Restrictions in pre-trial detention: understanding contact with the outside world

In the event of restrictions during pre-trial detention, contact with family and the outside world can be severely limited in the interest of the investigation. That can feel heavy and incomprehensible, especially when practical matters at home are ongoing. The lawyer remains an important route for legal assistance, but is not a free channel for prohibited messages. For assistance, necessary information and assessment, one must always look at the precise decision and the applicable framework.

Restrictions are a separate measure

Pretrial detention says that someone is deprived of their liberty before a final outcome. Restrictions add a specific limitation of contact or information. They are not the same as every house rule of a police cell or institution. The Code of Criminal Procedure contains the legal framework. Ask what decision has actually been made and which contacts or facilities are included. A general announcement that someone has limitations may not be sufficiently concrete to answer practical questions. (Code of Criminal Procedure)

Our analysis separates the detention order, the restriction decision and the execution at the place of residence. Each may have a different question or complaint. An objection to a refusal to visit is not automatically the same as a request to lift pre-trial detention. A complaint about treatment within the institution does not necessarily have to end the research restrictions. The lawyer can determine which route suits the specific problem and what information is needed to have that measure assessed.

Research interest is not a general penalty in advance

Restrictions may be intended to prevent interference, interference, or other risks to the study. They should not be an additional punishment because a suspicion sounds serious. The purpose and necessity must be assessed within the legal framework. An early investigation phase may have different circumstances than a phase in which relevant interrogations have already been completed. The continuation therefore deserves an up-to-date assessment as facts change.

Ask what specific research interest is put forward, insofar as this can be explained. The defense benefits from a specific question, for example whether a certain contact restriction is still necessary after an investigative step. This does not mean that every completed interrogation automatically removes all restrictions. Other risks may exist. The point is that the measure and the current circumstances must be linked. A general request to make everything normal provides less guidance than a concretely substantiated question about necessity and scope.

Contact, media and information may have different boundaries

Which restrictions apply must be apparent from the decision and implementation. The police describe in an official case explanation how contact and access to media can be limited. Such an explanation is an example of practice and does not replace your own decision. Do not assume that every measure entails exactly the same prohibitions. Ask whether it concerns visitors, telephone calls, mail, fellow detainees, media or other contacts and whether exceptions have been recorded. (police describe in an official case explanation how contact and access to media can be limited)

Have any ambiguities clarified through the lawyer. A family member who receives a letter cannot decide for themselves that a response is therefore permitted. A practical message via a third party may also fall under the restriction. Save the decision and confirmations of permitted actions. The goal is predictability: the suspect, family and executor must know what applies. An unclear ban must be questioned, but uncertainty does not provide the authority to establish the desired contact.

Legal aid is not a detour for family messages

Confidential consultation with the lawyer is essential for the defense. At the same time, the lawyer must adhere to the limits that apply to communication in this situation. He cannot simply exchange substantive messages between the suspect and the outside world. The 2025 disciplinary ruling on a lawyer and restrictions illustrates that compliance with restrictions is also important for the lawyer. A protected role entails its own responsibilities. Therefore ask what can be communicated. Sometimes general procedural information or a necessary practical matter can be addressed through an authorized route, but this must be assessed. Do not pressure the attorney to provide a coded message or deposition information. A question about medication or shelter is different from a statement about what a co-suspect should say. By making that distinction clear, legal assistance remains workable and a request for assistance is prevented from interfering with the research objective.

No news does not mean that the family has to solve the investigation themselves

Limited information can be very burdensome for family. Yet that uncertainty makes it unwise to approach witnesses or other suspects to find out what happened. That can be seen as influence and complicate the situation. Ask one permanent contact person how practical information can be passed on within the applicable limits. A central contact route prevents multiple family members from calling authorities or spreading messages past each other.

Separate facts from conjecture. A neighborhood rumor is not the same as official information about the accusation. Do not publish your own file or accusations on social media to get an answer. Family can especially help by keeping necessary administration, care and existing documents available. The lawyer determines what is needed for the defense at that moment and how it can be received. This support is valuable without the family organizing a parallel interrogation or joint reconstruction.

Necessary medical and practical information must arrive safely

Restrictions do not eliminate the need for medical care or protection of dependent children. Report urgent needs through the appropriate officials and the lawyer. Make it clear what needs to be arranged immediately: essential medication, a care contact or a child who is in danger of being left without care. Ask who will take responsibility for assessment and follow-up. A general message that there are problems at home may not be enough to take targeted action.

Share only necessary personal data and use an appropriate channel. A medication prescription may be necessary without all treatment information being widely distributed. A practical power of attorney may raise questions about consent and communication; have that route assessed. Not every desirable family contact is medically necessary and not every necessary transfer of information has to be an unlimited conversation. A well-defined request helps weigh the interests separately, while the applicable decision remains respected.

Practical consequences require limited, controllable actions

Rent, work and payments often continue while contact is limited. Make a list of urgent obligations and discuss what permissible action is possible. Consider a limited absence notification, arranging care or securing a payment term. The employer does not automatically need to receive the complete criminal file to understand a practical absence. At the same time, employment law or contractual obligations may require separate advice.

The in-depth section on pre-trial detention, work and home discusses this in more detail. In case of limitations, the communication route is especially important. Do not ask a housemate to coordinate statements on behalf of the suspect under the guise of administration. Note who is authorized to arrange financial matters and what existing authorizations there are. Do not share bank codes in a general contact overview. Legal or practical representation must be organized lawfully and is not an automatic consequence of being family. (Pre-trial detention and your job, home and income)

Have continuity and scope assessed in a targeted manner

A lawyer can assess what options exist to challenge or request removal of the restrictions or part thereof. The procedure depends on the decision and stage. Ask for the basis, current reason and competent assessor. A complaint about the implementation may also have a different route. Avoid submitting one general letter that indiscriminately combines detention, visitation, treatment and guilt.

A specific request states what is requested and why it would be responsible. Has a research step been completed, is a certain practical contact necessary or does the restriction go beyond the stated interest? Substantiate with concrete facts. A rejection can then provide an explanation of what is still decisive. The general information about pre-trial detention helps to understand the broader phase, but a favorable assessment of a restriction question does not automatically mean that the suspect must also be released. The detention order has its own legal basis. (general information about pre-trial detention)

Fictional example: arranging childcare for a child

A fictitious suspect is under restrictions while he normally arranges part of his child's care. Family wants him to call various people involved directly. The need for shelter is real, but the route must be assessed. A limited transfer of information via authorized officials or an authorized contact person may be a different solution than an unlimited conversation. The precise decision remains the starting point.

The lawyer presents the care question in concrete terms: which child needs care and when and which existing agreements or contact persons are available? No substantive messages about the criminal case are hidden in that transfer. The example shows that practical help and compliance do not have to be mutually exclusive, but do require organization. It does not say that every request will be granted. The added value is that an urgent interest is presented in a recognizable and limited manner, rather than as a general reason to circumvent the entire measure itself.

A contact card within the applicable restrictions

Have the card compiled through the correct contact person and keep the official decision with it. Do not include prohibited messages or access codes in the overview. Make it clear for each question whether it concerns defense, care or administration. This allows the lawyer or authorized official to determine which route is possible and whether a separate request is necessary. The card itself does not give permission for contact.

Frequently asked questions

Can my lawyer pass on all messages to my family?

Not by itself. Confidential legal assistance is not a general bypass for contact affected by restrictions.

Are restrictions the same as pre-trial detention?

No. The detention and the additional restriction of contact or information have separate bases and questions.

What if there is an acute care need at home?

Report this specifically via the lawyer and authorized official. Ask for a permitted, well-defined solution and do not circumvent the decision yourself.
