Electricity theft in a cannabis case

When a cannabis farm is discovered, an electricity investigation is regularly carried out and a bill is issued for unregistered consumption. However, a technically deviating connection, criminal involvement and the amount of a claim are three different questions. Anyone who only disputes the final amount may leave the evidentiary route undiscussed. Anyone who simply says that they have not used the meter does not automatically answer every accusation of involvement.

A technical finding is not the entire criminal case

An energy theft file may start with an inspection report describing a connection before the meter, damage or other abnormality. That report may be essential for the technical situation. It does not automatically determine who made the change, who knew about it and who used electricity during the entire period studied. Your own involvement requires a separate evidentiary reasoning. In addition, a civil claim can be filed on a different basis.

Our editorial analysis therefore divides the matter into three folders: installation, person and calculation. In the first comes what has actually been technically observed. The second is the link with the suspect and his acquaintance. The third is the stated consumption and damage. This classification prevents a large amount from functioning as proof of debt or from a technical objection being wrongly regarded as a complete response to an invoice. The coherence remains important, but the questions become verifiable.

The legal accusation and form of participation

Electricity can be the subject of suspected theft. The applicable provision and any aggravating circumstances must be apparent from the accusation. The Criminal Code requires an assessment of the conditions for the offense and, where applicable, complicity or complicity. Finding a nursery does not automatically prove every single energy crime. Conversely, a flow deviation is not independent proof of all acts accused under the Opium Act. (Criminal Code)

Ask what period the Public Prosecution Service mentions and what personal contribution is required. Is it about constructing it yourself, organizing it jointly, using it consciously or some other action? A suspect who says he is unable to perform technical work has not yet discussed all possible forms of involvement. A suspect who was only registered at the address is not automatically responsible for every technical action. The lawyer can connect the right conditions to the facts in the file, rather than to general assumptions about residents or landlords.

What should the technical report reveal?

A useful report connects findings to a specific connection and location. Photos, meter numbers, inspection date and a description of the situation encountered will help. Check whether it is clear what was seen on site and what was deduced later. A comment that a connection is unusual requires something other than a documented conclusion that consumption occurred outside the registration. The precise formulation may be important for further research.

Also read which parts were already secured or changed when photos were taken. A necessary security intervention does not automatically make a report unusable, but the original condition must be recorded as accurately as possible. Ask which observations support the conclusion and which uncertainties the expert mentions. Do not repair or inspect an installation yourself to collect evidence to the contrary. That can be dangerous and change relevant material. Have a competent expert assess via the correct procedure which technical questions can still be responsibly investigated.

The duration of the purchase is often a separate estimate

An anomalous connection on the day of discovery does not automatically indicate when it existed. For a calculation, previous meter readings, maintenance, conditions encountered and other indications can be taken into account. Some data is directly dated; others are based on assumptions. Ask what sources are used for the beginning and end of the specified period. A conclusion about previous cultures may not also determine the duration of the same electrical situation without explanation.

Create a timeline with occupancy, renovations, change of users and available measurement data. Include reliable starting points and uncertainties. If a space only became available later, this may be relevant, but it must be investigated whether the argument actually affects the stated decrease. Another tenant on paper does not automatically prove that an installation has been removed or reinstalled. A targeted objection identifies which period is not supported and which existing material can provide further clarity.

Distinguish between power, operating time and actual consumption

An estimate can be based on equipment found, assumed burning hours and a number of periods of use. The connected power is not automatically the same as actual consumption during the entire period. At the same time, the lack of a regular meter registration is not automatically a reason to reject every estimate. The question is whether the chosen principles are sufficiently substantiated and fit the specific situation. Have the underlying calculation made available.

Check whether equipment was demonstrably present and operational, how the useful life was determined and whether parts are counted twice. A defense does not have to recreate an alternative installation. However, an independent technical assessment may be relevant when the calculation relies heavily on disputed assumptions. The in-depth discussion about an expert in the criminal case discusses the formulation of research questions. A good question focuses on a measurable starting point, such as the substantiation of a period of use, rather than solely on the wish for the final amount to be lower. What did the individual suspect know?

A technical adjustment can be visible or hidden. Its meaning depends on access, role and factual knowledge. The mere fact that someone paid an energy bill does not automatically prove that that person knew all the consumption. Conversely, an account in someone else's name does not make your own conscious contribution impossible. Investigate what was known at what time and what actions are appropriate. Retrospective knowledge should not unknowingly replace previous knowledge.

Collect relevant communications about usage, payments and operations. Note who had access to the meter cupboard or room and which visits can be audited. Do not ask other parties involved to agree on a joint statement. If you reported a technical issue, the original report may be important, including the content and time. A statement drawn up afterwards that you knew nothing has a different evidentiary value than a report kept at the time. The lawyer can determine how this information is entered into the criminal file.

An energy claim has its own basis

In addition to the criminal case, a network operator or supplier can demand payment. It must be clear whether it concerns consumption, costs, contractual liability or damage. The civil law rules on liability and damage are not completely the same as the criminal rules of evidence. A rejection of a criminal accusation therefore does not automatically decide every invoice and a paid invoice does not automatically prove all criminal elements. Have both routes read separately. (civil law rules on liability and damage)

Request a specified claim with period, rates and cost items. Make a note of which items you dispute and why. A payment arrangement may be practically necessary, but discuss what you acknowledge and what you reserve. Do not delay a necessary response to a civil letter just because the criminal hearing will take place later. A claim can also be submitted as an injured party in the criminal case; then the process rules of that process are relevant. The correct answer depends on the document received.

Keep evidence without touching installation

In the event of a potentially unsafe electrical situation, immediate safety takes precedence over your own investigation. Do not touch damaged connections, wiring or meter parts. Have competent professionals assess which measures are necessary. Then ask how the condition and necessary interventions are documented. The aim is not that evidence remains at risk, but that necessary security and verifiable recording go hand in hand.

If a property is closed or sealed, take that decision seriously. A desire to take photos does not give permission to return. Discuss with the lawyer which existing photos, reports and inspection data can be requested. Submit a practical need for access for medicines or items separately. The general hemp floor deals with the intersection with home and rental. Safety, access to the property and criminal involvement are related topics, but each requires its own authority and decision. Fictitious example: one final amount, three different objections

A fictitious tenant receives a bill based on long-term use of a certain installation. He disputes the period, states that he only came to the building later and says that he was not aware of a different connection. Those are three different statements. The first is about calculation, the second can touch on allocation over time and the third is about science. Simply stating the amount is too high does not make these differences visible.

Targeted preparation links each statement to existing sources: the actual move date, correspondence about access and the technical report. If he had access before or had work carried out, that should also be included in the timeline. The lawyer investigates what conclusion can follow from each piece of information and what expert question is still open. The example shows why a partially justified objection to the bill does not automatically resolve all criminal questions and why an incriminating technical finding does not automatically support the entire claim.

A control card for installation, person and amount

Use this card to formulate questions for a lawyer and possibly an expert. Take the original pieces with you and do not modify any files or installation components. Note for each finding whether it was directly observed or calculated. A substantive dispute requires more than rejecting the final amount; it must make it clear which principle is incorrect or cannot yet be sufficiently verified.

Frequently asked questions

Does a nursery automatically prove that I have also stolen electricity?

No. The technical assessment and your own criminal involvement must be investigated separately.

Can consumption be estimated if the meter did not register it?

That may be the case, but the principles and period must be properly substantiated. Request the full calculation.

Do I have to take photos of the connection myself?

Do not work on an unsafe installation and do not enter a closed building without permission. Have security and evidence preservation organized by qualified professionals.
