An unfinished community sentence: conversion and challenging the decision

If a community service order is not carried out or is not carried out in full, alternative detention may be considered. The letter about this is not an ordinary reminder that you can leave until work or health improves. There may be a short objection period. A targeted response investigates what went wrong in the implementation, how many hours are still open and whether a substantiated, feasible alternative can be submitted to the court.

What decision did you receive?

A message from the probation service about a missed appointment is not the same as the formal notification that alternative detention is being applied. The source of the original community service is also relevant to the route. Therefore, start with the exact document, sender and case number. The CJIB explanation of objection to conversion mentions the notice and the court where objection can be lodged. A telephone conversation with the executor does not automatically replace that legal remedy. (CJIB -explanation of objection to conversion)

Our analysis separates three moments: problems during implementation, the decision on conversion and the judicial assessment of an objection. Each moment may involve different documents and responsibilities. Anyone who only tries to make a new working agreement after the formal decision has already been made may miss the process step that is now necessary. Immediately ask the lawyer which route applies to your document and whether other sanctions or regulations apply. Not every letter containing the word community service has exactly the same procedure.

Fourteen days requires verification of the service

Article 6:6:23 of the Code of Criminal Procedure regulates an objection to the notifications referred to within fourteen days after service. The exact beginning must therefore be tested against the documents. A letter date and a legally valid notification are not always the same. Take the term seriously and do not wait for a full discussion with the probation service. Let the lawyer assess which action is now necessary and which substantiation needs to be supplemented next. (Article 6:6:23 Sv)

Store envelopes, delivery documents and receipt notices. Ask for confirmation that the objection has been submitted to the correct authority. A complaint about treatment, a request for payment or an email to the workplace is not automatically the required objection. If the period appears to have expired, seek immediate advice regarding the actual commencement and any legal options. Do not assume that it is irreparable, but neither do you give the impression that every late response will still be dealt with. The procedural position must be determined in concrete terms.

Hours already performed and the original assignment

For an assessment it must be clear which community service order was imposed, which term applied and how many hours were actually performed. A difference between your own count and registration can be important. Ask for the timesheet and relevant confirmations. Make a distinction between available hours, accepted work and an appointment at which you ultimately could not work. Not every stay at a workplace automatically counts in the way you expected.

Also check whether multiple community service orders or cases are mixed up. A certificate of completion of one community service order does not exclude an outstanding portion in another case. For each case, put the assignment, start, hours worked and remaining part on its own line. The legal regulation of community service orders and substitution and the concrete decision together form the starting point. A correct calculation is important, but does not solve every question about culpability or further implementation. These topics also need to be prepared. (statutory regulation of community service sentences and substitution)

Read the negative report step by step

A report can describe missed appointments, warnings, behavior or unsuitability for the workplace. Ask what facts led to the negative closing. The CJIB page lists, among other things, the negative outcome report and relevant decisions as documents that can be requested. Don't just read it based on the final conclusion, but by date, event and the opportunity you were given to respond or correct it. (CJIB page lists, among other things, the negative outcome report and relevant decisions as documents that can be requested)

Make an overview of what is correct, what is disputed and which source belongs to it. A factual error about a date requires a different response than a difference about the reason for absence. If an alert was not received, the contact details and shipping method used are relevant. Don't just say that no one called you if written communication also exists. The lawyer can assess the significance of the execution history. A targeted dispute should address the real reason for conversion and not an entirely different workplace disagreement.

Not being able to and not wanting to are different facts

Health, disabilities, care or work may influence the performance. They are not a general exemption from community service, but they can be significant for what happened and what solution is possible. The specific cause must be substantiated. A statement that you were ill provides less information than a time-bound confirmation of which activity was not possible and what communication took place about it. Do not give a medical conclusion that has not been established.

Also make visible which steps you took. Have you reported your absence in time, requested an alternative or provided necessary information? A real problem can become less convincing when communication is delayed for a long time without explanation. Conversely, a demonstrably timely report may require a different assessment than an unexplained absence. Share necessary health data securely through an agreed channel. The aim is for the judge to be able to assess the actual possibility and responsibility, not for every unfavorable moment to be covered afterwards with a general excuse.

A last chance must be practically feasible

If further implementation is requested, a concrete plan is required. When can you work, what restrictions apply and what guidance or suitable workplace is available? A full-time job can pose a scheduling problem, but even then it must be investigated how an imposed community service order can be carried out. A blanket promise to prioritize is less useful than confirmed availability and a proposal that can work within the relevant time frame.

Have the executor assess the feasibility where possible. The probation service can provide important information about planning and suitable work, while the judge decides on the objection. Don't promise a start date that no one has confirmed. If treatment or care is needed first, explain how the transition will be organized and why the plan is more than a postponement without resolution. A feasible proposal makes future compliance verifiable. It does not automatically eliminate any previous shortcomings, but may be relevant to the requested decision.

What the judge can assess

The judge can assess and change the Public Prosecution Service decision within the applicable legal framework. If it is found to be well-founded, the scheme contains options to determine remaining community service hours and a completion period. This does not mean that every objection leads to a new opportunity. The facts, implementation history and the plan remain important. Ask the lawyer what will be central to the hearing and exactly what decision is being requested. A general desire not to go to prison is understandable but insufficiently specific.

Bring together the original decision, notification, relevant reporting and substantiation of the plan. If you have language problems, have appropriate arrangements arranged. Agree who will explain the substantive response and which questions are still open. If multiple cases are involved, it must be clear whether the decision concerns all or just one community service order. Afterwards, ask for the exact outcome and practical next steps. A verbal expectation that it will be resolved is not a substitute for a court decision or a new implementation agreement.

Do not rely on a supposed automatic pause

A submitted objection and the actual implementation of alternative detention must be carefully coordinated. Do not assume automatic suspension in every situation based on a general internet rule. Ask the lawyer and competent authority what applies to your decision and what confirmation is required. Do not ignore a notice or other official instruction without assessing the legal position. A procedural uncertainty requires immediate clarification.

If the appeal is rejected or only partially helpful, have the remaining options and consequences explained. Any new planning must be clear in writing. The in-depth information on self-reporting for detention relates to a different implementation framework and may not be used as a standard route for every conversion. The difference between alternative detention and a newly imposed prison sentence also deserves attention. The words prison and conversion do not in themselves indicate which rules belong to the document received. (Reporting to prison to serve a sentence)

Fictional example: illness reported but no resumption arranged

A fictional participant reports an acute illness and rightly misses a day of work. After that, it remains unclear when he will resume and he does not respond to messages for weeks. The disease can explain the initial absence, but not automatically the entire subsequent course. An objection must therefore address both parts: what was not medically possible and why was communication or resumption delayed? The negative reporting must be compared with this.

A new plan contains available medical information, accessibility and an executable schedule that has been discussed with the executor. The example makes it clear that a partially valid reason does not automatically eliminate every shortcoming. At the same time, a concrete recovery option may require a different assessment than a general assumption that someone does not want it. The lawyer submits the past and future feasibility separately to the judge, within the correct procedure and period.

A conversion card with time, hours and recovery plan

Use the card immediately after receiving the notification. Do not postpone legal assistance until everything is complete. The inventory helps to substantiate the objection in a targeted manner and makes visible which implementation documents still need to be requested. Report own counts as own counts and indicate the source of any medical or practical limitations. The card itself does not give a new chance or postponement; this requires the competent decision.

Frequently asked questions

How long do I have to object to conversion?

For the notifications referred to, Article 6:6:23 of the Code of Criminal Procedure specifies fourteen days after service. Have the onset checked immediately and do not wait for advice.

Is calling the probation service sufficient?

Not by itself. An implementation meeting does not automatically replace the required objection to the competent court.

Do I always get another chance to complete the community service?

No. The judge assesses the circumstances and the applicable framework. A concrete, feasible plan can be important, but does not guarantee allocation.

This article provides general information. The rules and options depend on your situation. Discuss your case and possible deadlines with a lawyer.
