may be related to work, care or other compelling interests, but the connection must be explained. For example, a care task requires information about what action is required, how often, at which locations and what other options actually exist. Only share the sensitive data required for the request and discuss secure delivery. The goal is not to collect the most personal story possible. The judge must be able to understand what current problem arises from this decision and why a temporary solution cannot wait for the main case.
Also explain why alternative transport is inadequate
A request becomes more controllable when it addresses the real alternatives. Consider public transport, ride-sharing, an adapted division of tasks, digital appointments or temporary other work. This does not mean that every theoretical option must be organised. Please show what has been researched and what the practical limitations are. Only record travel times, service hours or a specific refusal if there is a reliable basis for doing so. The lack of convenience is different from the inability to perform a necessary task within the relevant period.
Distinguish between impossibility, large additional burden and preference. Anyone who mentions a bus route that does not run during a night shift describes a different situation than someone who finds a longer journey unattractive. The costs and duration of temporary solutions may also be relevant, but must be linked to the actual problem. A review of alternatives is not an admission that the disadvantage is unimportant. It actually helps a lawyer explain why available options do not sufficiently address the specific consequence or why another temporary measure is better suited.
Urgency does not replace a substantive assessment
In addition to urgency, the preliminary relief judge looks at the legal objections raised and the interests involved. The precise grounds you put forward depend on the decision and the applicable regulations. An incorrectly read report requires a different substantiation than a dispute about a medical report or the receipt of a call. Refer to specific passages and appendices. The importance of road safety carries a lot of weight in this legal area; a personal disadvantage does not make every legally prescribed measure freely negotiable.
Our analysis is that the strongest preparation preserves two lines: why temporary protection is necessary now and why there is a legal basis for it. An impressive financial overview without decision-oriented grounds for objection leaves an important question open. A complicated legal argument without a current disadvantage may also fall short in an emergency procedure. Have the lawyer indicate what information is required for each line. Do not try to replace a missing legal basis with more and more personal documents that describe the same disadvantage again.
Calling work is not the same as making loss of work plausible
In ECLI:NL:RBZWB:2024:4194, the preliminary relief judge rejected a request for a driving test and suspension due to insufficient urgent interest. The person concerned had mentioned work, but had not sufficiently explained why it could not be carried out without his own driving licence. The judge also took into account available alternatives and the presence of other income. It is a concrete assessment of that file, not a rule that work or family interests can never cause urgency. The practical lesson is that the consequence and impossibility of postponement require substantiation.
Therefore, do not use a statement as a general probability meter. A different position, different income dependency or different care situation may require a different analysis. Conversely, copying words from an assigned request does not make your circumstances the same. Moreover, read which question the judge actually answered: a rejection due to lack of urgency is different from a substantive judgment that the CBR was right in all respects. Keep the operative part, the reasons and the provisional character separate when discussing the ruling with the lawyer.
Request a temporary measure that can solve the problem
Before the discussion, write down what you think you will need until the decision is made in the main case. Then have it legally translated into which provision is possible and appropriate. It may not be sufficient to simply ask for the decision to be removed if there are multiple legal consequences or subsequent decisions. A limited request can sometimes be better suited to the specific emergency problem than a broadly formulated wish. That is not standard advice to always ask for less; it is about an understandable link between authority, decision and practical effect.
Also discuss how long a provision would apply and what obligations would remain in place in the meantime. A suspension of a decision is not automatically a definitive determination of fitness to drive. In an appeal procedure, the judge may also, under certain conditions, immediately dismiss the main case on the basis of Article 8:86 of the General Administrative Law Act. Therefore, after the ruling, read carefully what was actually decided. The emergency hearing label does not independently indicate whether only temporary intervention has been taken or whether a final judgment has been given on the appeal.
Fictional example: a delivery function and two different obstacles
In a fictional case, Leyla receives a CBR decision that prohibits her from driving. She works as a delivery person and only sends her employment contract to the lawyer. During the consultation it turns out that a colleague can temporarily take over some of the journeys, but not the early shifts for which the contract requires specific availability. In addition, the driver's license is still with the Public Prosecution Service. A request that only deals with the CBR suspension may therefore not lead to the resumption of the journeys. Both obstacles must be mapped separately.
Leyla then collects an actual employer statement about tasks and available replacement, the overview of services and the documents of both procedures. It does not accept a threat of dismissal that the employer has not made. The lawyer assesses which disadvantage is current and which steps are required per route. This example does not predict assignment. It shows why the urgent question needs a causal chain: decision, obstacle, concrete consequence and a provision that can actually reduce that consequence within the period in which waiting seems irresponsible.
Organize evidence by consequence rather than magnitude
An emergency file must be quickly readable. Start with a brief explanation of the problem and link each key statement to a specific appendix. Do not automatically add a complete personnel folder or medical file. Make it clear what the attachment proves and what personal information is not necessary. Keep the original and let the attorney determine what is filed. Make sure that a deadline, start date or ongoing obligation is at the top; an urgent task should not disappear under dozens of pages of background that explain little about the facility.
- Decision: date, reference, legal effect and effective date.
- Main matter: objection or appeal, date of receipt and proof of submission.
- Urgency: concrete consequence, moment at which it occurs and recoverability.
- Connection: why this particular decision causes the consequence.
- Alternatives: researched solutions and demonstrable limitations.
- Substantiation: relevant contracts, schedules, statements and source documents.
- Concurrence: OM, judge, CBR, categories and other still applicable obstacles.
- Request: desired temporary measure, duration and ongoing obligations.
After the statement, check what actually changes
A favorable decision requires a careful reading of the conditions, validity period and other decisions. Have it confirmed which practical steps are needed and whether driving is actually permitted at that time. A rejection does not mean that all tasks disappear: the main point, possible cooperation and reaction moments can continue. Save the statement next to the original decision and update the decision card. When in doubt, possession of the driver's license card is not a reliable substitute for a check of legal status.
Our conclusion: an interim measure is especially useful to discuss when urgency, legal question and requested effect come together clearly. An actual emergency file helps more than a general request for leniency. It makes visible where temporary protection is needed and where another obstacle must first be tackled. By carefully substantiating both lines, legal assistance can provide targeted advice, without creating the expectation that work dependency, objection or a planned emergency hearing in itself will immediately make the driver's license usable again.
Frequently asked questions
Can I continue driving as soon as I submit an objection and an urgent request?
Not by itself. In principle, an objection or appeal does not suspend a decision. Have the applicable decisions and any other driving obstacles assessed and check which concrete judicial decision is required before driving becomes possible again.
Is an employer's statement always enough for an urgent need?
No. The statement must help substantiate the specific current disadvantage. Tasks, period, replacement and alternatives may be important. A general statement that a driver's license is useful or necessary does not determine the outcome.
Is een toegewezen voorziening hetzelfde als definitief winnen?
This usually concerns temporary protection. Under certain conditions, the appeal judge can also immediately dismiss the main case. Therefore, read the operative part, the duration and the conditions exactly and have it checked which other decisions remain valid.
