Conditional release in the Netherlands: preparation and conditions

When is someone allowed to go outside under certain conditions after a prison sentence? The well-known answer after two-thirds is often incomplete and may turn out to be incorrect under the current regime. Conditional release first requires a reliable penalty calculation and then an individual decision with conditions. Our analysis: an expected date only becomes useful when it is clear on which ruling, which legal regime and which implementation that date is based. Preparation also goes further than arithmetic. Housing, supervision, treatment and the position of victims must be discussed in time, so that a possible departure can also be carried out in a practically responsible manner.

Freedom under conditions remains part of the execution of the sentence

Conditional release, often due to under certain conditions, allows a transition from detention before the relevant custodial sentence has been fully served. It is not an acquittal, pardon or expungement of the remaining sentence. The legal basis is in the Code of Criminal Procedure, in the rules on enforcement. Keep this arrangement separate from leave, a penitentiary program or other implementation methods. The same words about going public can mean different legal decisions, with different conditions and consequences if agreements are not kept.

That distinction helps in conversations with family and employer. A possible date is not the same as a definitive permission to move, travel or start work without restrictions. Ask which document the expectation is based on and what still needs to be decided. A plan can be useful for the time being if its uncertainties remain explicit. Problems mainly arise when a calculation in a conversation changes unnoticed into a commitment and others base irreversible agreements on it. Therefore, record which step is still open and who provides information about it.

Old and new rules can continue to play side by side

The Public Prosecution Service's instructions for conditional release distinguish the regime from the old scheme from 1 July 2021. The date of conviction in the last actual instance is important for the transition. Merely looking at the date of the commission or the first ruling may therefore be insufficient, for example if an appeal has been lodged. Let the lawyer determine which regime applies to the punishment in question and which transitional provision it is based on. An internet example from another prisoner may be about a different regime. (OM instruction for conditional release)

With multiple punishments, this check becomes extra important. Various statements, subsequent performances and previous interruptions may be at play. A family member who adds up all the months and takes a fixed percentage may miss legal differences. Collect the statements and current implementation information in one file, but keep the individual titles visible. Ask for an explanation of the calculation in understandable parts. This makes it possible to specifically point out a missing statement or incorrect start date, without presenting your own calculation error as an alleged administrative error.

What duration of sentence gives initial legal effect?

The new probation scheme basically provides for a completely unconditional prison sentence of more than one year, with statutory exceptions. For more than one and less than two years, the legal starting point is after one year plus one third of the remaining part. From two years onwards, the starting point is two-thirds, while the period under the new regime is a maximum of two years. These are entries into the assessment, not a personal release guarantee. A partially suspended sentence or special execution situation requires a separate check.

A simple calculation example makes the limitation visible: with a nine-year prison sentence, two-thirds results in six years, but three years thereafter. does not fit within the new maximum period of two years. Even after that, the actual decision remains dependent on the applicable legal assessment. This example abstracts from settlement, multiple penalties and special circumstances. Only use it to recognize the fallacy about always two-thirds. The personal date must follow from the official execution calculation and the correct regime, not from a general percentage in an article.

The Public Prosecution Service assesses more than the calendar

Under the new regulation, the Public Prosecution Service decides on whether to grant vi.i. and that decision may be postponed or turn out to be negative. Behavior during implementation, risks and interests of victims and other stakeholders are relevant within the legal framework. DJI and the probation service can provide information and advice; Additional advice can also be provided in complex cases referred to for this purpose. A favorable calculation date does not take away that assessment. Therefore, ask what information is available for individual assessment and what data still needs to be supplemented or corrected.

The practical preparation focuses on verifiable facts. Is treatment only desired or is there actually a place available? Is the residential address provided suitable and has occupancy been confirmed? What agreements exist about work or income? A plan that depends on three unconfirmed commitments should be described as tentative. That is not unnecessary pessimism. It shows where timely action is needed and prevents a decision from being based on a paper provision that turns out not to exist upon departure. Also describe what happens if a facility starts later.

Read the obligation as it is actually imposed

Special conditions can affect various areas of life, such as treatment, contact, residence or supervision. The concrete decision determines what applies. A summary of a fellow inmate or an old concept does not provide a sufficient basis on which to adapt behavior. Read starting time, duration, scope and responsible authority. For example, ask what a contact ban means for unavoidable meetings or indirect contact and how problems should be reported. Do not assume your own exception because an agreement turns out to be practically inconvenient or someone says they have no objection.

Feedability deserves attention before the first day outside. A reporting obligation may conflict with working hours, a travel route may pass through a prohibited area and treatment may have a waiting period. Do not solve this by implementing the condition differently yourself. Discuss the bottlenecks with the lawyer and supervisor and ask what formal clarification or changes are needed. A desire to change and an actual changed decision are different things. Therefore, keep confirmations and check whether an appointment by an executor has also been made sufficiently authorized for the specific obligation.

Objection to the decision is different from discussion about conditions

The Public Prosecution Service instruction describes judicial legal protection against non-granting of a warrant, postponement of the decision and revocation. Against the v.i. associated conditions, that objection route is not open in the same way. The legal basis, term and submission method must be assessed based on the specific decision. Do not automatically use the standard administrative law period of six weeks here. Immediately submit an unfavorable decision to the lawyer and keep a record of when and how it was announced, so that the right step can be taken in a timely manner.

Anyone who finds a condition unclear or unenforceable does not therefore have permission to violate it. Ask what route exists to receive an explanation, change or assessment and what applies in anticipation of this. Nor does a complaint about the treatment by an authority automatically replace the legal remedy against a substantive decision. Keep those questions separate on the overview. In this way, not only is dissatisfaction expressed, but also the appropriate action is taken by the person responsible for it. Check whether the submitted document has actually been received and registered correctly.

Supervision requires a plan for normal disruptions

A release plan is often written as if everything is going according to schedule. In reality, a train may be canceled, treatment may be rescheduled or housing may come under pressure. Determine in advance who can be reached in the event of a problem and how a change will be reported. A disruption does not necessarily have to lead to the same legal response, but independently concealing it can worsen the situation. Save relevant messages without producing evidence afterwards that wasn't there. Transparency about a practical problem starts with timely and factual reporting.

Only involve loved ones in agreements that they can actually bear. A partner can help with transportation, but cannot automatically take over the responsibilities of supervision or care provider. The same applies to an employer who offers a workplace: the offer letter must be clear about hours, start and restrictions. Our analysis is that feasibility is mainly reflected in small, concrete agreements. An impressive plan without contacts and confirmations may be less useful than a more modest plan in which living space, support and daily accessibility are actually arranged.

Fictional example: the date is correct, the preparation is not yet

In a fictional situation, Karim expects to go outside based on his own calculation. His sister says she has a room available, but still has to ask permission from the landlord. A treatment institution has only planned an intake. Karim already tells his future employer a fixed start date. During the preparation, it appears that not only is the formal VI decision missing, but also that various facilities are still uncertain. The calculation was therefore at most one part of a much larger assessment and implementation plan.

The lawyer first checks the regime and execution calculation. The guidance team then makes visible which commitments are firm, which conditions need to be explained and which temporary solution is possible. The fictional example says nothing about the final decision for Karim. It shows why preparation does not only start after a departure date has been set. If all practical questions are left until the last minute, a legally possible transition can also become difficult to implement. A timely approach maintains both clarity about rights and realism about daily obligations.

Seven sources for one controlled planning

Make the planning version-sensitive: note the source for each date and when it was received. A previous calculation may change due to a new statement or correction. Keep the old version with a clear indication that it has been replaced. The card must be able to be understood by a loved one without having to do legal calculations themselves. For each unknown part, ask who can confirm it and when feedback will follow. This makes the overview useful for consultation with a lawyer, institution, guidance and any future supervisor.

  • Title: full ruling, last factual instance and applicable old or new regime.
  • Calculation: sentence duration, relevant settlement, subsequent sentences and source of each date.
  • Decision: current status, documents received and parts that still need to be decided.
  • Housing: confirmed address, permission, actual availability and any restrictions.
  • Support: treatment, income, work, contacts and actual start dates.
  • Conditions: text, probationary period, supervision, understandable explanations and reported implementation problems.
  • Legal protection: type of decision, announcement, appropriate route and evidence of timely action.

A departure date must be legally correct and work practically

Our conclusion is that v.i. cannot be responsibly interpreted as merely a reduction in punishment. The new regime includes legal limits and individual assessment at departure, while older businesses can keep their own rules. A careful file makes visible what has been calculated, what has been advised and what has actually been decided. This prevents incorrect expectations without taking away possibilities. The same care helps after departure: understanding terms and contact routes allows common issues to be discussed earlier before they become a bigger implementation problem.

The explanation of a suspended sentence can help to understand the difference with a conditional sentence imposed by the judge. Let the lawyer know v.i. Always assess your own statement and performance documents. A name, percentage or period from another scheme does not provide a reliable answer to the personal situation. Collect the correct source versions and confirmations now. In this way, the substantive discussion can be about the actual conditions for a responsible transition, instead of about a date that seems to have become certain only through repetition.

Questions from litigants

Frequently asked questions

Do I always go home after two-thirds of my sentence?

No. Regime, type of punishment, extent and individual decision are decisive. Under the new scheme, a maximum period of two years applies. Have the official foreclosure calculation and applicable transition rules checked before basing personal agreements on a date.

Does the new regulation apply to every old criminal offence?

The date of the commission alone does not determine this. The transitional rules look, among other things, at the conviction in the last actual instance. In the event of multiple rulings or appeals, this may require additional investigation. Use the original court decisions to establish the regime.

Can I adjust an unenforceable condition myself?

No. Discuss the specific problem immediately with the lawyer and supervisors and ask what competent explanation or change is required. A request is not yet a changed obligation. In addition, check which legal protection is actually available for the decision or condition in question.
