Pre-trial detention and your job, home and income
Pre-trial detention can start unexpectedly while work, rent, care and payments continue as normal. Legal defense and practical damage limitation must therefore be organized simultaneously. Family can mean a lot, but they don't automatically have access to accounts or authority to make decisions on your behalf. A short, targeted inventory makes it clear what needs to be done today, what information is needed and what questions should be asked to the lawyer or other expert.

The first days require triage, not a complete life administration
In the event of sudden detention, it is tempting to immediately try to solve all the problems at once. That can actually cost you an overview. Start with safety and dependents, then with appointments that will have consequences within days. A child without childcare requires something other than a subscription that expires next month. An impending dismissal or a judicial term requires advice faster than sorting all the old mail. Make that order explicit.
Our analysis uses three categories: immediately necessary, arrange this week and follow up later. Assign one person responsible for each task and confirmation of implementation. Family can provide practical support without taking over criminal defense. The lawyer monitors legal questions surrounding detention and legal position. The Rechtspraak explanation about pre-trial detention describes the broader framework, but the specific administration requires its own plan. The goal is to prevent daily obligations from growing unnoticed into new urgent problems. (Rechtspraak -explanation of pre-trial detention)
Report absence and assess employment rights
Detention can have consequences for work and wages. The employment contract does not end automatically due to actual absence, but the employer can consider measures. The Civil Code, Book 7, provides the employment law framework. What must be reported and what consequences exist for wages or dismissal depend on the specific situation. A general promise that the employer must always continue to pay is not responsible. (Civil Code Book 7)
Request appropriate advice in case of urgent action or termination. A limited absence notification may be practically necessary without the complete criminal file being shared. In case of restrictions, the communication route must also be allowed. Agree who will be in contact, what can actually be communicated and which letter will be received later. Do not ignore a dismissal notice because the criminal case has not yet been decided. Employment law expiration periods can run much earlier than the substantive criminal hearing. The two processes must be coordinated, not wait for each other.
Limited representation is better than unclear access
An entrepreneur may have to arrange payments, deliveries, personnel and legal notifications. A family member does not automatically have the authority to act on behalf of the company. Check existing powers of attorney, banking rights and responsible employees. Make the transfer limited and concrete. A relationship of trust is important, but it does not replace authority and secure access. Sharing all personal passwords can cause unnecessary risks and new ambiguity.
Have urgent obligations prioritized by someone who can lawfully view the administration. The lawyer can advise when communications are affected by restrictions or business documents have been seized by criminal law. A request for access to a necessary file may be a different request than the return of all equipment. Describe the concrete goal and missing alternative. Save actions in a log so that it is clear afterwards who did what. Practical continuity should not lead to changing possible evidence or aligning explanations.
Rent and other housing obligations require active monitoring
Pretrial detention does not automatically make a rent payment undue. Mail with important deadlines may also continue to arrive. Make an overview of fixed costs, balance and existing payment agreements. If there is a threat of arrears, request a suitable arrangement in a timely manner and have what has been agreed confirmed in writing. The idea that a future release will make everything possible again may come too late if a procedure or termination measure arises in the meantime.
Ask who can open mail and which documents should be sent directly to an advisor. A practical authorization for administration is not the same as an unlimited authority to settle or give up rights. Limit shared information to what is necessary. The DJI brochure for preparation for detention provides useful general points of attention, although sudden pre-trial detention is a different starting situation than planned self-reporting. So adapt the practical checklist to what can still be organized quickly and legally. (DJI detention preparation leaflet)
A benefit has its own reporting and stopping rules
The UWV information about detention describes that the consequences differ per benefit. Unemployment benefits are treated differently than certain other schemes. Do not assume unlimited payment or automatic reinstatement after release. Report the detention via the prescribed route and ask what date, statement and follow-up action are required. A benefit letter may also contain its own legal remedies information that deserves attention. (UWV information about detention)
Also check other income-related arrangements and consequences for the household. A family member can have their own position; this may not be equated with that of the prisoner without assessment. Create a simple cash statement for the coming weeks with realistic income and necessary expenses. A payment arrangement is useful, but does not replace notification of a change that is mandatory. Keep receipts and note which re-applications are required after release. This way, it is not only discovered on the day of dismissal that income has not yet been re-arranged.
Insurance and treatment must go through the correct framework
During detention, DJI arranges care and regular health insurance can be suspended. The DJI explanation about insurance makes it clear that the insurance continues to exist and that notification is required. Family members and additional coverage may be treated differently. It is therefore incorrect to simply terminate the entire policy. Request a detention certificate and have the insurer confirm what is being processed for the relevant period. (DJI insurance explanation)
Report necessary medication and ongoing treatment via the authorized care route. A family member can help provide data, but the medical assessment lies with professionals. Share prescriptions and contact details in a targeted manner, without unnecessarily distributing complete files. Don't stop taking medications to make the transition easier. Also ask what needs to be reactivated or transferred upon release. Continuity of care is both a practical and a health interest and deserves its own responsibility, instead of disappearing between the criminal law documents.
Dependent persons have their own urgent interests
Children or other dependents may be directly affected. Make it clear who is responsible at that moment and whether the shelter is safe and feasible. A general commitment from family may be insufficient if school, care or accommodation requires formal permission. Seek appropriate help in a timely manner if no reliable solution exists. The suspect does not have to conduct every conversation himself, but necessary information must reach the right person via an authorized route.
Keep the child out of the substantive evidence discussion. It's not his job to relay messages about depositions or keep the family together. A simple explanation of practical agreements can be more helpful than a broad criminal law story. If a contact ban or other measure is in place, the care arrangement must be tailored accordingly. The lawyer can help determine which legal question is required, while assistance organizes the actual support. The interests of the child are concrete and may not only be used as an argument in a request for freedom.
Substantiate personal interests without replacing the legal question
Work, home and care may be relevant in a suspension request. Make the consequences demonstrable: what date is the risk of job loss, what housing backlog will arise and what care cannot be arranged differently? This information must be assessed in addition to the legal conditions and grounds for detention. The rules of criminal procedure remain the framework. Personal need does not automatically prove that the order should be lifted, but can play an important role in a concrete alternative. (criminal procedure rules)
A usable plan describes available address, guidance and feasibility. Only ask those involved to make commitments that they can keep. An employer who is prepared to offer adapted work can confirm this in concrete terms. A family member can explain what housing or care support is actually possible. The in-depth discussion on termination and suspension elaborates on the two legal questions. Practical harm reduction must continue in the meantime; it must not become completely dependent on the hope that release will follow soon. (Ending or suspending pre-trial detention: which decision are you seeking?)
Fictional example: three problems with different time limits
A fictitious suspect has a job, a current rent payment and a caring role for a parent. The family first wants to wait and see whether he will be released after the weekend. In the meantime, the employer needs to know something immediately, there is a threat of a care gap and rent payment will follow later. The right priority is not to do everything at once, but rather to first organize care and work reporting via an authorized route and plan payment with an authorized administrator.
The lawyer receives concrete confirmation for any request for freedom, without the family promising an outcome. If detention lasts longer, there is already a basis for follow-up. The example shows why a brief overview can work better than panicking all the authorities. Every task has a purpose and a person responsible. The criminal assessment remains independent, while life outside does not come to a complete standstill. This parallel approach limits avoidable damage without making the legal reality smaller than it is.
A priority map for today and this week
Create the card with reliable information and keep sensitive data protected. Make a note of who can lawfully act on behalf of the detainee and what contact restrictions apply. Give each task an upcoming date and check whether it has actually been completed. The map helps practical support and legal assessment work together; it does not grant any power of attorney and does not change any detention or contact decision.
- Today: safe shelter, necessary care and urgent appointments or deadlines.
- Work: authorized absence notification, measures received and appropriate legal assistance.
- Home: rent, fixed costs, post and impending arrears.
- Income: notification per scheme, decision and subsequent reapplication.
- Care: medication, transfer, insurance suspension and contact person.
- Authorization: Existing permissions, secure access, and limits of representation.
- Freedom: concrete interests, confirmed alternatives and separate lawyer assessment.
