Breaching or being unable to comply with pretrial release conditions

A missed report, an unclear treatment appointment or unauthorized contact can have major consequences when pre-trial detention is suspended. Still, the sentence the terms were violated is not a complete description of what happened or what decision should follow. Our analysis: make the applicable condition, the actual event and the current risk separately visible. This allows a lawyer to explain what is disputed, what change is needed and why an executable plan may be relevant. Ignoring a problem usually makes that preparation more difficult.

The word cancellation can indicate two opposite consequences

When pre-trial detention is lifted, the relevant deprivation of liberty expires. If the suspension is lifted, the existing pre-trial detention order can be executed again. That difference is essential when a letter or claim is received. The Rechtspraak explains the procedure and conditions of suspension. For each piece, ask what decision is required and what the possible consequences are in your situation.

Therefore, keep the original suspension decision, any changes and current correspondence. A reminder that you were conditionally released is not sufficient to assess an alleged violation. A decision for a fixed period also deserves attention: when does it expire and what assessment is necessary afterwards? Let the lawyer read current documents instead of assuming that a previous agreement without an end date or with exactly the same content will continue to apply.

First investigate the exact obligation

Read what the condition actually prescribes. What action, what contact, what place, what time or what guidance is there? A verbal agreement about implementation can be important, but does not have to be the same as the judicial condition itself. Make it clear who gave what instruction and where it is recorded. A dispute over the meaning of a condition is different from a dispute over whether a specific event occurred.

If anything is unclear, quickly ask the lawyer and the relevant supervisor for clarification. Do not assume that a self-chosen reasonable explanation will provide sufficient protection. If a condition does not seem feasible in practice, it must be assessed what adjustment or decision is necessary. The Code of Criminal Procedure forms the legal framework. The existence of a practical problem does not mean that the suspect can independently rewrite the condition.

Distinguish between notification, determination and conclusion

A supervisor can report an incident, after which the Public Prosecution Service or the judge will assess the next step. Ask exactly what event is being described and what data exists for it. A notification of absence, a personal statement about an appointment and a technical registration moment can contain different information. Assess the provenance and completeness before treating a summary as an established set of facts.

Also record your own information with source. If an appointment has been rescheduled, keep the original confirmation. If transport was not possible, note what is demonstrable and when you reported this. Also state what you cannot substantiate yourself. The aim is not to provide an explanation for every problem afterwards, but to provide a concrete dispute or explanation. A lawyer cannot do much with a general assurance that supervision has misunderstood without the relevant agreement or communication.

An implementation problem requires quick action

Sometimes a problem is foreseeable: a work schedule changes or treatment cannot start on the agreed date. Report the change in a timely manner via the agreed route and ask what is needed to keep the condition enforceable. The Netherlands Probation Service's explanation about supervision helps to understand the practical role of the supervisor. In addition, keep the legal role of the judicial decision visible. (explanation from the Dutch Probation Service about supervision)

A conversation with a supervisor is not automatically a formal change to a condition. Ask what agreements can be made within the existing decision and what requires a new judicial assessment. Save confirmations and also pass on important information to the lawyer. Early clarity can prevent a practical impossibility from appearing in a report as an unexplained absence. However, it does not guarantee that every incident will remain without consequences.

A proposed solution must address the problem

When an event raises compliance concerns, a general promise to pay closer attention is often insufficient. What risk becomes visible and how can it be specifically limited? A clearer reporting agreement can solve a different problem than a treatment that is actually unavailable. Therefore, make the plan specific and verifiable: implementer, start date, accessibility and the way in which new problems are reported in a timely manner.

Also leave the boundaries of a plan unchanged. A family member who wants to help cannot simply take over tasks of professional guidance or supervision. A waiting list does not disappear by describing an application as a fixed place. The information about supervision of special conditions can provide context for implementation; the concrete suspension decision and criminal position remain decisive. Practical feasibility and legal admissibility both need to be examined.

The Supreme Court requires a concrete weighing of interests

In ECLI:NL:HR:2025:987 of 24 June 2025, the Supreme Court dealt with the cassation in the interest of the law about lifting suspension after a conviction. The prison sentence imposed alone was not sufficient motivation; the interests involved had to be weighed up in concrete terms. The judgment also emphasizes the importance of interviewing the suspect if possible. This was not an individual proceeding in which the same outcome was determined for each future violation. (ECLI:NL:HR:2025:987 from June 24, 2025)

It is especially important for the preparation that the current situation and relevant interests can be discussed in concrete terms. The judgment does not make compliance optional and does not rule out lifting the suspension. Nor does it provide a default right to a second chance. Let the lawyer assess how the considerations fit the trial phase and facts. A reference to the ECLI number alone is less useful than substantiation of the actual circumstances that may be relevant to the decision.

Fictional example: treatment postponed, notification missed

In a fictional example, Rens has a treatment obligation and a reporting appointment. The treatment is postponed by the institution. Rens concludes that the message is also of no use for the time being and does not appear. The delay in treatment may be a relevant fact, but does not automatically answer the question of whether the separate reporting agreement still applied. A joint label of non-enforceable conditions actually hides the difference between the two obligations.

Careful preparation preserves the message from the institution, the applicable reporting agreement and the communication on both topics. The lawyer can explain which event is disputed, which error is acknowledged and what actionable follow-up is proposed. This fictional example does not predict a detention decision. It shows that a good explanation for one part does not automatically solve every other part. The concrete connection must be examined without explaining away individual obligations.

Prepare the assessment and remain available

If the Public Prosecution Service requests that the suspension be lifted or a hearing is announced, submit the documents to the lawyer immediately. Check what the judge must decide and what information is still missing. Rechtspraak describes that the suspect and lawyer are given the opportunity to provide an explanation when suspension due to non-compliance is being dealt with. Not showing up does not prevent a decision. Therefore, ask in a timely manner what presence, accessibility and preparation are required in this case.

Keep a complaint about supervision separate from the question of which suspension decision applies. There is a complaints route at the Dutch Probation Service, but a complaint does not automatically have the effect of a judicial change. The same applies to a request that is still being processed. Have it explained which obligations continue in the meantime. Avoid new ambiguity by determining for yourself that supervision or a contact restriction will no longer apply for the time being.

A compliance and events matrix

For each condition, place the text of the decision, practical instruction, stated event and your response next to each other. Then indicate which source corresponds to each part. This makes it clear whether the dispute is about meaning, facts or consequences. An overview of months in which agreements went well can provide context, but does not replace a response to the current incident. Both can be relevant when their meaning is precisely explained.

  • Decision: full suspension conditions, duration and subsequent changes.
  • Implementation: concrete notifications, treatments, instructions and contact persons.
  • Incident: description, date, original data and source of the report.
  • Response: what is disputed, acknowledged or not yet understood, with substantiation.
  • Communication: timely notifications of problems and confirmations received.
  • Plan: actionable change, available help, start date and control.
  • Procedure: calls, claims, accessibility and preparation with the lawyer.

A controllable response is stronger than silent improvisation

A suspension can provide important space for work, treatment and family. Precisely for this reason, the possible return to detention can cause a lot of tension. The best preparation is not to immediately deny every problem, but to carefully assess the facts and the current situation. This can also mean that an error is acknowledged without adopting every legal conclusion of a report or claim.

Use the main guide on suspension for the conditions of a suspension request and the in-depth guide on lifting pre-trial detention for the other decision. Have a necessary change assessed in a timely manner, remain available and keep the current decision as a starting point as long as it has not changed. An executable plan and reliable data make legal assistance more possible, without promising an outcome or calling a violation unimportant. (main guide to suspension · lifting of pre-trial detention)

Questions from litigants

Frequently asked questions

Does every violation automatically mean back to jail?

That should not be taken as a general rule. The judge assesses the concrete situation within the applicable framework. An alleged violation can have serious consequences. Have the facts, interests and possible next steps legally assessed immediately.

Can the probation service adjust each condition itself?

Not every implementation agreement is the same as a change in the judicial condition. Ask what room there is within the decision and when a new judicial assessment is necessary. Do not assume a tacit change.

Does a complaint stop the condition while it is being processed?

Not automatic. A complaint about supervision and a decision about suspension have different functions. Have it explained which obligations apply in the meantime and which procedure suits the problem.
