Benefit fraud: administrative decisions and criminal investigation

An investigation into a benefit can lead to a correction, recovery, administrative fine or criminal proceedings. These consequences do not all have the same conditions. Received too much money does not automatically prove that someone committed fraud intentionally. At the same time, an unintentional error can also have financial consequences. Good preparation keeps the factual information, legal obligation and individual decisions visibly separated.

One check can lead to several documents

After an audit, a benefit may be reviewed, an amount recovered and a punitive measure considered. In addition, a criminal suspicion may arise. The UWV explanation about checks shows that incorrect data can have consequences even without deliberate fraud. A letter containing the word investigation therefore does not yet indicate which procedure is currently underway and what response is required from you. (UWV explanation about checks)

Our analysis uses four lines in a file overview: entitlement to benefits, reimbursement, administrative punishment and criminal law. For each letter, indicate which line it belongs on. This prevents a response to the calculation from being mistaken for an objection to a fine or a police interrogation from pushing all other deadlines out of the picture. A correction of the benefit entitlement may have its own legal basis without establishing criminal guilt. Both assessments must remain recognizable.

What information exactly did you have to provide?

Different benefits have different information obligations. Income, work, residence, cohabitation or other change may be relevant, but the precise rule and period must be determined. It is not enough to just read the general accusation that you did not report something. Ask what information was missing according to the authority, why it was important and through which scheme you should have reported it. The concrete obligation is the starting point for further assessment.

Collect application forms, explanations, previous questions and notification confirmations. A telephone conversation may be relevant, but the content and processing must be investigated. Make a note of what you actually reported and what response you received. A saved confirmation of receipt does not automatically prove that all necessary data has been transmitted; the content remains important. Conversely, a demonstrable message should not be ignored because it is not in the expected location in a system. A targeted reconstruction looks for both sides of that communication.

Reconstruct work, income and living conditions separately

A study can combine data from bank statements, registrations, observations and statements. These data can say something about activities, but do not always mean the same for the right to every benefit. A payment can be a wage, loan or reimbursement; the actual ratio remains to be seen. A registration at an address is not always a complete description of the actual residence. The applicable benefit rule determines which facts are relevant.

Therefore make a monthly or period table instead of one general life story. State source of income, activities, notifications and existing supporting documents. Note uncertainties and changes. If the Public Prosecution Service blames a prolonged period, a demonstrable change halfway through may be important. Do not shift data to a more favorable month to make the calculation appropriate. An incomplete but fair overview can be supplemented in a targeted manner; an artificially closed reconstruction makes control more difficult and can raise new suspicions.

An error in data is not automatically proven fraud

Depending on the criminal law, intent, knowledge and other conditions may be important. The Criminal Code contains various possible accusations regarding incorrect data and documents. An administrative error and deliberate misleading should not be equated without evidence. At the same time, a pattern of incorrect statements, warnings or actions can be relevant for the assessment of intent. The concrete reasoning must be examined. (Criminal Code)

Discuss what you knew and understood at the time of the report or omission. Language problems, complicated forms or advice from someone else can provide context, but are not a blanket exemption from any duty. Link such circumstances to specific questions and answers. An appeal to incomprehension is easier to test when it becomes clear what explanation was requested and given. The lawyer can assess how this differs for the criminal case and a possible administrative fine. The financial correction may also continue to require its own assessment.

A detriment amount is a substantiated calculation

A large final amount can consist of multiple periods and assumptions. Ask how it is structured and what entitlement to benefit remains per period according to the authority. The amount may be relevant for recovery, choice of settlement and punishment, but these applications are not completely identical. The 2023 Public Prosecution Service instruction on social security fraud uses amounts as a starting point for the route and mentions exceptions. A limit amount is therefore not a general guarantee that criminal law is impossible. (Public Prosecution Service designation for social security fraud from 2023)

Check start and end dates, gross and net amounts, settlements and reconciliation with the requested data. A dispute must point out the premise that you believe is incorrect. Simply reporting that you never saw the amount in your account may be inadequate if the calculation is legally structured differently. Let the lawyer and, if necessary, a benefits expert work together. A lower calculation does not automatically invalidate any previously chosen criminal route; the process position and policy application must be assessed separately.

Reimbursement and double punishment are different issues

The principle that the same conduct may not automatically be punished twice is important in administrative fines and criminal law. The General Administrative Law Act and the Public Prosecution Service instructions contain rules for this. However, recovery is not automatically the same type of punishment as a fine. Therefore, the reasoning that reimbursement excludes any criminal case is too general. It must be determined which decision has already been taken and whether legally the same fact and a punitive sanction apply. (General Administrative Law Act)

Bring fine intentions, fine decisions, penalty orders and prosecution documents together to the lawyer. An intention is not the same as a definitively imposed fine. Dismissal and the possibility of subsequent administrative law settlement also require a personal assessment. The practical benefit of a complete overview is that the coincidence is recognized in time. A substantive defense regarding intent remains necessary where relevant; a concurrent objection does not automatically prove that the original benefit data was correct.

Do not confuse control powers and suspect rights

Administrative audits may involve information and cooperation obligations. In a punitive or criminal investigation, there are also guarantees regarding explanations and legal assistance. The border can be legally complicated. Therefore, ask in what capacity you will be heard and what the basis for a request is. A universal advice to refuse all questions may be as incorrect as the idea that every request must be answered without restriction.

Have the rights and obligations for the specific action assessed. Save the invitation and ask for a report. Do not sign a statement that you do not understand or that misrepresents your words; ask for explanation and correction. Distinguish between existing documents that are requested and a substantive statement about possible criminal behavior. The criminal law guarantees apply within their scope of application. A lawyer can help you approach the investigation carefully without losing sight of legal obligations or your defense position. (criminal proceedings guarantees)

Waiting for the criminal investigation may cost an objection

An administrative law decision may have an independent objection or appeal period. A criminal appeal has other procedural consequences. One procedure does not automatically suspend the other. Therefore, note the date of publication or receipt and the legal remedies information for each document. Have the response assessed in a timely manner, even if not all substantive documents are yet available. Moreover, a payment arrangement is not the same as an objection to the underlying decision.

The UWV page about fines describes a response to an intention and a later decision. Do not confuse these phases: responding to an intention does not automatically replace a legal remedy against the final decision. Ask which authority is competent and how receipt of your response will be confirmed. A clear calendar with a responsible contact person prevents everyone from thinking that the other advisor is monitoring the deadline. When in doubt, a short, concrete check deserves immediate attention. (UWV page about fines)

Fictional example: varying additional earnings and an old notification

A fictitious benefit recipient has fluctuating income and believes that an earlier telephone conversation was sufficient to cover all subsequent changes. The agency states that monthly information was missing. The assessment asks for the applicable obligation, content of the report and actual income per period. The earlier notification may be relevant, but does not automatically prove that all subsequent information was communicated correctly.

A targeted overview links messages and payment information to each month. The lawyer investigates the significance of recovery, culpability and possible intent. The example shows why one misunderstanding can have different legal consequences without all having the same outcome. It also makes it clear that repayment can be a practical step, while there is still a difference of opinion about the correctness of the amount or a punitive accusation. The chosen route must carefully capture that distinction.

A period card for amounts, notifications and decisions

Use the map to organize the research and agree who monitors deadlines. Note the source of each amount and distinguish existing documents from your own memories. Do not keep records afterwards as if they were kept at the time. The map is intended to make relevant information reliably available and helps see where criminal and administrative law expertise need to work together.

  • Scheme: benefit, applicable obligation and period examined.
  • Data: income, activities, stay or other relevant changes per period.
  • Notifications: date, content, channel and confirmation or explanation received.
  • Calculation: assumptions, gross or net, settlements and disputed items.
  • Punishment: intention, fine, penalty or prosecution and mutual coincidence.
  • Deadlines: separate response, objection, appeal and payment agreements.
  • Continued: appropriate advisors, file documents and secure provision of information.
Questions from litigants

Frequently asked questions

Does chargeback prove that I committed intentional fraud?

No. The right to benefits, reimbursement and a punitive reproach have different conditions.

Can I receive an administrative fine and punishment at the same time?

For the same conduct, rules against double punishment and for the choice of route apply. Have the concrete decisions assessed together; recovery is not automatically a fine.

Can I wait for the criminal case before I object?

That can cause an independent term to expire. Have each letter and legal remedies information assessed separately immediately.

This article provides general information. The rules and options depend on your situation. Discuss your case and possible deadlines with a lawyer.
