Ending or suspending pre-trial detention: which decision are you seeking?
Those in pre-trial detention mainly want to know how they can get home. Legally, cancellation and suspension are different questions. When the order is lifted, the continued existence of the order is central; In the event of suspension, execution is interrupted under certain conditions while the order continues to exist. A good request makes it clear which legal assessment is required and which concrete alternative to the risks stated is feasible.

An end to the command or an interruption of execution
Lifting means that the pre-trial detention order is terminated. In the event of suspension, the order remains in force, but execution is interrupted under certain conditions. That difference is practically important. A suspension may have consequences if conditions are not met. The mere wish to be released does not indicate the legal question at hand. The Rechtspraak describes both procedures separately, with an assessment depending on the stage of the case. (Rechtspraak describes both procedures separately)
Our editorial analysis starts with two tracks on the same sheet. The first are the objections to the legal basis for continuation. The second shows the possible alternative if, according to the judge, that basis still exists. The lawyer can assess whether a primary and subsidiary request are appropriate. In this way, an important legal objection does not disappear behind mere personal need, and a practical freedom plan is not omitted because the defense disputes the order in principle.
Which conditions still need to be met?
Pre-trial detention has legal conditions regarding the type of suspicion, the strength of suspicion and the grounds for detention. The relevant rules are included in Articles 67 and 67a of the Code of Criminal Procedure. The precise framework depends on the case. The seriousness of the charge alone does not answer every legal question. Nor is a fear of recurrence sufficient because it is mentioned without concrete substantiation. The defense must be able to see on which facts the continuation is based. (articles 67 and 67a of the Code of Criminal Procedure)
Therefore, make visible for each ground put forward what circumstances the judge or the Public Prosecution Service mentions and what changes have occurred since then. An initial decision may be based on information that is later clarified. An important witness interview may have been completed or a risk assessment may require further information. This does not mean that every new development automatically leads to discontinuation. It concerns the significance for the current legal assessment. A file-oriented response is stronger than just saying that you have already been in prison long enough.
Pretrial detention must not unknowingly become an advance punishment
The law also requires attention to be paid to the relationship between pre-trial detention and what can be expected in the event of a possible conviction. An expectation of punishment or deprivation of liberty is not a definitive prediction of the outcome. Yet it may be relevant to the question of whether continuation is permitted. The suspect remains innocent until proven guilty according to law. Pre-trial detention has its own basis and is not a way to implement a socially desirable punishment.
Discuss with the lawyer which facts, legal qualifications and personal circumstances influence the expectation. A general reference to high legal maximums may say too little about the specific case. Conversely, an internet example with a low penalty cannot be decisive without a comparison. The defense must connect the relevant circumstances with the legal test. This makes the argument verifiable: not only that a sentence will probably be lower, but why the current case justifies that expectation and what that means for continuation.
A request benefits from new, targeted information
Not every repeated request contains a new question. If previous objections have already been assessed, it must become clear what is different now or why a further assessment is necessary. This may concern new file material, the status of the investigation or changed personal circumstances. State exactly what you are relying on. A long letter that repeats previous arguments without addressing the previous reasoning can obscure the new meaning.
Read the previous decision together with the lawyer. Which reason was decisive and which part remains unresolved according to the judge? An appropriate response could be a missing document, independent confirmation, or more concrete plan. Sometimes there is no new information, but a legal objection is still relevant at a subsequent assessment. The procedure and timing require advice. The goal is not an endless stream of requests, but a targeted assessment based on current facts and the right legal question.
An alternative must meet the stated risk
A stable address does not automatically protect against every possible risk. In the case of a stated risk of flight, accessibility and binding can be assessed differently than in the case of a risk of influence or recurrence. A freedom plan must therefore explain which part addresses which problem. Merely promising that you will behave is less verifiable than a concrete proposal with support and clear agreements. At the same time, proposals should not be unlimited or turned into a condition without an appropriate basis.
Ask what measures are actually available and who can implement them. A treatment location may have a waiting list; a family member cannot promise supervision all day if he works himself. Make those boundaries honestly visible. Probation advice can contribute to an executable proposal. The lawyer can check whether the conditions fit the framework and are sufficiently clear. A plan earns its value through workability and connection to the concrete risk, not through the number of strict commitments. (probation advice)
Substantiate work, care and housing in concrete terms
Personal consequences can weigh heavily in a suspension request, but must be made understandable and verifiable. A job loss is more concrete when it is clear what decision the employer is likely to make and within what period. A care task requires an explanation of who is dependent, what alternatives exist and what the absence of that care means. Only share necessary data from others. A medical necessity must be appropriately substantiated without distributing a complete file in an untargeted manner.
Place consequences next to possible solutions. Can work be temporarily adjusted, is an address actually available and can treatment begin afterwards? A statement from a housemate must not only demonstrate willingness, but also clarify the actual living situation where relevant. Keep a distinction between substantive defense and personal interests. The fact that detention is harmful to the family does not prove that the legal basis is lacking, but it can be important for a weighing of interests and a workable alternative.
The right judge and the right stage
Which judge will hear the request depends on the phase and the order. The general explanation of pre-trial detention distinguishes, among other things, judicial pre-trial detention (bewaring) and detention. Let the lawyer determine which request is currently open and which court has jurisdiction. A letter to the institution may contain a practical complaint, but is not automatically the request with which a judge assesses the detention order. The different procedures must remain recognisable. (general explanation of pre-trial detention)
Agree which documents will be submitted in advance, how you will be heard and who will explain the plan. If an interpreter or other support is needed, please report this in a timely manner. Afterwards, ask about the precise decision and its significance for the moment of release. A verbal expectation that a request is appropriate is not an enforceable decision. In the event of rejection, it must be assessed what next step is possible, taking into account the legal framework and any deadlines. Do not make a decision about this solely based on a general procedure page.
Suspension begins a new compliance phase
If suspension is permitted, read the conditions before you have to adjust your behavior accordingly. A reporting obligation, contact ban, location restriction or treatment appointment must be feasible and clear. Ask who will make the first appointment and how you should remain reachable. A condition may also include indirect contact or specific digital communication. A private appointment with a data subject does not automatically cancel the formal requirement.
Immediately discuss what to do in case of unforeseen problems. Who do you report illness, a change of address or a conflict with work? A request for change does not automatically give permission to deviate. The in-depth section on a suspension plan discusses the practical implementation in more detail. A successful application is not only a moment of freedom, but also the start of agreements that must be consistently fulfilled. Keep the decision and contact details accessible and ensure that housemates know which practical boundaries are relevant without distributing confidential file contents. (a suspension plan)
Fictional example: investigation completed and treatment available
A fictitious suspect is in custody while witnesses still had to be heard. These interrogations have now been completed and a treatment place is available. These are two different developments. Completing research can be meaningful for a given ground, while the treatment site can support an alternative for another risk. Simply sending a letter that he wants help now leaves those legal differences undiscussed.
A specific request therefore first addresses why a specific ground is no longer current according to the defense. In addition, where necessary, a suspension plan with a confirmed start date, address and guidance will be developed. The judge can assess both questions separately. The example does not predict release: other grounds or circumstances may continue to exist. It does show how a legal challenge and a feasible alternative can complement each other without becoming the same argument. The evidentiary position and the practical organization remain verifiable.
A two-track decision map
Set up the card with the lawyer. Distinguish between documents that already exist and commitments that still need to be confirmed. Note which grounds each measure or change affects. This makes it clear where the request is legally and practically substantiated. The map is a tool for preparation; Only the competent court decides on termination or suspension and the appropriate conditions.
- Current order: phase, date, judge, legal basis and previous reasons.
- Cancellation: concrete objections to the still existing legal conditions.
- Developments: new documents, completed research and changed circumstances.
- Risks: what, according to the Public Prosecution Service, makes continuation necessary and which facts support this.
- Suspension: available address, guidance, treatment and control per relevant risk.
- Interests: work, care, housing and necessary substantiation.
- Execution: competent court, responsible submitter, decision and compliance agreements.
Frequently asked questions
Is cancellation the same as suspension?
No. When lifted, the order ends; In the event of suspension, the order continues to exist while execution is interrupted under certain conditions.
Is a serious reproach enough to keep me stuck?
Not on its own. The legal conditions for pre-trial detention must also be currently fulfilled.
Does a treatment place entitle you to suspension?
No. A confirmed location can be an important part of a plan, but the judge will assess the entire legal framework and circumstances.
