A drug laboratory is discovered: presence and criminal involvement
The discovery of a suspected drug lab often leads to a major investigation with multiple suspects and technical reports. However, presence on the premises, renting space and criminal production are not the same facts. It must be clear to each suspect which act, knowledge and contribution are being accused. Careful defense starts with your own role, without underestimating the dangers of a potentially contaminated or unsafe location.

A research name is not a proven production process
In initial reports, a location may be designated as a drug lab while the technical investigation is still ongoing. This may involve active production, storage, a dismantled installation or possible preparation. These differences are legally important. Ask what was actually found and what action the Public Prosecution Service charges. A room with objects that can be used in drug production is not, without further assessment, the same as proven production by everyone present.
Our analysis starts with three separate questions: what was the function of the location, what happened during the alleged period and what connects you to it? A technical report can mainly address the first question, while observations or communications should support the second and third. A large number of photos does not automatically constitute a complete personal argumentation. The defense must be able to test the connections, including the possibility that a room was used by different people or for different purposes in different periods.
Substance, act and date determine the legal framework
The Opium Act contains various prohibitions and lists. Since 2025, List IA has also been important for certain groups of new psychoactive substances. Production, attendance and preparation do not automatically have the same conditions. The Public Prosecution Service guideline for lists I and IA from 2025 makes this distinction visible for criminal proceedings. A current case should therefore not be explained solely with an old scheme of two lists. (Opium Act · 2025 OM Guideline for List I and IA)
Have it determined which substance or group the research concerns and which regulations applied on the date in question. A new ban should not be applied unnoticed to previous behavior. In the event of a preparatory suspicion, it is also important what the law requires for the list and action in question. The defense does not have to draw chemical conclusions from a trade name on packaging. Ask about the samples examined and the precise reporting. The legal qualification must fit the established facts and time, not just the seriousness of the investigation name.
An expert report states what was investigated within the assignment
Technical reporting can describe substances, equipment, traces and the possible function of an installation. Read what question the expert was asked and what limits he indicates. A conclusion that something is suitable for a process is not the same as evidence that that process was carried out by a specific person on a certain date. Sampling may also only concern part of the location. The scope must be clear from the report.
Check that sample identifications, photos and locations match. If there is any uncertainty, ask what additional information is needed, without immediately assuming that the entire study is unusable. The NRGD code of conduct emphasizes verifiable, expert and independent reporting. A specific question about a technical conclusion may be more useful than the general request to have another report written. The lawyer determines how such a question is submitted procedurally and whether existing information or actual additional research is necessary. (NRGD code of conduct)
Access, knowledge and actions per suspect
Someone can be a tenant, driver, employee, visitor or owner. That role says something about possible access, but does not automatically determine the required criminal involvement. Conversely, someone without ownership or daily presence can still consciously contribute. This concerns the applicable description of the offense and form of participation. A personal timeline makes visible which actions are associated with you in which period and what the evidence is.
Record access times, keys, assignments and actual activities. Make it clear what you observed yourself and what you later heard about the location. An agreement about the transport of ordinary goods requires a different evidentiary assessment than a documented contribution to a prohibited process. The context must be examined, not filled in favorably afterwards. If you don't know what a room contained, it remains unknown. The lawyer can test whether the stated knowledge can be deduced from the available circumstances and what exculpatory research is still possible.
Co-offending requires more than just the same location
In an investigation with multiple suspects, roles may be related. The Criminal Code sets conditions for participation. A joint implementation or other sufficient contribution must be assessed on the concrete facts. Family ties, friendship or repeated presence are not automatically proof of complicity. At the same time, a contribution outside the actual production space may be relevant. The assessment should therefore not only look at who was standing next to a device at the time of the raid. (Criminal Code)
Create a role card with the stated action, the evidence and the period. A telephone contact can support an appointment, but the content and attribution are important. A payment can show a business relationship without itself proving the criminal purpose. Ask how the Public Prosecution Service links the individual data together. A useful defense challenges a concrete inference or presents a verifiable alternative. Simply saying that you are not the main suspect does not answer the question of your own criminal contribution.
An unfinished trial can still raise criminal law questions
A defense that nothing had yet been produced may be relevant to a production offense, but does not automatically rule out a preparatory offense. This applies to its own conditions regarding actions, objects and required knowledge or intention. The legal regulations differ per situation and list. The in-depth section on preparatory actions for drug production deals with that border separately. It is not enough to use the missing final production as a universal answer to all accusations. (Preparatory acts for drug production)
Conversely, the presence of usable objects does not automatically prove their punishable purpose or your knowledge. Document legitimate assignments or business context with original documents, where they actually exist. The question is not whether an object can ever be used legally, but what purpose and involvement are proven in the specific case. An artificial alternative without connection to the actual delivery does not help. The lawyer can assess the difference between general usability and the prohibited purpose stated in the file.
Safety limits own evidence collection
A suspected manufacturing site may contain chemical, fire, or other hazards. Do not return to collect items, take samples yourself or photograph the facility without appropriate permission and safety assessment. The importance of a defense does not make an unsafe act justified. Ask through the lawyer what material has already been recorded and how the necessary independent review can be safely organized. Preservation of evidence and protection of people must be managed together.
If personal belongings or company documents are not accessible, make a concrete list. A limited, permitted collection or inspection route may require a different consideration than unlimited access to the entire location. Respect closure or seal. Do not change objects or files to refute a suspicion. A new situation can actually make the original image uncontrollable. The relevant question is what was present at the time of the find and what has been reliably recorded about it, not what can later be arranged for a favorable interpretation.
criminal seizure, home and benefit are separate processes
In addition to the main case, criminal seizure, a benefit calculation, environmental questions or measures surrounding the property may be involved. Not every decision uses the same benchmark or has the same deadline. For example, a question of freedom during pre-trial detention is different from the question of whether a vehicle should be returned. An owner may be faced with housing or rental questions while the personal criminal docket is still being investigated. Collect all letters, not just the summons.
Make it visible for each process who decides and what you want to achieve. A claim for damages or clean-up costs requires its own substantiation and cannot be answered solely with the argument that the criminal case is still ongoing. Conversely, a payment of fees is not an automatic full recognition of production or participation; the agreement and consequences must be assessed. The lawyer can help maintain coherence without turning all proceedings into one unclear conflict. This is especially important when different people and legal entities are involved in the same location.
Fictional example: maintenance of a rented business space
A fictitious mechanic performs maintenance on a business premises and is later approached as a suspect after discovering a lab. He only states that he has carried out an ordinary assignment. The order form may be relevant, but does not yet tell what was visible on site or what work was actually done. The Public Prosecution Service may have other data that support science or a specific contribution. Both sides need to be examined.
A reliable preparation includes the original order, date, invoice, communication and a description of what the technician actually saw and did. If the assignment contained unusual instructions, they should not disappear from the overview. The lawyer compares these facts with the technical report and accusation. The example shows why an ordinary professional title is not a free pass, but also why an attendance trace does not prove full production involvement. The concrete action and knowledge at that moment remain the focus.
A role card with technical and personal evidence fields
The card helps to make an extensive file readable. For each piece of information, state the source and indicate whether it concerns an observation, expert conclusion or personal memory. Do not access a dangerous or closed location to complete it. The lawyer can use the inventory to determine which documents, witnesses or expert questions actually contribute to assessing his own suspicion.

Frequently asked questions
Is presence in a drug lab enough for a conviction?
Not automatic. The specific criminal act and your own knowledge and contribution must be assessed.
Could there be a criminal case if nothing had been produced yet?
Yes, under certain circumstances preparation or another action can be blamed. This applies to its own legal conditions.
Can I go back myself to collect exculpatory photos or samples?
Do not do so without appropriate authorization and safety assessment. Have evidence preservation and investigation organized by professionals and the lawyer.
