Reporting to prison to serve a sentence

A self-report call gives time to arrange practical matters, but is not an appointment without obligation. You must know where and when to report and what to do if there is a truly unforeseen urgent obstacle. Work, children, home and care continue in the meantime. The best preparation makes those responsibilities concrete and checks the legal status, without relying on a verbal expectation that postponement is likely to be possible.

An execution letter is not a new criminal hearing

A self-reporter receives a call to undergo a custodial sentence. The DJI explanation about self-reporting describes the role of the implementing agencies involved. The call does not mean that the criminal case will be substantively dealt with again. If you do not understand what punishment is being carried out, this should be clarified immediately with the lawyer or competent authority. Your own suspicion that the case was still ongoing is no reason to ignore the letter. (DJI self-notification explanation)

Our analysis starts with a call card: which decision is being implemented, how much remains to be undergone and where and when should you appear? Check the personal details and case numbers. In the case of multiple sentences or previous detention, a calculation may require explanation. The criminal law enforcement rules and the official position are leading. Do not wait with practical preparation until every detail has been clarified if the date is already approaching, but let the legal question and necessary organization be dealt with in parallel. (criminal enforcement rules)

The place and time of the call are decisive

Read the exact setting, date and time. Another prison or a self-chosen later time is not automatically a valid replacement. Ask which documents need to be taken and plan transport with sufficient margin. If there is an acute delay en route, please contact us immediately using the official contact details and save relevant information. A missed call may have consequences for the manner in which the punishment is further carried out.

The DJI information makes it clear that failure to report can lead to arrest and loss of self-reporting status. That is no reason to panic, but it is a reason for timely, concrete preparation. A family member who calls the institution cannot simply agree on a new date on behalf of the competent authority. Have deviating agreements confirmed by the person who decides. The practical peace lies in a well-read call and a controlled route, not in the general idea that a few days' difference probably doesn't matter.

An exceptional request requires quick and specific substantiation

DJI mentions very urgent, unforeseen circumstances and a period of seven days after receipt of the call for a request for postponement. Have the current instruction in the letter and the official DJI page assessed immediately. A usual work problem or the desire to go later does not automatically mean that a postponement will be granted. The reason and supporting documents must be presented in concrete terms via the correct route. (official DJI page)

A submitted request does not automatically change the reporting obligation. Ask who decides and what confirmation is needed before treating another date as valid. If a term problem exists, seek immediate advice rather than considering the call invalid yourself. A careful request describes the event, why it could not have been anticipated, and what limited solution is needed. The goal is not an indefinite postponement, but a verifiable assessment of a concrete obstacle. Save application, receipt and decision together.

An absence must be arranged practically and legally

A prison sentence can have consequences for your employment or company. An arrangement for leave or replacement is not automatically available and requires coordination. Discuss what information the employer actually needs and, if necessary, seek employment law advice. An employer cannot postpone the execution of the sentence itself. Even an important assignment does not provide its own exemption from the reporting obligation. Keep the practical work question and any formal postponement request separate.

A business may require a fiduciary or limited authority. Record which payments or actions that person is allowed to make and which access is secured securely. Don't share a general password list with a large group. An appropriate authorization or banking facility can be better than unclear actions on behalf of each other. Also create a transfer list of urgent obligations. The quality lies in a limited, feasible arrangement that allows continued work during absence without requiring new personal permission every day.

Fixed costs do not stop because you are temporarily absent

Rent, energy and other obligations may continue during detention. Create a realistic overview of income, expenses and available resources. A direct debit does not prevent an account from remaining unpaid if there is insufficient balance. Request appropriate agreements in a timely manner in case of payment problems. Do not assume that the landlord or bank will automatically be notified or that a future release date will solve the problem on its own. Keep confirmations of arrangements.

Also have mail and official messages managed in an authorized manner. A trusted person must know which documents are urgent and who provides legal advice. An authorization for administration is not automatically an authority to make substantive statements everywhere. Agree on the boundaries. The DJI information leaflet for self-detectors offers practical preparation. Your own overview remains necessary because family, home and debts differ per person. The goal is to prevent an implementation period from causing an unnecessary accumulation of new problems. (DJI information leaflet for self-detectors)

Health insurance is suspended, not simply deleted

According to DJI, health insurance will continue during detention but will be suspended while DJI arranges care. Inform the insurer via the correct route, for example with a detention statement. Family members on the policy and additional insurance may be treated differently. The general announcement that the entire insurance policy will end can therefore lead to wrong choices. Ask what is required for your policy and the restart after detention. (DJI's health insurance will continue to exist during detention but will be suspended)

Discuss necessary medication and treatment with the authorized healthcare contacts before the reporting day. Take only what is allowed by the institution and follow the instructions for prescriptions and transfer. To make the transition easier, do not stop treatment on your own. A list of active ingredients and dosage can be useful if it is reliable and up to date. Share health data through an appropriate channel. Continuity of care is a concrete organizational topic and should not only be discovered when you are at the gate.

Reporting and later reapplying have their own rules

The UWV information about detention describes consequences that differ per benefit. Benefits do not automatically continue indefinitely and a new application or reopening may be necessary after detention. Report the change in a timely manner and ask which date and documents are relevant. A sentence enforcement letter to you does not automatically mean that every other agency has already processed all the necessary information. Keep track of the confirmation of your report. (UWV information about detention)

Do not make a general calculation based on someone else's arrangement. Different rules may apply to different benefits or allowances. Also ask what will change for your family and what information is needed after release. The practical preparation therefore includes two moments: what must be reported before detention and what action is necessary afterwards? Keep the discharge certificate and other relevant documents. A forgotten re-application can cause a financial hole, even if the original notification was made correctly.

Care and responsibilities must actually be arranged

If children, other dependents or pets rely on you, a concrete care plan is needed. A general promise that family will help may be insufficient. Agree who is responsible and when, what permission is required and who can be reached in an emergency. For children, school, care and existing parental arrangements may require attention. If the shelter is not safe or feasible, seek appropriate professional help in a timely manner.

Keep practical support separate from the criminal law explanation that you want to share with family. A child does not need to understand the entire file to know who brings it, picks it up and takes care of it. Ensure that the responsible person has necessary information without unnecessary sensitive data. A family agreement does not automatically change the reporting obligation. If an acute unforeseen family circumstance raises a question of postponement, this must be assessed via the formal route. The care plan and the request remain two separate responsibilities.

Fictional example: postponement requested, but no decision yet

A fictitious self-reporter requests a postponement within a short period of time due to an unexpected care problem. He has confirmation of receipt and thinks he no longer needs to appear while the request is pending. That is a risky conclusion. The receipt says that the application has arrived, not that the notification date has changed. The applicable call must be followed until another competent decision is known or the concrete legal situation has been assessed differently.

The lawyer requests the status and helps substantiate the healthcare problem in a limited and verifiable manner. At the same time, a shelter alternative is being investigated in case a postponement is not granted. The example shows why parallel planning is necessary: a serious application and practical preparation can exist at the same time. It makes no prediction about allocation. The client must know which date is legally valid and what evidence is available, so that an unclear administrative moment does not lead to loss of self-reporter status.

A reporting card for the last week of preparation

Use the card in addition to the official call and setup instructions. Give each task a responsible and confirmed status. The card is not a permission for postponement and does not replace the notification letter. It helps transfer necessary items in a controllable manner and makes visible what needs to be reactivated after release. Limit shared personal data and access to what is actually needed.

  • Call: decision, setting, date, time and required documents.
  • Postponement: any concrete grounds, submission, receipt and competent decision.
  • Work: absence, replacement, limited authorization and urgent assignments.
  • Property: fixed costs, post, payment agreements and reliable manager.
  • Care: medication, transfer, insurance suspension and restart after detention.
  • Income: notification per benefit or scheme and required reapplication documents.
  • Family: safe shelter, necessary permission and contact persons available.
Questions from litigants

Frequently asked questions

Can I come later if I have requested an extension?

Not by itself. A request or acknowledgment of receipt does not automatically change the call. Have the current decision and reporting obligation checked.

Will my health insurance disappear during detention?

According to DJI, it will continue to exist but will be suspended. Report detention and ask for family members, additional coverage and restart.

Does every authority automatically know that I am going to detention?

Don't assume that. Check per agency which notification and documents are required and save the confirmation.
