Missing an appeal deadline: reconstructing notification
You hear that a ruling is final, while you thought you could still respond or only just became aware of the decision. Two questions must then be separated: when did the statutory period begin, and if it has actually been exceeded, is there an exceptional reason to excuse it? An accurate reconstruction of documents and notices is more important than simply explaining that the situation was confusing.

Act first, then work out the entire history
In the event of a possible missed deadline, further waiting may worsen the position. Contact a lawyer as soon as possible and have them assess what action needs to be taken immediately. A request for an explanation or a letter of complaint is not automatically an appeal. The correct procedure for setting and its confirmation must be checked separately. Do not wait for legal assistance until all old documents have been completely recovered.
Our editorial analysis separates an urgent process step from the subsequent reconstruction. The lawyer can determine whether and how to file an appeal while the admissibility is still being investigated. The timeline is then substantiated with documents. That is no guarantee that the case will be heard. It does prevent a possible step from being lost because someone first collects correspondence for weeks. Ask for clear confirmation of what has actually been done and what assessment is still outstanding.
Fourteen days is not a complete calculation
For appeals in criminal cases, a period of fourteen days often applies. The rules in Article 408 of the Code of Criminal Procedure determine when that period begins, depending on, among other things, presentation, presence and circumstances that demonstrate familiarity with the ruling. The Rechtspraak also mentions exceptions to starting immediately after the statement. A separate count from the day you opened a copy is therefore not always correct. (article 408 Code of Criminal Procedure · Rechtspraak also mentions exceptions to starting immediately after the ruling)
Place the summons, deed of delivery, hearing details and notification of the ruling side by side. Ask whether the service was personal and what relevant information you previously had. The absence of a reminder is not the same as the absence of delivery. Conversely, a file registration may require investigation if the actual receipt is disputed with reasons. A term calculation must be based on the legal scenario and reliable data, not on the most favorable date from different letters.
Familiarity is more than a document date
A statement may have been sent on a certain day but you will receive it later. You may also have previously acquired relevant knowledge in a different way. What knowledge is legally sufficient for a term start requires an assessment of the circumstances. A superficial report that something has happened does not automatically equate to sufficient familiarity with the final ruling. But a clear personal statement that you knew the decision cannot be ignored either because the paper copy came later.
Therefore, carefully reconstruct communications: telephone conversations, messages from the lawyer, receipts at an institution and any statements during an audit. Save original messages with date. When you remember a conversation, write down who the conversation partner was and what you remember for sure. Don't include precise wording that you don't actually remember. The lawyer can assess which moments are legally relevant and which additional documents are needed to check the notification.
Excusability has a high threshold
If the term has actually been exceeded, treatment is not automatically possible because the case is substantively important. The Supreme Court confirmed in 2021 that special circumstances that cannot be attributed to the suspect are necessary. In that case, the plea of excusability was not accepted. This underlines that a general explanation of misunderstanding or confusion may be insufficient. The judge assesses the specific cause and attribution of the excess. (Supreme Court confirmed in 2021 that special circumstances not attributable to the suspect are necessary)
Therefore, make it clear which circumstance prevented timely action, in what period and with what evidence. It is not just about the seriousness of a problem, but about the connection with missing the deadline. A difficult personal period can be real without legally explaining the entire delay. It is also necessary to consider what happened once the obstruction ended or the error became known. Let the lawyer choose the ground for exception; a list of generic excuses does not strengthen an accurate argument.
An incorrect statement requires exact proof
Information from a competent authority may in some circumstances be relevant to the assessment of a deadline error. Content, sender, moment and context are important for this. A communication before the expiry of the period may have a different meaning than reassurance afterwards. The general idea that someone said on the phone that it was still possible must be investigated as concretely as possible. Not every unclear comment results in legally justified trust.
Search for written confirmations, a contact record, or existing notes. Please state honestly when a note was made afterwards. An incorrect personal interpretation of a correct explanation differs from demonstrably incorrect information. An error by an authorized representative or lawyer also requires a personal assessment and is not automatically treated as excusable. Discuss both the legal remedy and any separate complaint or liability issue. The latter route does not automatically restore access to appeal.
Language problems deserve concrete documentation
A language barrier can affect comprehensibility and notification. The rules regarding interpreters and translators and the applicable criminal law guarantees are important. However, not every untranslated letter means that a term never begins. The rules applicable at the time must also be examined; a ruling on an old notification cannot automatically determine the current obligations. Have it determined which document, which explanation and which translation were relevant. (rules about interpreters and translators)
Describe what you could actually understand and what help you asked for or received. Was a statement signed, in what language was the content explained and was there a professional interpreter? Avoid general assumptions based on nationality. Someone can understand the colloquialisms but miss a legal consequence, or vice versa. A carefully recorded communication question helps the lawyer assess the correct legal argument. It remains necessary to make the connection with the deadline exceeding concrete.
An obstacle must be linked to the relevant period
Illness, mental disorder or other serious impairment can affect the ability to act. The legal meaning depends on the nature, duration and actual consequences. Merely stating a diagnosis does not prove that no relevant action could be taken within the entire period. Conversely, a demonstrably serious obstacle cannot be dismissed with the general statement that everyone must open mail. The specific circumstances require appropriate substantiation.
Discuss with the lawyer what medical information is necessary and how it can be shared safely. A practitioner can describe facts about the period without deciding legal admissibility. Also state when recovery or support became available and what steps were taken afterwards. A timeline with gaps must remain recognizable as such. Do not adapt a medical document afterwards to the desired period. The persuasive power lies in reliable information about actual performance in the relevant period.
Inadmissibility and a substantive judgment differ
If an appeal is declared inadmissible, the substantive content of the case will not be reassessed in the same way. The legal question may then be whether a legal remedy is available against that decision and on what grounds. A new letter to the same judge does not automatically replace such a route. Have the ruling and legal remedies information assessed immediately. The implementation of the original decision may also become a separate question.
Revision is also not a standard emergency exit for every missed appeal. This extraordinary legal remedy has its own strict grounds. The in-depth section on revision discusses that limit. It is better to honestly determine what options still exist than to give false hope that a substantively strong story always sets aside a closed period. The file reconstruction remains valuable, but the purpose and procedure must be consistent with the decision that is actually at hand. (Reviewing a final criminal conviction through herziening)
Fictional example: Received a copy after a previous communication
A fictitious suspect receives a paper copy of a judgment and counts fourteen days from that day. However, old reports show that he previously spoke to his lawyer about the decision. That previous conversation may be relevant, but the content needs to be established. An announcement about only the hearing date is different from an explanation of the final ruling. The date of the copy does not independently resolve that question.
A targeted reconstruction collects the roll call, previous presentation documents and the original messages. The lawyer assesses which legal scenario applies and whether an appeal to an exception is necessary. The example does not say that a lawyer's meeting always starts the term. It shows why a reliable assessment needs multiple sources and why it is risky to only use the last letter received. The precise beginning and a possible apology remain separate questions.
A notification card with cause and next step
Complete the card as soon as possible, but do not postpone urgent advice until it is complete. Mark missing pieces and ask who is requesting them. Include the source for each date, so that a reminder does not unknowingly acquire the same status as a certificate of award. The map helps the lawyer to assess the correct legal start, any excess and possible grounds for exception.
- Ruling: judge, case number, date and relevant final decision.
- Issuance: summons, summons, method of service and available documents.
- Knowledge: first relevant information about the pronunciation and the original source.
- Action: when and how appeal was actually filed and confirmed.
- Obstacle: concrete cause, duration, evidence and connection with failure to act on time.
- Then: moment of discovery or recovery and immediate follow-up steps taken.
- Procedure: current decision, possible remedies and responsible lawyer.
Frequently asked questions
Does the term always start when I receive the copy of the judgment?
No. The legal commencement may depend on previous award, presence or relevant fame. Have the specific situation assessed.
Can a missed term always be corrected if I have a good reason?
No. The threshold for excusability is high and requires special, unattributable circumstances with a concrete connection with the exceedance.
Can I wait for all the old pieces first?
Do not postpone urgent legal assistance advice. Have it assessed which action is immediately necessary while missing pieces are requested.
