A cannabis grow in a home: what involvement is alleged?
A nursery in a building quickly draws the attention of the resident, tenant or owner. However, it must be investigated per person what science and involvement are to be blamed. Cultivation, assistance with cultivation, energy theft, housing measures and benefit calculations are different questions. The most useful preparation separates those traces and makes visible what can actually be deduced from the facts for your role.

Start with your role in the alleged period
A property can legally belong to one person and actually be used by others. Therefore, the question of who owns it is not the same as the question of who operated a nursery. The Public Prosecution Service can investigate various actions: cultivation, presence, co-perpetration or consciously facilitating professional cultivation. Every accusation must be clear about the facts underlying it. A photo of a grow room describes the space, but does not explain the role of everyone involved.
Our analysis starts with a role description per period. Did you actually live there, did you rent out the property, did you perform maintenance or did you only come in occasionally? Note changes, such as subletting or a period of residence elsewhere. A legal title can be helpful evidence, but it is not a substitute for what actually happened. Anyone who only claims to be a landlord leaves open, for example, whether he knew the furnishings, paid for specific facilities or consciously contributed in some other way. Anyone who was only a tenant on paper also needs an explanation of the actual use.
Cultivation and facilitation are not the same charge
The Opium Act contains prohibitions on hemp and rules for certain preparatory or facilitating activities. The Public Prosecution Service's explanation about hemp cultivation also focuses on consciously supporting professional illegal cultivation. It does not follow that every ordinary landlord or supplier is automatically punishable. It must concern the conditions of the applicable offense and what the person concerned knew, should have suspected or did himself within that context. (Opium Act · OM explanation about hemp cultivation)
Therefore, check whether a file actually accuses cultivation or mainly addresses a service, space or material. The evidence and defenses may differ. A rental agreement proves a business relationship, but does not automatically say for what purpose a specific space was made available. An installation voucher may be relevant for the personal contribution, but here too the date, nature of the work and science remain important. Let the lawyer connect the legal qualification to concrete actions rather than to a general picture of the sector.
Five plants are not a general consent
There is persistent confusion about small-scale cultivation. The prosecution policy for soft drugs makes a distinction, under certain conditions, between non-professional cultivation for personal use and more serious situations. This does not mean that a fixed number of plants provides a legal right to a nursery. Professional characteristics and other circumstances may be relevant. Other measures and consequences may also exist in addition to the criminal law policy choice. (prosecution policy for soft drugs)
A useful assessment therefore looks at more than the number. What design has been described, how have power and climate facilities been installed and what indications are there for yield or organization? Don't take such questions as a step-by-step plan for cultivation; they serve to assess an existing file. Also determine which facts have actually been observed and which are based on a standard description. A general photo or list of common features cannot prove without explanation that each feature was present in your property.
An access card makes science researchable
Science is often derived from circumstances: smell, sound, daily presence, a closed room or visible changes. That may be relevant evidence, but the factual basis must be correct. Was the space accessible to you? When were changes made? Did an observation concern the day of discovery or an earlier period? A situation visible in retrospect cannot simply be equated with what a person knew months earlier.
Create an access card with keys, access times and agreed use of areas. Where possible, link these to existing documents: maintenance agreements, messages, travel details or an official address registration. Registration alone does not prove that you never got there; a statement alone does not prove that you were there every day. The combination requires assessment. Do not approach other parties involved to reconcile memories. A lawyer can investigate whether an independent witness or registration can clarify a relevant uncertainty without influencing statements.
Read the dismantling report critically
A dismantling report can describe quantities, equipment, materials and indications of previous harvests. Distinguish between direct findings and estimates. A contaminated installation or residual material may lead to a conclusion, but the precise meaning and period must be explained. Ask which photos belong to which room and whether objects and samples are recognisably registered. A file is easier to check when observations are linked to a place and date.
The defense does not have to play a technical expert itself. However, it can make ambiguities visible: a count that differs between forms, an unexplained time jump or a conclusion that goes beyond the material examined. Note any such differences exactly, with page numbers, and let the attorney determine which questions make sense. Not every administrative error undermines the core of the evidence. The importance lies in the question of whether a difference actually affects the alleged act, size, duration or involvement.
Energy theft requires a separate evidence route
An illegal nursery does not automatically mean that every suspect has also stolen electricity. There may be a separate suspicion surrounding a connection or meter. Then questions arise about the technical situation, the period of collection and one's own role. Moreover, a civil energy claim and a criminal conviction do not follow exactly the same rules of evidence. By summarizing both in one amount, it becomes unclear what the objection is against.
Save the technical report, photos, invoices and correspondence regarding energy consumption. Have a disputed calculation broken down into principles such as usage time, equipment and measurement data. Do not carry out your own actions on an unsafe installation. A safe inspection requires qualified professionals and evidence must be preserved. The separate in-depth study on energy theft in a cannabis case discusses why technical purchase, criminal involvement and the amount of a claim should be examined side by side. Yield calculation is not an automatic consequence of plant number
In an advantage procedure, it can be investigated how much unlawful advantage has been obtained. A nursery found does not automatically provide proof of every stated previous harvest. This concerns the substantiation of the relevant period, revenue and any costs within the applicable legal framework. The criminal case and the benefit procedure are related, but the calculation requires its own interpretation and targeted challenge where there is grounds for this.
Therefore, ask what the number of harvests is based on and what evidence supports the assumed duration. Check whether amounts represent turnover or benefit and whether different parties involved are not allocated the same full revenue without explanation. That does not mean that the defense only has to mention a different final amount. A useful objection goes back to the underlying assumption: a space that demonstrably became available later or equipment that, according to reliable documents, was installed in a different period. Also include data that can support the estimate; selective calculation makes a reconstruction less reliable.
A housing measure does not automatically follow the criminal case
A discovery may have consequences for the use of the building, the rental relationship or a decision by the municipality. Those procedures have different goals and may use different metrics. A preliminary assessment that the criminal evidence is weak does not mean that every housing letter can be ignored. Conversely, a housing measure is not a criminal judgment in which the personal guilt of all residents is established. Take the various documents to an appropriate legal assistance provider.
Create an overview with sender, date, requested response and deadline. Note who is authorized to act on behalf of the owner or tenant and what practical consequences are likely for housemates. Do not re-enter a locked or sealed premises without knowing what is permitted. If personal belongings, medications or business items are inaccessible, discuss a safe and permitted collection route. The first task is that an urgent practical need does not lead to a new violation or to unintentional changes to evidence.
Fictional example: a rented top floor
A fictitious owner rents out an upper floor and lives elsewhere. Upon discovering a nursery, it turns out that he had forwarded an electricity bill several months earlier. The Public Prosecution Service is investigating whether he knew about the cultivation. The invoice may be relevant, but does not automatically explain what he knew about the use. The rental contract alone does not prove ignorance either. The actual communication and access points are necessary to assess that position.
An honest reconstruction contains the contract, payments, maintenance notices and the times when the owner entered. If he saw a technical change, it shouldn't disappear from the timeline because it seems unfavorable. The lawyer can assess what follows from this and what independent data still exist. The example underlines an important distinction: normal rental documents can explain a role, but do not necessarily rule out deliberate facilitation. The legal assessment should be based on the actual facts.
A file card for four different routes
Create one inventory, but give each route its own line. This prevents an objection to a flow estimate from being mistaken for a response to a criminal accusation or municipal decision. The map below is a practical aid. It does not guarantee an outcome and does not replace an assessment of the documents. This allows a lawyer to see earlier where further investigation or separate legal assistance is needed.
- Personal role: actual stay, rental, activities and relevant changes per period.
- Access and knowledge: keys, visits, observations, messages and verifiable uncertainties.
- Cultivation evidence: counts, samples, photographs, technical findings and derived conclusions.
- Criminal accusation: precise offense, form of participation and stated personal contribution.
- Money: separate power claim, benefit calculation and possible criminal seizure.
- Property: rental letters, municipal decisions, consequences for residents and response periods.
- Follow-up: which source documents are missing, who requests them and when is each route discussed?
Frequently asked questions
Am I automatically punishable as a landlord?
No. The applicable penalty provision and your own knowledge and contribution must be examined. Ownership or rental alone does not fully answer those questions.
Can I have five hemp plants?
A policy distinction is not a general legal right to cultivation. Professional circumstances and other measures may also be relevant for small numbers.
Is an electricity claim the same as evidence of energy theft?
No. A civil claim, technical calculation and criminal accusation must be assessed separately.
