Missing or failing to complete a CBR course
Forgetting a preliminary meeting, falling ill on a course day or being sent away during a meeting: each can cause a different problem. The CBR can link non-cooperation to consequences for the driver's license. The willingness to come later does not automatically solve the previous situation. Our analysis: create an absence file with the exact obligation, event and response. Discuss the practical resumption and any decision separately, so that a new appointment is not mistaken for restoration of all legal consequences.

Which part needed to be completed?
Place the original CBR decision next to the course information. Is there a preliminary meeting, a first day, multiple meetings or another obligation? Note the date, location and the party performing the part. A participant may think that only the visible course days count, while a preliminary conversation is part of the process. The Driving Skills and Fitness Measures Regulations and the own documents determine what cooperation is required and how the lack thereof is assessed. (Regulation on driving skills and fitness measures)
Also distinguish between an educational measure and a study. The daily name CBR course may conceal the fact that the letter actually concerns a different procedure. A medical examination, driving test and educational process do not automatically have the same regulations. Therefore, ask which arrangement will be applied to the specific event. A general reassurance that everyone misses an appointment sometimes does not provide a legal answer. A complete obligation map first shows what had to be done according to the decision and what information was given to you about it.
Capture the event before the memory fades
Make a note of when the appointment was made, what confirmation you received, what happened on the day and when you contacted us. Save original messages, your own agenda and existing evidence of a report. A note immediately after a conversation can help later, but is not the same as an official confirmation. Therefore, include the source for each piece of information. If someone else called on your behalf, it must also be clear who that was and what was actually asked or communicated.
The timeline must be able to show the possible error without hiding it. If you have entered a date incorrectly, please describe it honestly. If the information was contradictory, place both pieces side by side. A very positive story afterwards that does not fit with the confirmation makes the assessment more difficult. The lawyer must be able to distinguish whether there is a communication problem, a valid impediment, a misunderstanding or another form of non-cooperation. These differences determine which pieces of evidence and legal questions become relevant.
An understandable reason is not automatically a valid reason
Illness, an acute emergency or another impediment may be important for the assessment. But the meaning depends on the concrete circumstances and the applicable rules. A work schedule or class day does not automatically make missing a self-scheduled appointment acceptable. Ask how an impediment should be reported, what evidence is required and who will decide on this. A course provider who responds with understanding has not always changed the CBR decision or the cooperation assessment.
Substantiate what the prevention actually meant. In the event of illness, this may concern the functional inability to attend, the course and timely communication. A medical appointment on another day does not automatically explain your absence on the course day. Share healthcare information in a targeted manner and ask what data is needed. The intention is not to place a complete diagnosis in an administrative file, but to make the relevant event verifiable. A lawyer can help determine what substantiation is appropriate and what remains uncertain.
A missed preliminary meeting can have independent consequences
In the Rotterdam District Court on October 5, 2026, ECLI:NL:RBROT:2026:13892 it concerned a missed EMG preliminary interview. The person concerned did appear on a later course day and invoked an administrative misunderstanding and willingness to participate. The court declared the appeal unfounded. One of the factors that mattered was that the person concerned had scheduled the dates himself and had no valid reason for missing the preliminary meeting. Attendance on the course day did not automatically correct this. (District Court of Rotterdam October 5, 2026, ECLI:NL:RBROT:2026:13892)
The ruling decides a specific case and is not a rule that any misunderstanding is always at the expense of the participant. She shows why the entire course structure can be legally relevant. The judge also discussed the possibility of later taking the course to reinstate the driver's license position. That does not make a future solution the same as the unlawfulness of the previous decision. Therefore, always ask which part of the past is being combated and which future path remains necessary.
Participating may require more than just being present
Taking a course may, in addition to appearing, also include substantive or behavioral obligations. Check which conditions were communicated in advance and what exactly went wrong according to the executor. A report that someone did not cooperate must be linked to concrete actions. Was it about arriving late, leaving early, not completing an item or behavior during the meeting? A general qualification does not provide enough information to understand what needs to be corrected or challenged. Request the relevant reporting and explanation.
State your own response factually. For example, describe what instruction was given, what you did and who was present. A difference of opinion with a trainer is not automatically a refusal to cooperate, but criticism of the course does not provide a general exemption from obligations either. Have the lawyer compare the specific report with your own data. Do not try to reverse a formal decision yourself by simply contacting the trainer again. The implementation and legal decision may lie with different parties involved.
Payment and finalization are different parts
A paid course is not completed. Conversely, failure to meet a financial obligation in a timely manner can pose its own problem. The National Ombudsman explains CBR courses and investigations, including the relationship between costs and cooperation. Check which amounts have been paid and which installments have actually been confirmed. A transfer shows the payment, but does not automatically indicate that the course dates have been adjusted or that an absence has been accepted as valid. (National ombudsman explains CBR courses and research)
If there is a lack of money, report this early and ask what arrangement is possible. A requested payment plan is not automatically assigned. Save confirmations and ask what applies while the request is being reviewed. Make the substantive obligations visible separately: do you still have to respond to an invitation or another appointment? A file can go wrong because someone thinks that the financial consultation temporarily pauses everything. The solution therefore starts with an overview in which payment, planning and a possible decision about the driver's license each have their own line.
Invalidation requires its own legal response
The Road Traffic Act imposes consequences for failure to provide the required cooperation. If there is a decision regarding the driver's license, have it read immediately and discuss the legal remedy route. The General Administrative Law Act regulates, among other things, objections and provisional measures. A complaint about the course or a request for a new date is not automatically an objection to the declaration of invalidity. Therefore, note which decision is being contested and how a valid response is submitted.
At the same time, check whether you are allowed to drive at this time. In principle, an objection does not suspend the effect of a decision. A strong belief that the absence was justified does not therefore constitute personal permission to continue driving. In case of specific urgency, a provisional measure can be discussed, with the required procedure and substantiation. Ask for the current status and keep the written decision. A telephone note about re-registration may have a different function than a judicial suspension of the decision.
Fictional example: two dates in one trajectory
In a fictional example, Daniël plans a preliminary interview and three course moments. He only puts the course days in his diary and does not appear at the meeting. A week later he reports for the first day of the course, but cannot participate because the preparatory part is missing. His willingness is real, but the cause does not automatically lie with the performer. The lawyer reviews the confirmation, the information provided and the applicable rules to assess the significance of the missed part.
In a second fictitious variant, the acknowledgment mentions two conflicting dates for the same call. Then another research question arises. Both variants require the original documents, not just an explanation formulated afterwards. The example does not predict a well-founded objection. It makes clear why an absence file must show both your own actions and the communication. A new opportunity to participate may be of practical value, while the previous decision must be assessed separately based on the situation that existed at the time.
A file with event, evidence and follow-up question
Create a small overview that the lawyer can read quickly. State the precise obligation, the reason why it has not been carried out and which decision you now want to have assessed. Also indicate which parts have still been tracked and confirmed. A lot of payment slips without an appointment overview is insufficient; an agenda without the original invitation as well. The question is which source can clarify the concrete difference and what still needs to be done at this point.
- Process: measure, decision, implementer and all mandatory components.
- Planning: appointments made, confirmations, changes and own agenda notes.
- Event: Missed or uncompleted item with date and actual progress.
- Reason: concrete prevention, timely notification and targeted substantiation.
- Report: accusation of non-cooperation and own response with sources.
- Decision: legal consequences, term, objection and possible emergency measure.
- Follow-up: new participation, payment agreement and confirmed current driving license status.
A future trajectory is not the same as recovery from the past
Our conclusion: those who miss a CBR course often have two tasks. The first is to understand whether the previous non-cooperation was assessed correctly. The second is to determine which route is needed from now on to restore the route or driver's license position. A new appointment can serve the second task without automatically overturning the first decision. Therefore, ask in writing what exactly a restart means and which obligations continue to apply. The practical solution and legal protection must be coordinated.
Use the guide on a non-received CBR letter when sending or receiving is the issue and the explanation of CBR objection for the decision route. Have a current invalidation certificate assessed immediately and do not give yourself an exception to drive. A careful analysis recognizes both real impediments and one's own errors, examines what the rules require and makes clear what confirmation is required before recovery can be assumed. Frequently asked questions
Is showing up on the next course day enough if I missed a preliminary meeting?
Not automatic. A preliminary interview can be a mandatory part of the process. The meaning of missing must be assessed against the rules and the information provided. Save the planning and ask in writing what follow-up is necessary.
Is illness always a valid reason?
The specific prevention, notification and substantiation must be assessed. A diagnosis or appointment receipt does not automatically explain why this part could not be followed. Ask how the impediment should be reported and what targeted information is required.
Can I drive because I have registered again?
A new registration does not automatically make a previously invalidated driving license valid. Have the current status checked and ask what decision or completed step is needed. An objection also does not automatically suspend the operation; discuss interim relief if necessary.
