Complaining about your criminal defence lawyer: choosing the right route

A missed appointment, unclear bill or dissatisfaction with a criminal case can seriously affect confidence in a lawyer. However, not every problem requires the same complaint route. Sometimes quick clarity is needed about a current term; sometimes it concerns services, a declaration or possibly disciplinary culpable behavior. Our analysis: first determine what needs to be repaired and what decision you require. A complaint may not obscure an urgent criminal law step. A good file distinguishes agreements, events, consequences and the desired answer, without automatically regarding the disappointing outcome of a case as a professional error.

A complaint and an ongoing defense require two agendas

Start with the current criminal case. Is there a hearing, hearing or legal remedy on the calendar and who will handle that step? A discussion about the office does not automatically change that date. Ask in writing who is responsible for an urgent action and when confirmation will follow. If trust is lacking, another lawyer can assess continuity. The guide to switching lawyers addresses that separate request for help. Switching and complaining can go together, but they are not interchangeable actions. (change lawyer)

Therefore, make two lists: what is needed now to continue the case and what needs to be substantively investigated later. Put at the top who monitors which list. A client can be rightly angry and still need practical transfer. A lawyer can dispute a complaint and still have to provide clarity about the file and agreements. Keep the contact businesslike and specific. An urgent question about a deadline deserves a recognizable subject line, so that it does not disappear in a long general complaint letter.

An unfavorable outcome does not automatically prove defective work

A criminal case can end badly even though the lawyer worked carefully. Conversely, a favorable outcome can exist despite deficiencies in communication or execution. Therefore, describe the specific act or omission that is the subject of the complaint. Was information not shared, an agreed step not carried out or an invoice insufficiently explained? A general sentence such as my lawyer has done nothing is more difficult to investigate than a specific agreement with date, response and consequences.

Separate your own expectations from what has actually been agreed. A lawyer who discusses a risk does not automatically provide a guarantee about the judge's decision. An order confirmation, email or conversation report can help determine what has been agreed. Also note when something is only apparent from memory. This makes the complaint fairer and more verifiable. The aim is not to collect as many accusations as possible, but to describe a problem in such a way that the lawyer involved and any assessor can respond substantively.

Use the complaints procedure for a recognizable initial treatment

The NOvA describes the office complaints route as a way to have problems about a lawyer handled. Request the applicable regulations and the contact details of the complaints officer. State which event is presented, which documents support it and which answer is requested. The Regulation on the Legal Profession contains requirements for the arrangement and treatment. An internal conversation can be useful, but make sure you submit a formal complaint clearly when that step is necessary. (NOvA describes the office complaints route · Regulation on the legal profession)

Make the query actionable. For example, request an explanation of a specific declaration rule, confirmation of an appointment or an opinion on information not provided. A demand that the office must change the criminal decision does not fit within the authority of a complaints officer. Also ask when an answer will be given and how the treatment will be recorded. A new agreement on recovery deserves the same precision as the original assignment. This way no second ambiguity arises that can only be discussed later with different memories.

A financial dispute needs its own substantiation

An invoice includes research into the assignment, rate agreements, work, specifications and payments. Ask which items are unclear and which answer is missing. A total amount without comparison with the agreements says little about the accuracy of the invoice. The rules of conduct regarding the relationship with the client provide a professional framework for cost information and declarations. Also read the specific agreement; general rules of conduct do not replace what has been agreed in this assignment.

The route for a dispute about services or declarations may partly depend on affiliation with a dispute resolution body and the applicable conditions. Do not assume that every office is automatically affiliated with the same committee. Please inquire and record which external route is included in the scheme. Let us also discuss what a dispute for payment means. Filing a complaint does not automatically erase an invoice and paying an arbitrary part does not automatically resolve the substantive difference. A clear written position prevents the dispute from growing due to new assumptions.

Disciplinary law starts with the right complaint recipient

The Discipline Council describes that a disciplinary complaint is submitted to the dean and not directly to the council as a first step. The dean investigates the complaint and can try to find a solution. The local dean belongs to the district where the lawyer has an office. Check the current submission method and provide the requested information. A general post on social media or a bad review on a website is not a substitute for that procedural step. (Council of Discipline describes)

Disciplinary law concerns the professional standard and should not be presented as a direct debit route for a claim for damages. Which assessment or provision is possible must be considered separately. Therefore, clearly state what you are asking for and why this route is particularly suitable. A client may need explanation, recovery, assessment or compensation; those are not necessarily the same outcomes. By distinguishing these goals, a lot of time can be prevented from being spent on a procedure that cannot solve the most important practical problem.

Don't wait until the criminal case is finally over everywhere

Article 46g of the Advocates Act has an expiration period that is in principle three years after the complainant knew or could reasonably have known of the act or omission. The law has a special arrangement when consequences only become known later. Have the concrete application assessed; start and end points cannot be safely determined using only the year in which the criminal case took place. A lengthy procedure does not automatically mean that every complaint about previous actions can wait indefinitely. (Lawyers Act)

Any claim for damages or other dispute may also have different terms. Do not assume that an internal complaint discussion will automatically stop those deadlines. Create a timeline with event, announcement, discovery of consequences and correspondence conducted. Ask specifically what action is required to retain rights. It is better to ask that term question individually early on than to wait for a fully completed reconstruction. A missing email can be retrieved later; an expired term can pose a completely different problem.

A professional error and its consequences require separate assessment

Anyone who wants to recover damages must investigate more than the question of whether something could have been done better. Relevant may be which standard has been violated, what damage actually exists and how this is related to the actions. A missed opportunity does not automatically equal the entire sentence imposed or all costs of the case. Have an independent assessment carried out when substantial consequences are involved. A complaints handler and the lawyer who takes over the criminal case do not automatically have the same assignment.

Save invoices and documents about concrete consequences, without tracing every burden back to one cause. If a deadline has been missed, it must be investigated what procedure could have followed differently and what uncertainty exists. An extensive sense of injustice is understandable, but does not replace that analysis. An insurance notification or a response from the office must also be read carefully: confirming receipt is different from admitting liability. Note which step has actually been confirmed and which question is still open.

Fictional example: accessibility and a declaration are mixed up

In a fictional case, Noor receives few answers to questions about her appeal. At the same time she receives an unexpected invoice. She writes one angry letter in which she asks for the entire punishment to disappear and for everything to be paid back. The office only responds to the invoice and the urgent question about the appeal remains unclear. The complaint contains understandable concerns, but the goals and deadlines are not recognizably separated. As a result, the most important practical risk is not sufficiently visible.

A better approach first determines who is handling the remedy and what date applies. The complaint about accessibility is given concrete examples and the declaration is placed next to the order confirmation. Noor then asks for a reasoned answer via the correct arrangement. This fictional example does not conclude that the office made a mistake. It shows how different questions need their own substantiation. A careful complaint allows for both recovery and substantive assessment, without expecting one recipient to resolve every legal consequence.

Seven rules for a testable complaint

Use a chronological overview with brief references to original pieces. Add a few relevant documents rather than an unorganized entire message archive. Also mention what is still missing and why it is important. Someone else must be able to see which question is asked in which procedure. This increases the chance of a substantive answer and limits misunderstandings about the purpose of the complaint. Keep the card up to date if a new lawyer takes over the criminal case or if part of the dispute is resolved.

  • Urgent: ongoing criminal case, next deadline and confirmed person responsible for the next step.
  • Agreement: assignment, rate, promised action and original source of evidence.
  • Event: specific date, act or omission and what has been communicated about it.
  • Result: established disadvantage, missing information and distinction between damage and disappointment.
  • Purpose: explanation, recovery, claim assessment, disciplinary review or investigation into liability.
  • Route: complaints officer, applicable dispute resolution, dean or separate legal assessment.
  • Deadline: announcement, submission, confirmation of receipt and separately the request for retention of rights.

A complaint becomes stronger through a precise goal

Our conclusion is that precision mainly helps the client. A complaint with a concrete purpose provides room for recovery and makes it clear when independent assessment is necessary. This does not require that the client already legally knows all the answers. It does help to separate agreements, events and consequences and to keep original documents. A criminal outcome may give rise to questions, but does not constitute a complete assessment of the service provided. The quality of the complaint lies in the verifiable points that are actually submitted to the lawyer.

In the meantime, protect your own criminal case. Ask for clarity in a timely manner about assistance, transfer and legal remedies and have another lawyer take a look if there is a lack of trust or continuity. Use the guide to attorney fees for the financial framework. A complaints procedure can be valuable, but it must match the desired outcome. With two clear agendas, one for the defense and one for the complaint, a real problem in the service is prevented from unintentionally leading to new process problems.

Questions from litigants

Frequently asked questions

Do I have to complete my pending criminal case before I can complain?

That is not a general condition. Pay close attention to the applicable complaint deadlines and at the same time protect current deadlines in the criminal case. If necessary, discuss transfer of defense and complaint as separate steps.

Can I go directly to the Discipline Board?

The usual disciplinary route starts with a complaint to the competent dean. He will investigate the complaint. Check the current filing requirements and determine whether disciplinary law is in line with the purpose of your complaint.

Will I automatically receive compensation for my damages if I make a well-founded complaint?

You can't assume that. Assessment of professional conduct, a declaration dispute and a possible liability claim are different questions. Have it investigated what damage exists and which route suits the desired result.

This article provides general information. The rules and options depend on your situation. Discuss your case and possible deadlines with a lawyer.
